HOUSTON, 3:39 p.m. CDT July 2, 2003 - A gunshot rang out Tuesday in a west Houston shopping mall's food court, News2Houston reported.
Police said Joshua Michael Short, 18, accidentally shot himself in the backside with a derringer around 4 p.m. at Memorial City Mall, on Interstate 10 at Gessner. "He got up from the food court and accidentally shot himself in the buttocks and he was transported to Ben Taub and he's in stable condition," said Officer Catherine Truhan, with the Houston Police Department.
Investigators said that Short had the gun tucked inside the waistband of his pants. He somehow brushed the trigger and the gun fired.
"We saw him sitting on the ground. He had his handcuffs just laying there," said Brandon Rees, a witness. "It's pretty stupid."
Witnesses said the gunshot shocked them.
"It's devastating because you're not safe anymore," said Dayzy Malakul, a shopper.
"I just heard a big bang and everybody just started looking (to see) what was going on. It kind of scared us," said Rommy Patel, a witness.
"I just heard real loud (noise). We just thought it was like a terrorist attack or something," said Jose Lopez, a witness. "(It was) surprisingly loud, real loud."
Police said that the teenager was too young to carry a concealed weapon and he could face charges of carrying a weapon without a license. It is legal to carry a handgun if the owner has a concealed handgun permit, unless a sign is posted prohibiting weapons.
Experts said that the first thing people should do when they hear a gunshot is to get out of the line of fire.
"If a weapon goes off and you see it, the first thing one ought to do is try to take some cover," said Don Clark, News2Houston consultant and former head of the FBI's Houston office.
"If a person says, 'Give me your jewelry,' then I'm going to give them my jewelry. But on the same token, if they want to put the gun in my face and tell me to come and go with them, then I think I'm going to try to do something to defend myself," Clark said.

If it's a direct quote, then no one should be fired but the parents and teachers of the idiot who uttered it.

In the concealed-carry community, this is considered extremely poor form.

This is almost as funny as a story that happened here about 11 years ago. A 19 year old youth who thought a 9mm would be a fashionable accessory at the local roller skating rink placed the weapon in his waistband. Later, at the rink, after becoming embroiled in a fated controversy, he drew his weapon and fired on a fellow youth and succeeded in hitting his rival/target in the leg. Before turning to flee, our modern gunslinger placed his trusty semi-automatic back in his waistband but forgot to remove his finger from the trigger. Poetic Justice ensued but I never found out if the partial reattachment was successful.

It appears that, if the owner has a permit, then they have a right to carry a concealed gun -- unless a property owner (such a s restaurant, or lunch counter) posts a sign saying "No guns allowed" -- which, property rights being what they are, trumps the right to bring a gun to the lunch counter. Is that the thinking? Yes, that's the thinking. I like to refer to such businesses as "discriminating against individuals based on lifestyle choice". It annoys the anti-gun lefties who would throw a fit if you barred any other lifestyle choice from a business establishment.

YOU WERE NEVER SAFE. YOU WERE JUST NAIVE.
If you want to be safe learn to carry a gun. If you want to FEEL safe, curl up in a ball on the ground and rub gravel in your hair.

In the state of Texas, a licensed CCW holder may carry their weapon into a business unless a sign of specified size and with very specific language is posted at ALL entrances. Posting one of the numerous "No weapons allowed", "Gun free zone" or similar general language is not adequate to render the cardholder culpable under the law in Texas.

Well, the oft heard threat of "I'll bust a cap in your ass" has actually happened, even though it was self inflicted.

I seem to recall the massacre at Lubby's and the fact that a woman had locked her gun in her car -- because Lubby's didn't allow guns. IIRC, she lost her parents in the massacre and was later elected to state government, running a pro-gun campaign. I forget her name (and hopefully haven't screwed up the details too much).

The Luby's massacre occurred before (and was a major impetus for the passage of) the Texas concealed carry legislation.

Experts said that the first thing people should do when they hear a gunshot is to get out of the line of fire. Wow, good thing experts mentioned this. My first instinct is to jump into the line of fire and yell, "I'm right over here."

The woman's name is Suzanna Gratia-Hupp; she is a Texas State Rpresentative now, and she is an outspoken and effective voice for the right to keep and most importantly to bear arms.

Thank you Mr. FBI agent for telling us poor, ignorant masses how to respond to gunfire.
Just another example of the collusion between stupid reporters and arrogant, gun grabbing Gmen. Must be a symbiotic relationship.

Where was the appropriate use of the safety? On a derringer? Likely it didn't even have a trigger guard.

If a property owner posts the correct sign at every entrance and somehow they see your concealed gun they can only ask you to leave. Failure to do so might get you charged with trespass. Foleys Department store in Sugar Land had such a sign until 23 of us went to the manager and turned in our credit cards. Many others protested in other cities and within two weeks the signs came down. If I see a sign, I go to the manager and tell him I will no longer do business there. So far only one furniture store has refused to remove it.
