Michigan Legislature Introduces Gun Owner Protection Legislation

As the Michigan state Senate finishes its second week of the new legislative session, pro-gun legislators have already begun to advocate for the rights of law-abiding gun owners. State Senator Thomas Casperson (R-38) filed a bill that would keep the personal information of permit-to-purchase applicants confidential and exempt from Freedom of Information Act requests. This bill, Senate Bill 49, has been scheduled for a hearing on Wednesday January 23 in the Senate Judiciary Committee at 8:30 am.

In other parts of the country, anti-gun media outlets abused their privileges under the Freedom of Information Act and have jeopardized the safety of law-abiding citizens by publishing the names and addresses of registered gun owners. Contrary to their claims, these media elites have not increased public safety. Rather they have simply provided a map for criminals to use on their next burglary. SB 49 would make sure that never happens in Michigan by exempting permit-to-purchase applications from Freedom of Information Act requests.

Please contact your state senator and the members of the Senate Judiciary Committee and urge them not to endanger the rights of people that have applied for a permit to purchase and those that have registered the pistol as required by Michigan law. It has been reported that some of the gun owners in New York who had their names and addresses published have already had their houses burglarized and their guns stolen. Your help is needed TODAY to make sure that never happens in Michigan.

Michigan gun owner protection.

Introduced by Sen. Tom Casperson (R) on January 16, 2013, to establish that state databases containing information on licenses issued to individuals to purchase, carry, possess, or transport pistols are confidential and not subject to disclosure under the state Freedom of Information Act (FOIA). The bill was introduced after a New York newspaper published the names and addresses of gun owners it acquired from a state database (since then New York has also banned releasing this information).

Referred to the Senate Judiciary Committee on January 16, 2013.

As I understand it, there’s also a proposal floating around to protect guns made and owned in Michigan from federal regulation.

I haven’t been able to find anything solid on it but I’ll keep my eyes open.

I don’t know of any manufacturers but I do know there are plenty of guys who customize guns. Such a law would certainly encourage small manufacturers.

My neighbor has a 30.06 that he basically built for himself. He bought the barrel from great britain of all places, had another neighbor hand carve the stock and machined the rest for himself.

This is a "medical marijuana law" for gun owners. If a federal ban on Modern Sporting Rifles or full capacity magazines is passed at the Federal level, no state law is going to prevent the Feds from enforcing Federal law on your arse.

Though there is one already, I hope people create a bunch of “private gun reseller” service, intended to avoid government accessible paperwork trails. Taking advantage of the misnamed “gun show loophole”, to purchase guns then resell them as private sales for cash only.

Currently the scam is that, while the government may or may not follow its own rules in not recording who has purchased guns, dealers are required to do so. And so the federals or even the local police can go to the gun dealer and demand to see who they sold guns to.

And there are reports of the feds copying the entire ledger of gun dealers, though that is not entirely legal.

So, one bright and sunshiny day, when the DHS shows up at the house of some reseller, claiming that he owns dozens of rifles, shotguns, and handguns, which they can identify by serial number, and are there to confiscate, he can just shrug, and say, “sorry, sold ‘em.”

When they ask, “To who?” He can honestly say, “No idea.”

Getting angry, they demand to see his sales receipts. “Aren’t any.” Credit card records? “None”. Canceled checks? “Nope.”

“We have no warrant, but we don’t need one, so we will now proceed to search and tear about your trailer.”

“Won’t find any guns or ammo, and I’ve got ‘police trashing your home as harassment’ insurance. And I don’t own any pets you can kill or children you can kidnap, either.”

“You are acting like a terrorist, citizen!”

“Nope. A revolutionary. An American revolutionary.”

Than what I would really like to see is a wanted poster for Obama for treason.

Any agent of the federal government included, that sets foot in state to attempt to enforce extra constitutional federal laws or executive orders, etc.

I thought Michigan House Bill 5225 (HB 5225)was suppose to address registration? It appears the bill was passed but was amended(watered-down)by the senate in order to get Snyder(who had reservations)to sign it. More info HERE.
