GOP senator embarrasses Biden judicial nominee with basic legal question that every first-year law student knows (Video)

Sen. John Kennedy (R-La.) stumped yet another Biden judicial nominee on Wednesday with a basic legal question.

During a Senate Judiciary Committee hearing for several judicial nominations, including U.S. Magistrate Judge S. Kato Crews' nomination to serve as a U.S. district court judge, Kennedy asked Crews an elementary question about evidentiary discovery.

"Tell me how you analyze a Brady motion," Kennedy asked Crews.

In a Brady motion, a defendant compels prosecutors in a criminal case to turn over potentially exculpatory evidence, that is, evidence that would help prove the innocence of the defendant.

Brady Motions are central to the January 6th cases that have flooded the Federal courts since 2021, in light of clear evidence DOJ prosecutors withheld video evidence from those defendants.

Despite serving as a federal magistrate judge, Crews was unable to answer the question.

"How I analyze a Brady motion? Senator, in my four and a half years on the bench, I don't believe I've had the occasion to address a Brady motion in my career," he said.

"Do you know what a Brady motion is?" Kennedy followed up.

"Senator, in my time on the bench, I've not had occasion to address that, and so it's not coming to mind at the moment what a Brady motion is," Crews clarified.

The Republican senator then asked Crews if he was aware of Brady v. Maryland. Crews confirmed that he was aware of the case, then said — quite shockingly — that the case addressed Second Amendment rights.

Crews dug even deeper, and it only got worse, as the video below shows.

Kennedy did not follow up with another question. Instead, he allowed Crews' wildly incorrect answer to hang in the air for good rhetorical effect.

Every one of these nominees are products of our “best” legal schools. Sow the wind, reap the tornado.

Were I a competent black lawyer (and there are plenty of those around), I’d be yelling at that dumbass to take himeself out the competition and turn in his law degree. He, and Alvin Bragg are nothing but large adverts for a movement to not only get rid of quotas, but to take a very close look at those who got into a profession because of them. Quotas appear to guarantee that there are one hundred Braggs for every jewell such as Clarence Thomas.

As somebody pointed out in the article, this is like a surgeon not knowing what a scalpel is.

But diversity is our strength!

Everyone gets it, right? He thought Brady vs Maryland was about guns because of the Brady bill or something like that.

Has he been to law school?? If so, which one?? He might be a grad of Stanford’s law school. We all got a good look at them last week as they demonstrated against a conservative speaker.

It is a Biden nomination, chosen based on physical characteristics and/or sexual perversions. Biden has been very clear and his black, lesbian immigrant press secretary has iterated the selection criteria for nominations. Every Republican Senator should be an automatic no vote for confirmation on all Biden nominees. Concurrently, Republican Senators need to take instances of incompetence, like Kennedy did Wednesday, and explain to America the reasons why identity appointments to not work. Destroy the character and reputation of the nominees in the process. Ideally they should be relegated to digging ditches or serving fast food.

He passed the bar.
Did you know that the bar is a private organization?
Yes, an organization not subject to governmental oversight, certifies if a person can practice law, be a judge, prosecutor, etc.
And the bar association is made up almost entirely of leftists.

What do you think of that?

LOL, he is confusing the Brady case with the “Brady bill”. Looks like we got a genuine affirmative action social promotion candidate here.
