Judge Napolitano: Prosecute ‘Hothead’ McKinney Pool Party Cop

The resignation on Tuesday of McKinney, Texas policeman Eric Casebolt after the widespread viewing of a video showing Casebolt drawing his gun and brutalizing a teenager outside a pool party may not be enough to bring justice, suggests Judge Andrew Napolitano. Napolitano, in a Fox Business interview, argues that it would be proper to prosecute Casebolt.

Reviewing the video footage, Napolitano explains to host Stuart Varney that Casebolt, who Napolitano calls a “hothead,” appears to have committed an illegal assault:

Varney: The police officer could be guilty of a crime?

Napolitano: Oh sure, it’s an assault for him to pull the gun on someone when it’s contraindicated under police procedures. He can only pull his gun to resist deadly force. There is no deadly force being applied to him.  Napolitano, a Ron Paul Institute Advisory Board member, explains later in the interview that further action should be taken against Casebolt stating:

[T]he tape that we saw showed unlawful behavior on the part of that cop. His superiors were right to suspend him and investigate. The prosecutor would be right to prosecute.

The cop was totally justified to pull the gun. See the video. The two guys flanked him, moving aggressively. The guy claims he just “tripped,” but how does a normal cop in this Post-Baltimore/Ferguson world react to two people shouting and rushing at your blind spot?

That man that ran up behind the cop for some purpose, slipped on the grass and got closer than he may have intended. But, clearly the cop thought the man was after the cop's gun.

A classic example of how the presence of a gun inherently escalates a situation.

The Zimmerman/Martin case is another.

If one or both parties are armed, any scuffle immediately becomes by definition a life/death struggle.

A good reason to stay out of scuffles, BTW.

I watched the full video. I think the cop was an ass, and he needlessly escalated a volatile situation. You could excuse his behavior as reasonable, and you could even say that the kids deserved to be arrested, and you could even be correct. However, you cannot dispute the fact that he was not in control of his emotions, and that is never good during such a situation.

However, he was perfectly justified in drawing his weapon and he holstered it quickly when the threat decreased. It almost appears that once the cop pulled his weapon, he realized that he needed to deescalate. The kids advancing on him where a threat and it was a reasonable response, but unfortunately his prior performance gave the jackals all the fodder they need to continue their false narrative.

DID THEY WATCH THAT VIDEO????

Because if they did they would have seen two guys sneaking around behind the cop while he was distracted by a group trying to interferring with his arrest. One of the two had his left hand behind his back as if he were reaching for a gun in his belt, it wasn’t until the cop finally sensed what was happening and noticed the men sneaking up on him with one looking like he was going for a gun that his pulled his weapon!

Napolitano you are a FREAKING IDIOT!!!

It’s good to know the people standing around, agitating the crowd, cursing the officer, and disobeying his orders to stand down were not considered “hotheads”, especially the girl who was screaming and resisting the officer. I guess the Judge also failed to notice the two thugs who rushed in to blindside the officer. Clearly the officer should have known they were there to “rescue” the girl, not to physically threaten him. He should have backed off and waited for the thugs take control of the situation.

Bullshit, you’d have thought somebody got pistol whipped or shot, or something worse. It could have ended on a tragic note, but it didn’t. It ended with minor bruises, a policeman’s career destroyed, and another helping of imagined racism and political correctness.

So goes the daily war for equality and justice in the new liberal paradise we once called America. Wake up!

This is, as you imply, the reason behind the olf saw, “An armed society is a polite society.”

When any altercation can quickly escalate to a life or death situation, it’s a good idea to be polite to everyone.

Of course, in almost all such societies in human history, only certain people were allowed to be armed. For instance, “gentlemen” in 17th century Europe and samurai in medieval Japan.

The armed people could be, and usually were, as impolite as they felt like to the unarmed people. This was, of course, a major reason why they’d set it up this way. The polite society part applied only to their relationships with each other.

A cop cannot pull his gun out when he feels his life might be threatened? I can’t believe the judge is on firm ground there.

I don't think that his actions rose to the level of criminal prosecution, maybe body-slamming the 14 year old but even that is problematic. But the officer definitely showed that he lacked the composure to be a police officer so his resignation was enough.

He had just been attacked by two women from his left, He was being rushed by two large men from behind, one reached toward his waistline, you can clearly see this in the video. Pulling the gun was the CORRECT move. When they ran away he holstered it. Waiting for two thugs to attack you from behind isn’t going to solve a problem. Can’t believe people are caving on this. We are not going to have one cop left who can do his job without retribution. Check out thenCommunist manifesto..,”FIRST the police force of the government must be neutralized.” Where’s McCarthy when you need him?

Being critical of overbearing cops does not make one liberal. It makes one understand the constitution.

That being said this cop had just been called to two suicides, one in which a husband offed him self in front of his family with a shotgun. To say that at the pool party he was under duress would be an understatement. He should have been called into the cop shop and not right out.

He wasn’t overbearing. He did the job he was trained to do in an environment dangerous to his life. He understood the risks and acted accordingly and professionally.

Ferals should be returned the respect they give. Black, white or purple.

I used to really like and respect Judge Napolitano.

Been a couple of years since that was true.

In another couple of years, the way he is going, he will be about at the same level as his ‘sister’ Janet.

It would be nice to put that wind bag Napolitano in a police car for a midnite shift in a black area and then see how quick he is to bash. The neighbors who lived in that neighborhood called it a riot situation and defended the cop.

exactly....she was stomping around, mouthing off and wouldnt follow a police command. The other 2 thugs that ran up on him....thats the last thing i would ever do, run up on a cop thats trying to arrest someone. I dont believe whats happening in this country...ever since this punk got elected. Wait til the last like 2 or 3 weeks hes in office, the amish are gonna really freak out, especially if a white republican wins the election...i can hear it all now.
