The University’s New Loyalty Oath: Required ‘diversity and inclusion’ statements amount to a political litmus test for hiring.

Seventy years ago the University of California introduced a loyalty oath, requiring employees to swear they were “not a member of the Communist Party.” After a contentious period in which 31 faculty were fired for refusing to sign, the requirement was reconsidered. An eventual consequence was the current Standing Order of the Regents 101.1(d): “No political test shall ever be considered in the appointment and promotion of any faculty member or employee.” This is a statement of principle. No one will be denied a position at the University of California based on political beliefs. No communist, no conservative, no progressive, no liberal.

Now the university appears to be abandoning this principle. In the past few years “Diversity, Equity and Inclusion” statements, in which applicants for faculty positions profess their commitment to these social goals, have become required on eight UC campuses and at colleges across the country. These requirements are promoted as fulfilling worthy goals: to help redress the historic exclusion of underrepresented groups, to ensure that candidates from all backgrounds apply for and are given fair consideration for faculty jobs, and to make sure faculty respect and support all students in their teaching and mentoring.

There are many constructive ways to pursue these admirable aims. For example, professors can reach out to underrepresented communities at every level. We can enact family-friendly policies that help young faculty balance family life with jobs. We can encourage students from all backgrounds to explore and succeed in academic careers.

The mathematical community, my own discipline, has widely embraced the ideals of inclusiveness. But I have become increasingly uneasy with the use of DEI statements in faculty hiring. This spring the university issued guidelines instructing each campus to develop and use a scoring system, called a “rubric,” for applicants’ diversity statements.

(Note: I am a mathematician, and I know very well people on all sides of this issue.) There are two very important points here. One is the free speech issue, and the calls for voices and views to be shamed, silenced, shunned. The second is the content issue, specifically how diversity statements are being done. My brother is attempting to get a university faculty position. Every job application requires that he provide a statement of his commitment to diversity and inclusion. Some demand that he demonstrate his commitment to diversity. How do you do that?? Others require he indicate whether or not he has lived experience with LGBTQ issues or is an “ally” or has undergone training. This is for positions in West Virginia, Nevada, New York, California, and other states.

When he writes his “statement” he emphasizes that he believes in equal treatment for everyone and diversity in opinions. Naturally that isn’t acceptable so he’s eliminated from the candidate pool. Why isn’t the EEOC involved in stopping this?

When applying at San Jose State, there was no form to file but after my first review, I was questioned as to any biases that I felt towards my very diverse students. I would have thought my student ratings and the makeup of my classes would have been all they needed, but they wanted to hear it from me too.

What I don’t like about this approach is that it represents an attempt to screen people who may harbor a conservative thought. Of course having Trump literature show up in my mail was a bit of a give away, but I retired — later — not for any dispute, but because it was time. So I am not complaining, just reflecting on the problems of the younger job applicants.

I graduated from a small but well respected college in the Old South in the late 1960s and early 1970s.

Every issue of my alumni magazine is now flavored with at least one article about Diversity and Inclusion.

The founding of my college pre-dates the Civil War, so, on and off for the last 5 years, we have also been begging the world to forgive us for segregation - which we ended almost 60 years ago!

The previous President of my college, a former classmate of mine, "evolved" into an eco-fanatic and anti-capitalist (except when fund raising goals were not being met).

Many of the best memories of my life were made on that campus - but, after a political betrayal of this magnitude, I don't think I can ever go back there.

The state’s repeal of the law against Communists and seditionists teaching in California schools happened THIS century and it was the Democrats who did it.

And education has only surged Left in the wake of that decision.

There is no free speech in America. The problem with that for the demonazis is there is still a secret ballot.

Nazi-level speech restrictions combined with a secret ballot mean many big surprises at the ballot box.
