A couple points there.

This hypothetical idealogue is going to do this no matter what the testimony is.

The judge has ultimate control of the verdict. He can take the jury's decision away. That happened in one of the tangential russian collusion cases, jury said guilty, judge said "nope." Not saying that will happen here, just that the ultimate power here is not with the jury.

As much as I am against ANY defendant taking the stand, these defense attorneys have done an OUTSTANDING job in this instance I will trust them!!

No kidding. Rittenhouse’s defense team has done a stellar job until now. In most situations, a defendant wanting to testify in a murder case—after his counsel destroyed the prosecution’s star witness on cross-examination—would get a response like this:

“You’re on the road to acquittal...we have clearly established your self-defense motive, and their witness confirmed that, by admitting he pointed a gun at you. Don’t jeopardize your chances by taking the stand. If you want to add something, save it for your book. Otherwise, stay quiet and let us do our jobs.”

Was very impressed by the defense team and their work—until this morning.

To a certain extent. But regardless of how many times a jury gets told that they should take no meaning into a defendant not taking the stand, it’s been shown that juries still consider it.

Yup. It’s psychological, and one does not have to “prove innocence”, but yes, I think it is a positive for the jury to hear the mindset of the defendant. They can then better visualize themselves in the same circumstance.

Yup. I am an attorney. It is not unusual to have your defendant testify when self defense is interposed as your defense. Defendant’s state of mind at the time is critical. The defendant is the only one that can testify to his state of mind. You should have to appraise whether your defendant is up to the task. And this kid is stellar.

That's what I was thinking. He has such a good heart. Nothing, absolutely nothing so far has set off an alarm in me to think that he's Bs'ing.

I’ve spent many, many hours on the witness stand in civil litigation. It’s EASY to screw up with even one or two words quickly!

If KR has a quick mind, and understands the basic principals like the 3 you enunciate, it may work out but it is a big risk.

While it’s a gamble, so far it looks very helpful to bolster the jury’s resolve to find him innocent in spite of the enormous pressure they are under to convict. At least some of the jurors will have a conscience that won’t allow them to convict an innocent man regardless of the pressure.

He probably wanted to testify so he can clear his name. He didnt have to testify, but I think he felt if he didnt people would always wonder what he really felt, until now..and you can see it all over his face he’s a sweet kid, he had to defend himself
