That's a strong accusation without any evidence. Sounds from the article that the employer did his due diligence. Now if it turns out he was paying him under the table, then maybe you're correct. But if he was being paid by payroll, including tax withholdings, what would motivate the employer to leave such an audit trail for something illegal?

Are you telling me that a that a business owner doesn’t know that an 18 year old who can’t speak English, with no high school diploma shows up with a shiny new Social security card ( let’s assume they didn’t provide it for him ) and your too dumb to know he’s illegal... no way.... not buying it. I do wonder what he was paid/hr did he file taxes? Did he get a W2? these are good questions... bet you a lot of money we’ll never get the answers.
There is a record of eVerify and it seems like that’s what they’re presenting. Sounds like they did due diligence. If everything businesses are required to do (over regulated to do, I’d add), and it all says clear, what do you propose? Seems like cross checking was what they did...

Most likely he was not being paid by payroll. A work group leader was probably being paid in his name for the labor of a half dozen others in the group. On the books it looks like minimum-wage payments to one person. In reality that same payment is divided by several people, with the group leader taking a premium cut.
Cheap labor. No recourse for the workers for anything, because they are illegals. Plausible deniability for the employer. What a sweetheart deal. Until something goes wrong.

As long as an illegal alien get a Taxpayer Identification Number, a TIN (Not an SSN), e-verify will pass them.
It is also how illegal aliens register to vote.

I am not making any judgement on the business owner yet. But whatever occurred will certainly get the spot light now. So if it was a hole in the system, that should get addressed. If it was bad action on the employer, he should be charged.
Here’s the problem with this. If you go the legal and ethical route, then the ‘Juan’ you end up with, will require regular pay and social security/medicare. Maybe someone with insight to the pay business will jump into this discussion, but I would imagine the legal ‘Juan’ would cost you 30-percent more. You go and lay out the farm income and the man-hours required, and it’s a tough balancing act to survive as a farmer these days.
I do agree, we ought to go and operate a simple work-visa program where a ‘Juan’ does everything legal, has the paperwork, and the farmer can feel happy over the pay and work requirements. But I’ll add this comment...right now, it’s very possible that you’d end up with some Honduran kid who is 14 years old and you get in serious child-labor issues because of the open door mess and our approach to the whole worker concept.
Agreed, they are part of the problem. This illegal activity on a national scale has to stop.
I follow your post as one means of cheating the system, but not sure how it would work in this case, given the employer is saying the perp was verified thru e-verify.
That is what the I9 process is for.
Second, if the person vetted committed ID theft including using a bogus SSN, then the system can be circumvented.
IMO I don't believe he was checked thru e-verify.

E-verify is all automated. You enter the data and get back a response within a few seconds.
You pay them more money to attract workers. It is called the marketplace. Supply and demand. When you bring in an inexhaustible supply of cheap, illegal labor, you depress wages and take jobs from Americans.
