( Vanity ) If Ted Cruz is the Republican nominee

've never started a thread (in 16 years), but I have a question for discussion.

Assume Ted Cruz is the Republican nominee. The Democrat candidate files lawsuits challenging Cruz's Natural Born Citizen status in two or more appellate districts. In one, the Court of Appeals rules that Cruz is a Natural Born Citizen and must appear on ballots. In another, the Court of Appeals rules that Cruz is not a Natural Born Citizen and cannot appear on ballots in that district.

Both cases are appealed to SCOTUS, but no replacement for Justice Scalia is nominated and confirmed. In both cases the Supreme Court splits 4-4. Would the matter revert to the decision of the Appeals Court so Cruz would be on the ballot in some states but not others.

To complicate the matter further, some states, California for example, span two appellate districts. If the decisions conflicted, Cruz would appear on some ballots in a state but not others.

What happens now?

I have no idea how this would play out, but in this situation, in our system, it is possible.

Let’s try cheering for the home team.

Cruz is the most conservative candidate running.

Illinois is Obama’s home state. It is an excellent test of your question.

Now is the time to support Ted Cruz.

I think it would depend on whose head would explode more dramatically. Hillarys or Trumps.

I simply can not see how our Founders would have considered Cruz a natural born citizen.

When the Supreme Court is split the lower court’s decision stands. People are so focused on fighting about Trump vs. Cruz that most seem to be overlooking the significance of the shift in the balance of the Supreme Court that has just taken place and its possible effect on the outcome of the election if Cruz prevails.

As I recall, it is extremely difficult to achieve “standing” in order to bring such a suit, at least for a Republican. Maybe if you are a Democrat the rules change?

I think they would have noticed that his parents were citizens.

since he was born to them— he would be a natural born citizen.

They would also have written language stating that individuals must be born within the borders of the United States.

There could be 40 frivolous lawsuits... and that just Trump and his various bands of supporters this week. Please nobody boo them, or that number may double.

No, cruz was a Canadian at birth. You cannot be both a NBC American and a Canadian citizen at the same time. You may be so jaded that you cannot grasp that, bit that does not change the fact the cruz is not a NBC. And if he were to get the nomination you would see just how fast that would be proven. Fortunately, cruz getting the nomination is just not a real possibility at this point.

Cruz would still need 270 electoral votes regardless of what the courts decided.

It is up to congress to determine if Cruz is eligible. If they deem that he is not eligible, then the VP becomes president. The courts do not have jurisdiction.
