After the tumultuous Attorney Generalship of Eric Holder, what the country badly needs is a replacement who will uphold the law fairly and guard against injustices perpetrated by the government. President Obamas nominee to replace him, federal prosecutor Loretta Lynch is questionable in that regard because of her enthusiastic embrace of civil asset forfeiture, which often deprives perfectly innocent people of their property.
In an editorial published November 22, Loretta Lynchs Money Pot, the Wall Street Journal revealed that during her tenure as U.S. attorney for the Eastern District of New York, Ms. Lynch has used civil asset forfeiture in more than 120 cases, raking in some $113 million for federal and local coffers. The trouble with civil asset forfeiture cases is that they frequently inflict severe losses on people who have only the most tenuous connection with a crime or even no connection at all.
The editorial discloses the facts of the Bi-County Distributors case, overseen by Lynchs office. Bi-County is a small business run by Jeffrey, Richard, and Mitch Hirsch. Their business deals largely in small amounts of cash and in May 2012, their account held $446,651.11, when it was confiscated entirely by Eastern District prosecutors.
Bi-County sells candy and snack food items to small retailers on Long Island, but, disfavored as such things may be by the Washington elite, that business is entirely legal. There has never been any allegation of any wrongdoing by the company or its owners, but they were under suspicion because of many cash deposits of less than $10,000. Under IRS regulations, banks must report cash deposits of $10,000 or more, but the feds look at substantial deposits of smaller amounts as grounds for suspicion, thinking that the depositor must be trying to avoid detection.

Here in Maine, civil asset forfeiture is not used often. There are many hoops for the government to jump through.
In the cases where there is an actual forfeiture, the assets go to the State of Maine’s general fund. Police departments and sheriff’s department do not receive anything, so there is no incentive for them to be aggressive, as is the case in other states.
It needs to be outlawed!
What’s with King Barry’s obsession with America having a black DOJ AG? Oh, silly me.. I guess Loretta would best understand the need for keeping Barry’s crimes covered-up.

Civil forfeiture must never benefit those that implement it as that equates it to legal robbery. Putting it in the general fund of the state serves a balanced approach while removing a motive of LE to abuse it. I would be strongly in favor of putting such constraints.
Is this civil forfeiture a federal policy that benefits the DOJ, and then they get to divvy it out to the states?
1. Abolition of property in land and application of all rents of land to public purposes. [Can you say "Property Taxes]??? 2. A heavy progressive or graduated income tax. [Can you say "Income Taxes"]
3. Abolition of all rights of inheritance. [Death tax,although they haven't done away with this completely yet...]
4. Confiscation of the property of all emigrants and rebels. {Asset Forfeiture and seizure, "war on drugs", etc.}
5. Centralisation of credit in the hands of the state, by means of a national bank with State capital and an exclusive monopoly. [the "Federal Reserve"]
6. Centralisation of the means of communication and transport in the hands of the State. [Major media are completely state-bootlickers - carrying Obama's water and covering his ass for six years straight, and 8 years for the Clintons]
7. Extension of factories and instruments of production owned by the State; [not quite there yet, the bringing into cultivation of waste lands, and the improvement of the soil generally in accordance with a common plan. [the EPA with its endless rules and regulations?]
8. Equal liability of all to work. Establishment of industrial armies, especially for agriculture. [not quite there yet; all the welfare parasites are still breaking down the system]
9. Combination of agriculture with manufacturing industries; gradual abolition of all the distinction between town and country by a more equable distribution of the populace over the country. [They're working on that one now; "regions" and "districts" instead of states...]
10. Free education for all children in public schools. [Got that already] Abolition of childrens factory labor in its present form.[not applicable anymore] Combination of education with industrial production, etc, etc. [Not there yet.]
When you look at all these things that Marx and Engels wrote over 100 years ago, and then look at where we are today, and where the Democrats want to take us... and add in the Socialist Obamacare system...

I’ll point this out....it was a law passed by the House and Senate....with plenty of Republicans in support of the law. A number of people said at the time....it would be abused. Well...they were right. Imminent Domain is also abused. There’s a problem here....but the question is...instead of going after Lynch, why not rewrite the whole law and really take it down several notches?
Heh, the fact that dear leader wanted her for AG was enough reason for me to believe she’d be another lousy AG, but now I’ve got a more concrete reason.
Highway robbery under color of law is just another one of those areas where both wings of the uniparty can come to a mutual agreement. Along with amnesty, increasing prison populations, higher taxes, growing deficits and deathcare.
Asset forfeiture... bunch of pirates.

Of course. But Lynch is a prime example of the abusers, so holding her up over it could be a catalyst for changing the law.
But stealing is so attractive to politicians - people who typically are incapable of making and selling things - that they just can't stop themselves.
Do we really think that a bagman like Mitch McConnell is against the government getting more money for him to pass out to his clients?
On steroids and angry from taking them for so long...
