Trump Is Not a Target and That’s Big: Game over? (John Podhoretz)

53 shares A The Washington Post reports tonight: “Special counsel Robert S. Mueller III informed President Trump’s attorneys last month that he is continuing to investigate the president but does not consider him a criminal target at this point, according to three people familiar with the discussions.” You’re going to hear a lot about this story, and much of what you hear is going to focus on its secondary details. Among them, that Mueller is reportedly thinking of writing separate reports about the various charges and those reports could be very damaging.

Do not be misled.

Yes, the story goes on to say that he might become a target later. But Mueller has been at this now for nine months with an aggressive staff. He has issued indictments of various figures and might be going after others. So telling Trump that he’s not a target is a very big deal.

This story could very well be game over for everyone who has hoped against hope that the Mueller probe was going serve as the deus ex machina of the #Resistance and surgically remove Trump from the presidency.

Keep in mind that Podhoretz has been far from being a Trump supporter so this is a "very big deal."

Very skeptical. Didn’t they say not a target for criminal investigation? I guarantee you they are still still scouring the bottom of the barrel for something to use as a basis for impeachment.

Of course he is a target, the investigation would not exist if not for Trump.

They haven't been able to pin the tail on the donkey yet, but they want to keep trying.

At the very least, he's going to be an "unindicted co-conspirator", or words to that Nixonian effect.

Note the “at this point”. If Mueller keeps digging long enough, sooner or later he will find that Trump sold candy to school kids at and inflated price when he was back in 3rd grade. Nothing would surprise me. What a waste of time, money and energy.

The whole idea of this Mueller investigation is to keep it going forever / all the time Trump is in office / with a steady drip drip drip of stupid rumors and stupid rumors about Russian collusion. This investigation must shave 5 points off Trump’s popularity rating. It hurts Republicans running for office.

You can blame this huge distraction on Jeff Sessions and his idiotic and “oh so ethical” recusal. WHEN DID ERIC HOLDER EVER RECUSE HIMSELF?

Please do not pop the champagne just yet! The statement was not a criminal case against President Trump. This does not exclude a counter-intelligence case -- that he was acting as an agent of a foreign power.

Subject of an Investigation: The term “subject of an investigation” has a particular meaning within the United States Department of Justice (DOJ). According to the DOJ Handbook[2], a “subject” is: “a person whose conduct is within the scope of a Grand Jury’s investigation.” A subject is somewhere between a target and a witness. A subject has engaged in conduct that may look suspicious or unethical, but the prosecutor isn’t certain that a provable crime has been committed and wants to do more investigating in order to be sure.

• Target: The term “target of an investigation” is also specifically defined by the DOJ. A person is a target where the prosecutor or Grand Jury has substantial evidence linking him to the commission of a crime. Designation as a target provides a clear warning of a person’s criminal exposure.

Even though your status as a witness, subject or target may be important in guiding your strategy during a particular phase of a federal white collar crime investigation, the key thing to remember about these categories is that they are ultimately meaningless and offer you no protection. Why? Because even if you’re currently a witness or subject, there’s no guarantee that your status will remain unchanged.

Those bags usually have fine print on the individual pieces of candy saying not for individual sale. So yup, that’s a crime!

There was a book published awhile back whose thesis is there are so many laws on the books, everyone is guilty of committing 3 felonies a day.

Read Andrew McCarthy at National Review on the “you’re not a target” game. It only means that they don’t have enough evidence to bring charges against you. Comey played the same game while he was trying to dig up dirt on Trump, all the while assuring him that he wasn’t a target. Once they find the information, he becomes a target.
