A federal judge in South Dakota is on the warpath against the US Marshals service that provides courtroom security, accusing them of ‘kidnapping’ and criminal contempt after they refused to disclose Covid-19 vaccination status. On Monday, US District Judge Charles Kornmann fulminated for nearly an hour at the courthouse in Aberdeen, as Justice Department lawyers and two of the Marshals he wants criminally prosecuted took notes.
“This was such an outrageous thing to do,” the judge reportedly said, according to the Washington Post, referring to the incident last month when a female deputy refused to tell him if she was vaccinated – and took the three defendants with her when Kornmann ordered her to leave the courtroom.

“Nothing like this that we could find has ever been done in this country. If it is the marshals’ position that they can override court orders, they are badly mistaken,” he added.
Kornmann wants obstruction of justice and criminal contempt charges levied – not against the female deputy, but against the Marshals Service chief of staff John Kilgallon in Washington, DC; as well as Daniel Mosteller, the marshal for the District of South Dakota and his chief deputy Stephen Houghtaling. He gave the federal prosecutor until Friday to do so, or he would appoint a prosecutor who will. The trial date is already set: September 13.

My answer would be, FOAD, color of law tyrant.
I would also tell the marshall service to NEVER, EVER AGAIN provide security services for that judge.
She was responsible for the prisoners and he ordered her to leave, so the correct thing for her to do was to take the prisoners with her.
It’s none of his business if she was vaccinated.
If he is, he shouldn’t be worried.

Boy, I always thought the judges were supposed to be fair and impartial. What does one expect from a Clinton appointee.
I’m curious to see him try and pull this off. A sitting judge ordering the US Attorney’s office to investigate, indict and arrest members of federal law enforcement...all while ordering the attorney to violate a federal law, HIPPA.

The judge is nuts. Another example of why lifetime appointments are a bad idea. I would favor an amendment imposing a term and/or age limit.

HIPAA doesn’t grant any such authority. So no, you wouldn’t arrest for a HIPAA violation.
