Mother lets son drive golf cart at resort, gets jailed for child abuse

On the second day of her dream vacation on exclusive Bald Head Island, Julie Mall went with her family to the beach to catch the sunset. Her 11-year-old son asked to drive the golf cart back to their $1,000-a-day rented cottage.

It was dusk, no traffic on the path and his father would sit next to him. A two-block, 30-second ride. She said sure. What could go wrong?

In the next four hours, Mall says she was pinned to the ground by police, repeatedly accused of being drunk, frogmarched barefoot aboard a ferry in handcuffs, jailed in leg irons and charged with child abuse.

Ever notice how on all the *Cops* shows the officers all simultaneously begin screaming "STOP RESISTING! STOP RESISTING!" almost as if it is scripted for them at the police academy?

They frequently scream it no matter what is occurring on the screen.
Almost as if it is a catch-all for anything wrong they might do.

Something doesn’t sound right about this. My wife and I own a condo several islands over at Ocean Isle Beach. It has always been very common to see youngsters driving golf carts there. One summer before our kids had a license, I rented a golf cart to help them learn to drive. Different police departments to be sure, but there is a much more relaxed attitude at the beach.

Why not?

Were they on a public road? Is a state issued license required to drive a golf cart? Was the public ever endangered by the 11 year old driver?

I’m sorry, but arresting this woman for child endangerment was a huge overreach on the part of the police department. Thug government at its worst, in my opinion.

Well then my dad should still be in prison 50 years later. He used to let us drive the tractors around whenever we wanted when we were kids. I think he thought they were safer than riding the horses or harassing the cows. And he was right... I went to school so often with black eyes and being busted up from riding horses around bareback that my teachers continually suspected that I was an abused kid. But my dad never hit me... where it left a mark.

My brother and I made a giant kite out of 2x4s and plastic sheeting that we were able to get off the ground towing behind an old tractor that we had to start with a crank. My brother has now been a captain for Southwest Airlines for many years.

My dad also let us dig giant holes with the 1958 John Deere track loader that had a backhoe. “Just fill it in when you are done playing.” “And don’t wreck anything.” “OK Dad.”

My brother did roll a small tractor and the trailer off a bridge into the mud. It took a little effort to drag it out of the mud, but no one got hurt and we had everything cleaned up and fixed within a few hours.

The most serious casualties came from towing kids on inner tubes behind the big wheeled farm tractor in the snow. The tractor could only do around 20 - 25 mph, but when you swung the tubes around behind them on a long rope, the speeds could be magnified significantly. When you fell off or hit something it could get a little ugly.

Of course we were expected to do constructive things with the tractors as well, which wasn’t nearly as much fun. Now kids spend all their time playing with little electronic devices. And now they charge a woman with child abuse for letting her kid drive a golf cart? I am glad I grew up when I did.

Yes...I know...carts are a great beginning training tool for kids...but nanny state m monsters dont want parents to train their kids anymore

Bald Head Island doesn’t allow cars other than police and emergency, golf carts and bicycles are the only vehicles for the public. Regardless, the officer was wrong. The resort will not want such bad publicity, they will settle. Need to dismiss that officer and scrutinize the whole force. They apparently have too much time on their hands.

Way to many holes in the police side of the story. First the officer failed to show for court multiple times. Secondly, they let the husband drive the golf cart away even though they claim that he was intoxicated. No mention of breathalyzers performed. Despite claiming the husband is intoxicated, they let him be the lone adult with the 11 year old.

You are correct. I'm a criminal defense attorney. Cops will find "probable cause" with nearly anything, and prosecutors will file charges on almost anything with absolutely no research to find out if there really was a crime committed.

I had a client recently who, on a dark street while in his truck, told an approaching person to get away from him. Client was on his phone at the time and pointed the phone at the guy. Guy thought it was a gun. Calls the cops. Cops pull my guy over, he tells them what happened, gives full consent to all searches and they completely search the area he drove from. No gun was found, because there never was one. Guess what? Prosecutors charge him with THREE firearms felonies. He has to hire me and the charges get dropped for lack of evidence. Total joke and a disgusting abuse of discretion.

Lucky for the dog he didn’t get more agitated or he would have been dead.
They would have shot my German Shepherd for sure, b/c I think he would have been latched on to an officer’s arm!

She said she violated the minimum age for driving the cart. Also, it sounds like they were heading back to a bungalow, which could have meant they were driving on the street—didn’t the story say it was a two block drive?

If it was on private land AND there was no prohibition on cart driving age, then there wouldn’t have been an issue.

Is it okay for me to put you at risk of a lawsuit because I want to ignore your prohibition?

Watch the video. She was screaming and kicking. Resisting. The cops were in the wrong. Doesn’t matter. Once arrested, go quietly. Much better to argue your case later.

Why not? It wasn't on a public road, and most golf carts have a top speed of 15 MPH. Heck, a kid can reach higher speeds that that on a bicycle going downhill and bikes are more dangerous than golf carts.

Besides, the kids dad was in the cart too... so I don't see the problem.
