rock them back on their heels... start filing charges against the administration for the entire laundry list of crimes they’ve committed. make them defend themselves non-stop until the election

attack your enemy... it’s how you win the battle

Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.”

Even if he does declare Tea Party Republicans to be in a state of rebellion, the Congress itself is granted the power to enforce the provisions it contains. So John Boehner would have to be complicit.

“Boehner should pass a bill funding only payments on the current debt. See if the senate even votes on it.”

in the original house CR there was a section 138 that exempted debt interest and principal from the debt ceiling

http://www.gpo.gov/fdsys/pkg/BILLS-113hjres59eh/pdf/BILLS-113hjres59eh.pdf

i think when Boehner says he is not going to cave and give a no conditions CR, and that he will not allow a debt default, this is what he is thinking about

It will float very well if he wants it to. I think that’s why Boehner has been scared enough to kick into gear.

It will not come to this, but if it did the Supreme Court would side with Obama.

Obama is not specifically ruling out using the 14th Amendment to increase the nation´s borrowing ability if the political impasse continues and Congress fails to do so...

I assume Boehner and his committed brave band of Congresspersons have prepared the documents necessary to immediately process impeachment procedures to challenge the delusional Kenyan, and then file an emergency challenge to defend the Constitutionally limited prerogative of the House exclusively to deal with revenue matters before the Supreme Court.

Unless Obama is prepared to get the Chinese, Saudi Arabia or George Soros to fund the multi-trillion$ loan on his Visa Card.

When does Obama care about breaking the law?

We have known the answer to that since 2009.

Yes he HAS. AND NO, HE CAN'T!

How? Easy, he read Section 4, but skipped Section 5.

4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

What part of the 14th amendment allows him to do that?

The 14th amendment specifically assigns this power to Congress.

Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.”

Probably there, but the debts would need to be authorized by law, hence the debt ceiling. Maybe zero would argue that there's no need for a ceiling because of this clause of the 14th Amendment.

But section 5 would probably sink him. This power seems one that is delineated to the Congress.

I’m looking more at section 3.

The part he's probably proposing to use reads:

The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned...

But as usual he reads it selectively, ignoring the part in italics

Kind of like regulating intrastate commerce seems to be one delineated to the States?

2/3rds of the house won't go for it. They know they'd be next.

3. No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Don't get me started on that one. Commerce Clause jurisprudence has distorted Federalist ideals and allowed this uber-large Federal government to become so powerful.

He can usurp that power, but the Constitution does not give him that power.
This is within the prerogative of Congress. He is talking about trespassing upon the jurisdiction of a co-equal branch of government.
But when has law—and Congress—stopped him? They haven’t challenged him until recently. Stand up to this bully!

http://scarinciattorney.com/the-constitution/amendment-14-04/
“The question that is being raised, then, is whether the debt ceiling is even constitutional in the first place.”
This is typical behavior for this president, and Congress until recently:
“Yeah, well, we’ll, uh, just kick this can down the road ... “:
Securing our southwestern border, national infrastructure (bridges, roads, etc.), spending/budgeting, defense .....

Congress, watch Ted Cruz! Fight this puffed-up muslim bully! Do your jobs!
Toss out the federal deadwood. Come up with a budget! Pay for defense, toss out the unneeded agencies and bureaucracies—close `em down!
Open the White House first-floor and the national monuments and parks!
Impeach Obama!
