So When Is Eric Holder Indicted?
Market Ticker ^ | 10/4/11 | Karl Denninger

Posted on 10/04/2011 11:00:57 AM PDT by Kartographer

New documents obtained by CBS News show Attorney General Eric Holder was sent briefings on the controversial Fast and Furious operation as far back as July 2010. That directly contradicts his statement to Congress.

On May 3, 2011, Holder told a Judiciary Committee hearing, "I'm not sure of the exact date, but I probably heard about Fast and Furious for the first time over the last few weeks."

If Holder isn’t tried by a Special Prosecutor and convicted of lying to Congress, Scooter Libby should sue the DOJ. He served 3 1/2 years for getting a date wrong in his statement to the FBI during the Bush administration’s Valerie Plame fiasco.

Holder has never been too smart of a guy. He is a mongrel like barry is. He is also a liar like barry...making the race they are attached to look really really bad. When all else fails just lie.

I already put forth the ex-pres clit read the riot act to O’bummer during a recent golf game, that either O’bummer doesn’t run for reelection or everyone in his administration gets investigated then O’bummer himself.

Clit represents the Democratic money raising machine and power base, that base is not happy that they are losing money and Congress because of O’bummer and want another presidential candidate to run in this coming election.

He’s black and he’s a Democrat. The worse that will happen is that he has to leave the DoJ “to spend more time with his family” or “to pursue opportunities in the private sector.”

I am VERY pleased that they are calling for a special prosecutor for Holder... I’ve a feeling HE will be the Fall Guy though and Obama will probably walk away from this!!! “It was all the DOJ” and I was clueless! I really hope that doesn’t end up being the case.

Remember Donofrio’s briefs on Scalia and the power of the Federal Grand Jury? This is a prime example of where We The People could exercise that power! (Not that goofy, illegal American Grand Jury nonsense.)

Any legally empaneled federal grand jury, but especially one in D.C., can investigate malfeasance known to them and issue a presentment (indictment) against Holder. That puts the matter in the courts and forces Holder to resign because the U.S. Attorneys’ Office would be prosecuting the case and they work for him.

If Obama fails to approve a special counsel, the power of the federal grand jury must be exercised. Please start repeating this on GunWalker threads.

Tex

(Apologies, Lucy, but will you, pretty please, ping the group?)

The special counsel investigates the matter and issues a report.

I said: But I remain pessimistic. Most Americans have no clue what Fast & Furious is. Nor do they care. All they are interested in is how Chaz does on Dancing with the Stars.

And how you read: But I remain pessimistic. Most FREEPERS have no clue what Fast & Furious is. Nor do they care. All they are interested in is how Chaz does on Dancing with the Stars.... I have no idea.

A special prosecutor can take over twelve years to investigate.

I’m hoping the cornered rats fight up to the last second, that way more are implicated. I want Zero’s complicity (and Gestapitano’s, Hitlery’s, and anyone else who knew/authorized/planned/sign off on it) revealed and on the stand!

This is not on the MSM's radar screen.

I'll tell you what gets me depressed: clueless conservatives.

F&F not on the MSM's radar screen? Like the MSM serves some kind of objective, news reporting function as embodied in the Constitution? LOL Jeez louise, you don't think everyone and their dog isn't completely aware of what happened, including the CIA, NSA, FBI and illegal immigrant nannies?

Do yourself a favor and read Rutabega's post above. Obama is a puppet - he was put in his current position to facilitate the transfer of $trillions upon $trillions to the game players who run this country.

Do you think they want to give up this gravy train? They could hardly give a sh!t who is president, be it R or D, as along as the status quo is maintained. That means never ending deficits financed by those who earn interest off nothing.

It's the ultimate system of enrichment, and if threatened, they need to think through how to replace -0- with someone else who will keep the game going.

In theory, that's right, but in practice, the DOJ controls what cases the grand jury considers and what witnesses it hears. So, while a "runaway grand jury" is a theoretical possibility, I haven't heard of any case in the last 50 years where a federal grand jury even tried to indict someone that the prosecutor didn't ask them to. (If there was such a case, I'm sure someone will correct me; I can't swear there wasn't, but I've never heard of it.)

So practically speaking, there will have to be an independent special prosecutor appointed first before the grand jury indicts Holder. Congress can push for a special prrosecutor, as they did in Watergate.

Have we ever had an Attorney General go to jail? Be indicted in office? I wonder how that would work.

Nixon resigned, his VP resigned, Attorney Generals usually go quietly in the dark of night.

Thank you! I knew I should've asked.

In theory, that's right, but in practice, the DOJ controls what cases the grand jury considers and what witnesses it hears.

But the grand jury can call any witness it wants, correct?

I haven't heard of any case in the last 50 years where a federal grand jury even tried to indict someone that the prosecutor didn't ask them to.

Maybe because they don't know they have the power to do so?

I need to look up Scalia's speech on this. I was hoping that if Obama doesn't approve a special counsel that we could get word out that any FGJ has the power to investigate, call witnesses, and indict without being directed by the DOJ.
