If reheard, State of Washington has a tough level of proof to attain. In order to sustain the TRO, they must establish at least two things:
#1: POTUS does not have the questioned authority.
#2: Persons temporarily denied entry would suffer IRREPARABLE harm, and the temporary nature of the ban seems to negate irrreparability argument.

The (most-overturned) 9th is the only circuit court that does a “limited en banc” review, so instead of all 29 judges, it will be the chief judge plus 10 “chosen at random”.
Playing politics and undermining our Constitution is already coming back to bite these whacko judges, too funny.

I’ve never heard of this being done before. Of course, not being involved in litigation, I don’t pay a lot of attention to Circuit Courts anyway.
I wonder how much this has to do re our new AG, Jeff Sessions. The 9 th Circus court does not want AG Sessions investigating their criminal behavior the past 4-5 decades.
The following is probably another example of the impact and fear Sessions will bring to the liberals in and out of DC.
