Natural Born Citizen relates to an earlier concept of Natural Born Subject, as colonists they were not citizens but subjects. So they didn’t have to spell it out the way later folks might have felt or feel the need to.

Especially as they may be like Obozo and want to rip it to shreds.

NBC however is distinct from NBS because it is mentioned in relation to who can be the chief executive/administrator, the closest we Yanks get to who can be the king for Britain. Thus it has a particular added weight when compared to NBS that normally would not touch on their sovereign question.

To be born only with one allegiance is the heart of NBC.

If there were any reasoning that only one parent was needed it would be a father who could confer it, not a mother. That case too would arise from how NBC compared to NBS.

As I understand that, the Constitution does not define what a natural born citizen is.

As a practical matter, nobody stopped Obama or Kamala Harris with their foreign-born parents, from being president and vice president.

His run for Senate, he said “it’s not like I’m running for president” when asked about his Kenyan birth.
But we had posters on the birther threads here being absolutely insulting idiots defending... Obama.

There is a difference between defending Obama and criticizing birthers. Orly Taitz, and Joe Arapio made a mess of the issue and they were not alone.

When birthers and birther PACs tried to use Dred Scott and the dicta for Minor v. Happersett, it showed they did not know the law, while knowing how to ask for money. Orly Taitz was lucky she was only fined for misconduct and not disbarred. Arapio was holding press briefings promising to deliver the goods on Obama and never delivering.

It is not surprising that the movement failed when much of the team were legal keystone cops.

Levin’s definition of a U S. NBC seemed to boil down to this: Everyone born everywhere in the world to fewer than two non-U.S.-citizen parents. Over-inclusive, no?

Kerchner v. Obama
United States Court of Appeals, Third Circuit
Jul 2, 2010
612 F.3d 204 (3d Cir. 2010)

That case went really well. < /sarc >

Definitely overinclusive. The catch is there is 245 years of citizenship case law.

Pointing out the birthers were their own worst enemy is not defending Obama.

I remember that....

But you can't cast doubt on the validity of his Hawaiian birth which was published in a local newspaper in real time.

There’s a carve-out which allowed Washington et al. to qualify for President.

There’s a carve-out which allowed Washington et al. to qualify for President.

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five years, and been fourteen Years a resident within the United States. -- US Constitution, Article II, section 1, paragraph 5.

The provision of "or a Citizen of the United States, at the time of the Adoption of this Constitution" can be thought of as a kind of selvage, to use the textile/sewing/weaving term. It is the self-finished edge of Constitutional qualification for our nation's first generation of leaders.
