cross check social security # with IRS data might be a prudent thing to do.

E-verify uses other government databases. Why should we automatically believe the employer? E-verify is voluntary right now. It needs to be made mandatory.

So if it was a hole in the system, that should get addressed. If it was bad action on the employer, he should be charged.

E-verify is voluntary. However, it is illegal to hire an illegal alien to work and it is illegal for an illegal alien to work here. Both sides are legally liable.

This is exactly how it’s done, the IRS system for verifying the eligibility of persons applying for a TIN is completely corrupted.

The dirty secret is that the FedGov doesn’t care if you are here illegally and working illegally just as long as you pay your taxes on the money earned.

Go look at a farmer who has a 400-acre operation, and needs 100-plus hours per week of production/effort. He has to hire someone to fill in and do stuff, and they aren’t exactly rocket-scientists or keen on the English language. You might easily be in a situation where you end up with some 13-year old kid who convinces you that he’s 17 and in the ‘system’. I could see how the system has failed the nation, but it’s failing farmers as well.

It's really not the problem you described.

This really can be done and in place by the end of Trumps 1st term. It's just a matter of if the citizens of this country want to fix the problem, or turn a blind eye and kick the can down the road and let all this illegal insanity continue on.

1. First and foremost, enforce existing laws. Otherwise, as a lawful citizen of this country (and a taxpayer to boot), I want to know which laws I get to break with immunity?

2. Guest worker program. Install one that actually follows the laws and is enforced across the board w/o exception. Give them 3 / 6 / 12 months temporary legal status to work. Biometrics are used to track everyone. If you don't exit the country on time, you are suspended from the system for 2 years. 2nd violation, 5 year suspension, etc.
Any foreign national found using a stolen or fraudulent SSN (or other verification documents) is automatically kicked out of the program for life.
Any employer found to have a foreign national here illegally on their payroll will be fined $5,000 per occurrence for the 1st offence. 2nd offence, it's $20,000 per occurrence, etc.

3. Ensure eVerify 2.0 is not corrupted. Bring in 2 to 3 different private sector tech / accounting / forensic firms to verify that eVerify is not corrupted. Do this annually, at least.

4. Stop all government programs to foreign nationals here illegally, that use taxpayer money for things like housing assistance, food stamps, routine medical care, legal help, etc. They are not entitled to it.

If employment and the taxpayer freebies are removed, most will self deport. Those that don't can be sought out by ICE and removed.

Either our immigration laws and our national sovereignty mean something or they don't and if they don't, well then...we're not really a country anymore.

Enough is enough.

Yup. Some of the local farms here use E-verify for new employees through their accountants. One guy didn’t pass so the accountant just ran it through again and he passed.

That's a strong accusation without any evidence. Sounds from the article that the employer did his due diligence. Now if it turns out he was paying him under the table, then maybe you're correct. But if he was being paid by payroll, including tax withholdings, what would motivate the employer to leave such an audit trail for something illegal?

If the guy is truly a foreign national here illegally, by definition he can not be lawfully employed by the farmer.

So either the farmer is lying in an attempt to cool the heat (where's the proof he used eVerify or that he simply didn't ignore the negative result?),
or he did pass eVerify...meaning the foreign national not only broke our immigration law(s), but is also involved in document fraud and possibly identify theft.

In either case, this massive scale illegality has gone for far too long.

he gets a valid ssn from someone then goes to the DMV and says he needs id in that state... here is my ssn # and my bank account (which bank of america will open for anyone using a matricula consular card from Mexico) This card has the same name as the SSN...you can get one that says Donald Duck if you like.

Now it looks like you have a legit identity in E-Verify...there maybe 7 juan valdez paying into social security under that number... but Dems and Repubs like that too, because it means Social Security won’t go bankrupt as soon... so it is a win-win for Illegals, Dems and Repubs.

That is what the employer is saying. Does not mean that it is true.

There are many ways to cheat the E-verify system. Employers have an incentive to turn a blind eye to all of them - and they do.

Even the Government does not really care all that much, as long as they collect Social Security taxes from somebody.

It is all just fun and games until somebody gets hurt. Well, here we are. And it turns out that a lot of people get hurt. Maybe we can keep it quiet so the Democrats (and the Republicans) won't look so bad.

People who hire illegals create a reason for people to illegally enter this country.

They should be charged for hiring non-citizens. Of course, that is the purpose of the work visa program...

Circumventing that is illegal...

We have that and it’s called the H2A worker program. Farmers contract with a broker to supply the workers. Here in eastern Washington the orchardists are required to build suitable housing and their typically hiring between 50-100 workers.

I have been contracted to design several water systems for theses units. All of these units have to be approved by the State Health Department. The workers get transported to town once a week to buy their own food and necessities. Some farmers even provide large recreational yards for these workers that include soccer fields, basketball courts, and BBQ areas. At the end of the season (end of October) they send them home.

Is the farm registered as part of E Verify?

If not, is the temp agency?

Sorry. I suspect that it will come out that this guy was not background checked at all, and other issues with hiring practices will come out

Not acceptable to break the law “Because I have to”.

If I do that in OSHA or environmental compliance, I go to jail.
