Sorry, Republican Governors: It’s Illegal To Not Accept Syrian Refugees Into Your State

The far-right wing in both America and Europe have seized on the Paris terror attacks as an excuse to turn away the thousands of desperate refugees who are fleeing the terror and violence of ISIS. Thirteen American governors (all Republican) have announced they will refuse to accept Syrian refugees in their states, demonstrating a remarkable ignorance of Constitutional law. As ThinkProgress noted, "the Supreme Court explained in Hines v. Davidowitz, "the supremacy of the national power in the general field of foreign affairs, including power over immigration, naturalization and deportation, is made clear by the Constitution." States do not get to overrule the federal government on matters such as this one."

Those declarations by GOP governors are riding the wave of Islamophobia coursing through the right-wing. Jeb Bush and Ted Cruz both proposed profiling refugees by religion and "only accepting Christians," because despite the fact that Christian terrorist attacks take place in our country on a regular basis, Cruz thinks "there is no meaningful risk of Christians committing acts of terror." Trump said that he would "strongly consider" shutting down mosques in America, completely contradicting his widely professed devotion for "religious freedom." Mike Huckabee called for the new Speaker of the House, Paul Ryan, to halt the "importation" of refugees or resign.

President Obama ripped these xenophobic bigots in his Monday press conference, chastising them for abandoning American values and buying into their own fearmongering:

"When I hear folks say that, well, maybe we should just admit the Christians, but not the Muslims, when I hear political leaders suggesting that there would be a religious test for which person who’s fleeing from a war-torn country is admitted, when some of those folks themselves come from families who benefited from protection when they were fleeing political persecution, that’s shameful. That’s not American. That’s not who we are. we don’t have religious tests to our compassion."

He is absolutely right. While there are certainly dangers we need to address, this kind of reaction from the right-wing is exactly what ISIS wanted. By reacting with fear and discrimination, we marginalize more Muslims and push them into the arms of extremists. The passport that indicated one of the attackers was a Syrian refugee is likely fake, and an obvious plant to inflame fear of refugees. These people are desperately fleeing their homes because the murderous horrors of the Paris attacks are a daily occurrence in ISIS territory – a mass grave of eighty murdered women was recently discovered in Iraq's Sinjar province by liberating Kurdish peshmerga units. It is our moral obligation to accept and protect the incoming refugees in the face of unthinkable violence.

Yes, Huckster made a fine pointed threat, and I liked it a LOT!

Ryan is in bed with the USCCB and Catholic Charities, and sucked up to the bishops in coming up with his past budget plans, to be charity heavy to illegals and endless give aways. LIBERAL. He has virtually no political enemies in liberal Wisconsin, so what’s that tell us?????

I don’t see anybody arresting mayors in sanctuary cities. I would think locking up governors of states refusing Syrians is going to end badly for the left.

The owners of Occupy Democrats and Addicting Info have accused me of professional jealousy, but both websites have a long history of manipulating or falsifying stories about Republican lawmakers like Bobby Jindal and political figures to increase their web traffic and subsequent revenue. This has nothing to do with continuing the mission of Occupy Wall Street and/or fighting Tea Party Republicans as Occupy Democrats claims, and everything to do with personally enriching the owners and writers of their website.

If Occupy Democrats and Omar Rivero really cared about the truth instead of making an easy buck, they wouldn’t be shamelessly passing off blatantly false “information” as truth. It seems like Occupy Democrats has more in common with the Tea Party than they’d like to admit, and that’s a damn shame for the liberals who constantly fall for this utter nonsense.

*Update* Shortly after the publication of the Politifact fact-check and this article, Occupy Democrats deleted the Bobby Jindal post (which had been shared almost 80,000 times) with no public retraction or acknowledgement of their blatant lie. Classy, as usual.

The only thing I can find about States rights is the 10th amendment...States only give to the Federal what they want to...apparently....so does that mean that States can refuse the right to keep out people they don’t want?

I am a young entrepreneur/political organizer that received a tax-payer subsidized world-class education after having moved to the USA from Mexico at the age of 8. I guess you can say that I am a living embodiment of the American Dream.

And this assault on America is a family affair. Omar has a partner in crime – his twin brother Rafael. This must be an example of the close family bonds that Jeb Bush keeps telling us about. Hispanics’ doing the work Americans’ don’t want to do. Yup, that’s right – we don’t want to extinguish our country.

With his twin brother, Omar Rivero , they have launched several Facebook pages and a website that aim to do for the Democratic Party what the Tea Party has done for the Republicans, namely, yoke them more firmly to a specific vision and values. In the case of the Tea Party, the vision and values are those of smaller government and lower taxes; in the Riveros’, they’re activist government and egalitarian values.

World Patent Marketing, a spin off of Desa Industries, has invited Omar to join their Marketing Board of Advisors. The best place for a fraud is in a fraudulent company. True to form World Patent Marketing’s goal is to weaken patent laws worldwide via petty lawsuits allowing a free-for-all against intellectual property rights. For those of us with reasoning abilities, that’s called theft. But we can’t expect a progressive to respect the meaning of “intellectual” or “property”.

One slight correction. Your document wasn’t from 1912. “Charles, Emperor of Austria and Apostolic King of Hungary” did not become such until Franz Josef died in 1916. And Charles was deposed at the end of WW One in 1918. Immigrants usually filed this document (”First Papers”) five years after arrival, so this was probably signed in or near 1917.
