Judge Orders Release of Jailed Kentucky Clerk Kim Davis

A federal judge on Tuesday ordered the release of the Kentucky clerk who was jailed for contempt last week after she repeatedly defied his order to issue marriage licenses to same-sex couples.

Kim Davis, the Rowan County clerk, “shall be released from the custody of the U.S. Marshal forthwith,” U.S. District Judge David Bunning of the Eastern District of Kentucky stated in an order.

Judge Bunning warned Ms. Davis not to “interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples.

Deputies in her office issued three licenses to gay couples last week.

Bunning said the licenses satisfied his order to issue documents, thus clearing the way to drop the contempt ruling.

The judge also noted that the licenses had been altered so that Rowan County rather than the name Kim Davis appeared on the document. Bunning said the changes “do not impact the court’s finding that the deputy clerk have complied with the court’s order.”

Still does not answer the question — is this LEGAL under Kentucky Law ( I mean a license issued by Clerks without Kim Davis’ signature )?

So he's saying she can play at being County Clerk but she has no control over her office. Did she agree with that?

Not legal. Alteration of the marriage license makes it illegal (as well as the violation of the actual definition of marriage still in KY law).

Bunning seems to think so. So, if a Kentucky judge finds otherwise, Bunning can get involved in that lawsuit, and order the Kentucky judge to find the license valid.

Whomever signed her arrest warrant should be imprisoned for false imprisonment. This whole thing is silly.

I think Kim Davis is agreeable to that. What she objected to is her SIGNATURE being on the marriage license of same-sex couples.

Two open questions come to mind:

1) If it is Kentucky Law that the Chief County Clerk’s ( Ms. Davis ) signature be on the license in order for it to be valid, are the licenses issued by the other clerks valid?

2) If her signature was not necessary and other clerks could do it, why the brouahaha and what the heck did she go to jail for?

Something still does not smell right.

Then the whole thing about jailing her was a sham.

Her whole objection was her SIGNATURE on same-sex marriage couples’ licenses.

If other clerks could do it, then this whole thing was much ado about nothing.

People can shack up without a marriage license and face no legal ramifications (homo and normal). Yet, a Federal judge throws the clerk in prison, for not issuing the license that the state doesn’t really care about to begin with.

Bunning could care less what the law says. He is ruling from pure emotion like those 5 deviants on the el-supremo court. We are living in dangerous times.

This is from the Rowan County Clerk website, under Kim Davis's signature:

"As county clerk I am responsible for providing many services to the people of Rowan county. These duties include general categories of clerical duties of the fiscal court: issuing and registering, recording and keeping various legal records, registering and purging voter rolls, and conducting election duties and tax duties."

Everything I've seen says that county clerks will issue various licenses. I've yet to see anything that says they are required to sign them. I think they do, because it's a political office and it connects the office with a name in the minds of the voters. But is it required by law to be signed by the County Clerk to make it legal? Someone would have to find a law that requires that.

How is HE (the judge) not interfering with the law? The Kentucky law is Kentucky Law. The Supremes only said the states cannot discriminate. Thus Kentucky has to change their laws, which they yet have not?
