To be fair, this is present on any Apple device as well. If you use Siri, you’re consenting to the same data sharing as with Microsoft here.
I turned off Siri, and I’ll turn off Cortana when I go to W10. While I very much like text-to-speech for text messaging, the “inconvenience” of typing out my messages outweighs the hit to my privacy. For the same reason, I have no webcams or microphones connected to any of my home platforms.
My work grunt PCs & and laptops wont be upgraded until I can put 10 through its paces.
I did put 10 on my aspire switch last night and I adiosed the files to restore back, so it's no guts no glory on that.
Yeah, that’s why I said “on any OS”.
I presume Apple would need to collect similar data for it's Siri app to be able to perform the functions it does, and the same goes for Google for their "ok Google" and map functions.
Increased usability in locating businesses, services, contacts, and so on, especially in a mobile environment, requires more widespread use of various data.
So go ahead and dump Apple and Google Android while you're at it.

Walt Mossberg was on CNBC yesterday. He likes Win 10 but advised against installing it for several months until Microsoft gets all the bugs out. He said Cortana was very buggy.
If the information is there, it can be subpoenaed in a court case.

Sure of what? So far W10 is working very well. I ran into some problems with the Nvidia graphics card originally, but that’s fixed now. Configuring the Edge browser was most of the remaining work required. No crashes, no BSOD.
Win-10: Where do I begin.
First, definition of fonts were not detailed, horribly corrupted.
I didn't have that problem with Win7.
Next, Aero Peek was gone also. Not sorry, I'm addicted to the Alt-Tab peek.
Slow, reboot, and startup, slower than Win7. Probably because I can tweek
in many ways including my bios.
Fugly all around. Customizing is gone, Win10 knows what you want already
so just sit down and shut up about it.
If I wanted a cell phone interface on a PC with all the limited trappings of
zero customizing, 10 would be it. No thanks.
Win7 smooth scrolling is a major factor to me, Alt-Tab, and the ability
to control more than programs allow, is for me. Old school, sure. but I don't
like an interface that controls me, and gives me extremely limited options.

That Microsoft won't copy your data just because you unchecked that box. It wouldn't be the first time they ignored configuration controls.
