OH YES! The insurance industry is totally buried in STATE mandated regulations that kill efficiency and protect in-state agencies from any competition. I’m sure it’s the result of a lot of lobbying at the state level by the industry.
My daughter goes to college in another state. She is REQUIRED to return (500 miles) to our home state for any medical treatment. Otherwise, it’s the ER for EVERYTHING! An ER visit for an ankle infection cost...$1924.00! For a sprained ankle... $1022.00 So our insurance would rather pay that than deregulate the interstate coverage clauses in their regulations.
That’s CRAZY ! ! !

Since you asked the forum for an opinion on O-Care... for what reason do you ask it?
What would you "replace" it with (considering that NO one has any benefit now from it.

Obama caused me to not have any care now. You see I went on SSDI and I have a pre-existing condition.
O PROMISED if the bill was past people like me would have coverage immediately... and that was a LIE. I have NONE now... and can not get any health care coverage at an affordable price and by that I mean the choice now is to pay for HC insurance or pay for housing, food, and gas.

What would you choose there? Obama and the obama care actually made the rates go up if you try to buy it now. So obama care has done NOTHING for citizens like me... despite the promise he made on TV the day of the signing of the bill.

So since that is the situation NOW, and it is based on a LIE obama told to get it passed, citizens like me will lose NOTHING by obamacare being turned over at SCOTUS. Barak LIED so many like me have NO expectation that by staying in effect it will get better.

Now again, for what reason do you ask your question and what is your answer to it?

Any serious healthcare reform needs to originate from nonpartisan sources, with the understanding up front that nobody is going to get everything they want.

You can't send a group of politicians--Democrat or Republican-- and their lobbyist friends being closed doors to hammer something like this out.

Everything contained in reform needs to be explained in detail. There can be no waivers. No "pass it to find out what's in it." No hidden legislation tucked away on page 2024.

I would propose that we look at what regulations and specifically which of the 'uninsured' cause the cost of 'health care' (not insurance) to be so high.

At the bottom of that dungheap, I'd pretty much bet that we'll find:

Illegal aliens.

Federal Regulations

The need for tort reform

Take care of that, and there is a good chance costs would come back in line.

Nationwide medical tort reform, or just tort reform.

50 state + territories health insurance market.

No mandated coverages in one policy (let the consumer choose his coverage).

That's true for me, also, if I want my medical insurance to cover any part of it. But nothing to stop me from paying cash at an urgent-care clinic. However, if I were on Medicaid (I'm not), that strategy wouldn't work as the providers are bound by law to not treat unless it is through Medicaid (which it wouldn't be at an urgent care clinic)..

The Supreme Court will not resolve it. They will not strike down the entire law - that’s too broad for them.

Most likely, you're right, but there is a chance in this case, for two reasons:

1) There is no "severability" clause allowing other portions of the law to stand if any portion is struck down, and

2) Even the administration's legal team will be arguing that without the individual mandate, the rest of the law doesn't work.

If it were just #1, the Court would likely punt it back to Congress, saying "since we can't be sure of your intentions, we'll take the least interfering approach and let you handle repealing the mess that's left, if that's what you really want".

But the law's defenders saying that the provision in question is essential to the law's intent coupled with the lack of a severability clause does open for the door for the Court to say that Congress' intent was clear and that the whole law is null and void.

Excellent point. People were disgusted and sickened by the process as much as anything. Especially after Obama had won on promises that he’d be “Mr. Transparency”.

Frankly though I don’t think Congress is capable of having a transparent, non-corrupt process.
