Police seize first firearms under Florida's new gun-control laws

A Broward County judge on Friday issued the state’s first order temporarily removing guns from a person under Florida’s new gun-control laws.

Four firearms and 267 rounds of ammunition were ordered removed...under the state’s new “risk protection” law...

The man was also taken to a hospital for involuntary psychiatric treatment under the state’s Baker Act. But the civil ruling removing his access to guns and ammunition was granted under the new legislation — which permits confiscating guns from people who have not been committed but are deemed a potential risk to themselves or others, according to the order signed by Broward’s Chief Judge Jack Tuter...

Lighthouse Point police made the request on March 14, one week after they were called to conduct a welfare check on the man, who they said was behaving strangely at his condominium building. Authorities said it was the latest in a series of encounters law enforcement had with the man, though he has no prior history of arrests in Florida. He had some prior arrests in Pennsylvania, records show...

Lighthouse Point Police Chief Ross Licata said officers have had interactions with the man over a number of years but none of them had risen to the level that would have warranted removing the man’s access to guns. There was also no legal method to do so in the past...

At [next] hearing, police would have to present “clear and convincing” evidence — more than was needed for the temporary removal of guns and ammunition — to keep the weapons in their custody for the next year. Any violation of the court order would be a third-degree felony, punishable by up to five years in state prison and a $5,000 fine.

There will be eccentric..but not dangerous...people losing their rights while the likes of Sr Cruz will be untouched.

And (of course!) FL attracts eccentrics & free spirits. ... certainly obvious in coastal towns like Lighthouse Point, people with/without homes, with different levels of functioning/coping skills (drugs, alcohol).

That should be coupled with text describing any expressed threat to commit acts of violence, murder or suicide. Never mind gun confiscation, they'll steal a gun or use something else....lock them away.

Florida's Gun Confiscation Law---CS/SB 7026--- prohibits a person who is mentally defective from owning a gun.

The Broward-area black Congresswoman who thinks she's a cowboy is at the top of that list of mental defectives....
followed by mayo-head Cong Debbie W/S who represents Broward.

Five days a week I work alongside 60 or so people with a variety of mental illness. You name it: bipolar disorder, schizophrenia, PTSD, schizo-affective disorder, borderline personality disorder...

There is not one... not one... of them who I have ever or would ever feel endangered by. Each one of them is among the most sincere and conscientious and respectful and GOOD people you are ever apt to meet in this world.

The vast majority of them, I would have no hesitation at all about letting them own a firearm for personal protection. Except that most of them have been in psychiatric facilities of one sort or another.

It's ironic that the vast majority of people with mental illness have greater appreciation of human life than too many who are "normal".

It isn't an issue of neurobiology. It's an issue about the soul. And idiots like Hogg and Feinstein and Schumer will never understand that it's impossible to fix the soul with more and more legislation.

There has to be sufficient evidence leading a reasonable person to conclude that possession of a firearm probably poses a threat to the person or others. Note the order is temporary.

Here is the section that applies. I assume that if the person is say a convicted felon the firearms would not be returned.

“Firearms or ammunition seized or voluntarily surrendered
487 under this paragraph must be made available for return no later
488 than 24 hours after the person taken into custody can document
489 that he or she is no longer subject to involuntary examination
490 and has been released or discharged from any inpatient or
491 involuntary outpatient treatment provided or ordered under
492 paragraph (g), unless a risk protection order entered under s.
493 790.401 directs the law enforcement agency to hold the firearms
494 or ammunition for a longer period or the person is subject to a
495 firearm purchase disability under s. 790.065(2), or a firearm
496 possession and firearm ownership disability under s. 790.064.
497 The process for the actual return of firearms or ammunition
498 seized or voluntarily surrendered under this paragraph may not
499 take longer than 7 days.”

Knew someone who became depressed and suicidal...had a gun..went to clinic for depression...when it was discovered he had a gun...the cops came and took it away...he spent a few days in mental health hospital later....much better...but i think he would have easily killed himself at that time. His family was very worried for him..Big concern is that opposimg political views will be falsely deemed mental illness with forcible disarming. Need rock solid safeguards

It could be a slippery slope but it’s one we’re going to have to navigate. Something has got to be done to stop these crazy people from doing these deeds. If we can’t localize the inconvenience and denial of rights to crazy people then they are just going to seize all guns.

Next it will be the elderly. Already established age limit on the young end and they will say elderly are likely to have poor eyesight, poor coordination, deficient mental abilities, tendency to end their own lives, etc. and so justify no guns after 65 y/o and they will want to link it to withholding social security or some other such scheme. Once you limit various groups you are well on your way to nearly total control and each step will sound very reasonable along the way.

I’m all for taking guns from Cruz types who should be in jail to begin with but the problem with these type of laws is you could have your guns taken away simply because the neighborhood busybody complains about you. As others have said it’s a slippery slope.

I've not been able to find it, but MANY years ago I was impressed and saddened by the news account of a criminal who busted down the door of an elderly couple. He was shot and killed by the woman, but not before her husband had been killed.

Is it any surprise Broward would the first. They probably would have been even if the shooting didn’t happen there.
That said the country owes a great debt to Broward county. Enough idiots there accidentally voted for Buchanon when they were trying to vote for Gore to give Bush Florida. As bad as Bush was think of a President Gore.

Well there is something to be said about having most of your firearms in a safe place where you can take them out and use them with out digging them up every time you want to go to the range or hunting.

And the govt always follows their own laws. Just look at how well they followed fisa.

Until they put serious penalties for govt workers and politicians of they misuse the law they will all be abused.
