Toward An Article V Amendment Convention

Posted on 08/24/2013 3:38:50 PM PDT by Jacquerie

Take a look ahead.

Despite our nation’s free fall into totalitarianism, congress recoils from using its power of the purse and impeachment. Only a small cadre of conservatives call for a state amendment convention to go around congress, and defeat the eighty year assault on liberty called progressivism. Obamacare, Benghazi, F&F, illegal appointments, open borders, use of executive agencies to silence political opponents, suspension of the laws, fag marriage, a foreign born president . . . are insufficient to cause serious resistance. While Obama is the face of those recent assaults on our freedoms, he had plenty of help from congress and scotus; all three are culpable.

Since these muggings of our sovereignty are insufficient to prompt many calls for impeachment or an Article V state amendment convention, one should ask oneself, “what will?” What outrage will move two thirds of the states to put an end to tyranny? I don’t know, but it will have to be a political nuclear blast, something on the order of Obama suspending the 2016 election.

So at some horrific point the Obama administration commits a crime that finally goes over the top. The congressional GOP will, as usual, whimper in a corner while the rats commend Obama for his courage. Does it not stand to reason that all three branches of the consolidated government will lock arms to secure a hundred years’ worth of power, wealth and honor accumulated at the expense of the states and the people? Of course.

Of course the statists will find tyrannical justification to counter an Article V amendment convention. It is as certain as sunrise tomorrow. The favorite and easiest method will be to punt opposition to the federal courts. Rather than refer to the law of the land, scotus will divine godlike wisdom from unintelligible precedent to either put the brakes on the amendment convention or muck up the works. Appeals will take years, which is the intent. . . while our nation suffers.

If that happens, if the statists seriously attempt to sabotage the end run our framers gave us . . . it will truly be over. Then and only then will I listen to those whose solution involves lamp posts and rope, for by that time there will be no other choice.

IF an article V movement starts to gain traction....I see the possibility of dumbocrats playing dirty...

Hello?

Do yourself a favor, and read Whistleblower, Marinka Peschmann, 2011; subtitle, How Clinton White House Stayed in Power to Reemerge in the Obama White House and on the World stage.

The progressives have been playing dirty for 20 years. The Obama regime is like Clinton's, on steroids. 1993 was the genesis of what we are facing today.

Well not to be a Debbie downer but your chances of getting killed in a drone strike are better than any ammendments to the Constituion happening any time soon.

There is no need to ammend the Constitution. The Constitution is just fine. The people trampling on it are the problem. Focus on that instead.

“...The Constitution is just fine.
The people trampling on it are the problem...”

You see, right there in those two short sentences you contradict yourself.

If people are trampling on the Constitution, then it ain’t “just fine”.

Levin’s suggestions would shackle the tramplers and restore the original intent.

Getting fifty state legislatures to do the heavy lifting to restore our republic is far from lazy, useless or easy.

We're talking about structural changes to restore federalism, to divide power once again between DC and the states.

The 10th ammendment is all we need to reign in the Federal govt. States are already [finally] starting to exercise it.

"Reign" in??

Take the time to review Levin's amendments. The structure of the government and their reach into the states and our lives will be severely restricted.

The choices are to either press for state initiated amendments or accelerate into tyranny.

Progressives have been playing dirty for more than a century...

I was merely offering my thoughts about one way they (and the GOP-e) might try to stop amendments from an Article V convention.

On the contrary, socialists will welcome a Constitutional Convention. History has already proven a Constitutional Convention can be dangerous. Many delegates attending the 1787 Philadelphia Convention were under the impression the purpose was to merely modify the Articles of Confederation.

However, James Madison and Alexander Hamilton had planned prior to the Convention to replace the Articles of Confederation with a Constitution. The result was an entirely different form of government. The same could happen with another Constitutional Convention. The process can completely change once delegates get behind closed doors. No one on the outside will be able to stop them. It will be an opportunity those seeking to destroy the Constitution will use to their advantage to create a far more centralized, powerful and dangerous government than already exists.

No one has proposed a Constitutional Convention
in the way that you describe.

The Constitution has no such provision.

The discussion is in regards to
an Article V State’s Convention to Propose Amendments.

Two more logs to toss on the fire ...

First, name MARK LEVIN as chairman of the Amendment Convention. Good luck trying to pull any underhanded political crap after that!

Two, start thinking about people in your state that you trust. No, I didn’t say “politicians” that you trust. I mean people who are honest and willing to help their neighbors and fellow citizens. We are going to need such people to attend the Convention on our behalf.

That convention was held prior to ratification of the current constitution. The Constitution's supremacy clause does not allow for a runaway convention, because Article V only allows for calling for amendments to the Constitution.

That doesn't mean that someone can't offer an amendment like what the Senate uses to gut a House bill into a spending origination bill, such as Amendment XXVII: The constitution in its entirety is abolised and replaced with this..." Try getting that amendment passed at the convention, and then try getting 3/4ths of the states to pass it.

Wow. Somebody actually gets it. This “amend the Constitution” crap is like discussing the design of a future fire sprinkler system while the building in question is engulfed in flames.

No need for drama. Simply follow Nancy Reagan’s advcice and Just Say No.

Most of our federal government problems could be solved by applying the tenth amendment. Unfortunately, traitor in chief Roberts has never read that much of the Constitution.

Exactly. Few if any conservatives would be allowed to participate. Patrick Henry was right last time around.

I am not defeatist because I don't associate myself with the failures in the GOP and will adapt in my own way to the inevitable death of the Republican party.

I'm trying to shame you and other panty-wetting conservatives into acting like men instead of legalistic dweebs who think another piece of paper is going to save you.
