You load 16 tons and what do you get? Another day older and deeper in debt. St. Peter don't ya call me 'cause I can't go, I owe my soul to the company store.

Oh! The clotes need washin' and the fire won't start. Kids all cryin' and your breakin' my heart.

Whole darn place is fallin' apart. Maybe things'll get a little better in the mornin' maybe things'll bet a little better

Work your fingers to the bone and whaddy ya get? Boney fingers, boney fingers

They're closin' down the textile mill across the railroad tracks, foreman says these jobs are goin' boys and they ain't comin' back, to your hometown.

Thank you, I appreciate it. I'd like to know what's on the horizon, what to expect if I go under.

Where do you live? Starting businesses in dying communities is always a problem, but hope springs eternal. There are usually good reasons why people are tied to their towns and try to make the most of it. It is likely that you will look back on this time as the best time of your life. Hard times bring out good in good people.

Sorry to hear about the pizza place. I tried my hand at that years ago and had to concede to Little Ceasars, et al (there went my dreams of owning the Red Wings and Detroit Tigers).

I practice bankruptcy law but everyone is still navigating the new law and its hurdles.

In your case, the issues are:

1) Are you incorporated, and if so, did you personally guarantee your business debt? If you aren't liable for the business debt, an Ohio corporate attorney can help you simply dissolve the business and assign any assets for the benefit of creditors.

2) To the extent that you are liable, and can't afford to pay it off, you will probably have to file Chapter 13 (as would have been the case last year) since, in your occupation, you PROBABLY have too much income to qualify (unless maybe you've retired or if you have lots of dependants). Also, if you have a lot of equity in your house and if Ohio doesn't offer you greater homestead exemptions than the feds, you will need to go Chapter 13 to keep your house from being attached for creditors.

The long and short of it is, see an Ohio attorney and get a consultation. That is often free, but even if you have to pay a couple hundred its worth it to get a complete evaluation of your options.

Doesn't make it easier in the process, I know that from experience. But I always find hope in knowing that someday, I will look back and it will make a lot more sense.

All things work together for good...

I bought you a ten-dollar dinner...you said "Thanks for the snack."

I bought you a big fancy house...you said "Thanks for the shack."

I bought you a brand new Chevy..you said "I wanted a Cadillac."

I gave you seven children, and now you want to give em back!

But that's alright...

(Who can do em like B.B. King, I ask ya?)

So, bankruptcy may be inevitable.

Is this personal or corporate?

Well, it didn't help me that as soon as I bought the place Der Publik Skool System came in and raised my taxes over 130%, and that was after we fought them in court.

I understand that they did this against the State of Ohio Constitution.... and it's a common practice.

It's 'for the Children' after all.

Then go see the small busisness administration bean counter and look for aid packages that will divert the cost of a poor local economy till yer back in the black or I win the lotto and come up there and we'll pay it off for ya, scrape it back to bare earth and make it a park if that's what ya so desire........"wish me luck" !:o)

That's about as close to any advice (albeit piss poor) I can muster friend and bump yer question to the top.

you PROBABLY have too much income to qualify

I meant to add "for Chapter 7."

Under Chapter 13, the court will let you keep all your assets but will have you pay all disposable income to the U.S. Trustee, which will be paid pro-rata to your unsecured creditors, after which you will be eligible to receive a discharge of any remaining balance.

It's a big job just gettin' by with nine kids and a wife
I been a workin' man dang near all my life
I'll be working long as my two hands are fit to use
I'll drink my beer in a tavern,
Sing a little bit of these working man blues

I keep my nose on the grindstone, I work hard every day
Might get a little tired on the weekend, after I draw my pay
But I'll go back workin, come Monday morning I'm right back with the crew
I'll drink a little beer that evening,
Sing a little bit of these working man blues

Hey hey, the working man, the working man like me
I ain't never been on welfare, that's one place I won't be
Cause I'll be working long as my two hands are fit to use
I drink a little beer in a tavern
Sing a little bit of these working man blues

Sometimes I think about leaving, do a little bummin around
I wanna throw my bills out the window catch a train to another town
But I go back working I gotta buy my kids a brand new pair of shoes
Yeah drink a little beer in a tavern,
Cry a little bit of these working man blues

Hey hey, the working man, the working man like me
I ain't never been on welfare, that's one place I won't be
Cause I'll be working long as my two hands are fit to use
I drink a little beer in a tavern
Sing a little bit of these working man blues
Yeah drink a little beer in a tavern,
Cry a little bit of these working man blues

My Great Grandfather used to sit me down and make me listen to that song over and over when I was about 5 or 6 years old. I still remember.

I later saw pictures of him working in the steel mills.

I filed bankruptcy in 1990. I have since paid off everything I owed. But, I would tell you to NOT file. Just pay the people you owe.

The people you owe will be happy to bargain for a settlement. You may get a 50% discount on your balance owed, with a full forgiveness of the rest. Everybody wins. You just need to talk with them.

I have suffered due to the filing. It took me longer than necessary to build back my standing. But, along the way, I paid cash for things, and elevated my standard of living.

Call your creditors tomorrow, and tell them you are broke! Ask them if you can work off your debt! Stay away from lawyers. They take a cut, and nobody wins but them!

I tell my kids all they have today is 'snivel rock,' nothing really good. I know some will dispute that.

Nothin' like treatin' the kids to "King of the road" once in awhile.
