Expulsion For Gay Comments? Duquesne Student Resists Punishment

Catholic University Sanctions Student for Calling Homosexuality 'Subhuman'

A Duquesne University sophomore will risk being kicked out of school rather than write an essay as punishment for expressing his view that homosexuality is "subhuman."

Ryan Miner, 19, of Hagerstown, Md., was sanctioned by Duquesne after posting his view in The Facebook, an online directory that is not related to the university.

Miner opposed an effort by other students to form a Gay-Straight Alliance group, an issue that is still being debated by the university.

"I believe as a student that my First Amendment rights in the Constitution were subverted and attacked," said Miner.

After Miner's comments appeared online, some students complained to the school.

After a hearing, the Office of Judicial Affairs found Miner guilty of violating the University Code, which prohibits harassment or discrimination based on sexual orientation, among other groups.

A 10-page paper was assigned as punishment. Miner said he refuses to write it and will file an appeal.

Did not realize this was a Catholic school. They should have the right to decide who attends, and this fellow ought to be glad he's not going to be there.

Now he might have an opportunity to attend a REAL Catholic school. He should thank them on the way out for kicking him out.

No, I don't, unless it escalates into homosexual rape.

I mostly consider fraternity pranks and hazing activities to be alcohol and drug induced brain farts.

That does not mean that a stealth fag or sadist won't insert themselves into these type of situations in order to take advantage of a situation, cause they will.

That animals may exhibit behavior that is interpreted by humans as "homosexual" does not mean that animals are homosexual or that the observing humans have a clue. I am extremely tired of the gay agenda of describing the non-normative situational behavior of zoo animals as proof of animal homsexuality.

"Intrinsically disordered" does not mean "sub-human" which is the term the student used. Also, if you're going to quote Roman Catholic teaching, then you should know that the Church does not abide this kind of language toward homosexuals. The Church teaches that all humans should be treated with respect.

you're right, but it's not grounds for a punishment, when was the last time you heard of some college student getting punished for saying something. Heck, if it's against bush or conservatives, they'll make the front page of the campus paper and get an A in the course.

If the student had called African-Americans "sub-human", you don't think he would have been punished? I agree with the previous poster who said that "sub-human" is a Nazi-like term. Once you start saying a group of people are less than human, then it allows for the kind of atrocities that occurred during the holocaust when in addition to millions of Jews, thousands of homosexuals were incinerated. I think the University should give the student the opportunity to apologize. If he does not, then expelling him is not an unreasonable action.

The university has a code that prohibits harassment or discrimination based on sexual orientation. As much as I disagree with the label he used, I don't see how his actions fit either harassment or discrimination.

I believe that speech alone can be considered harassment. I know that in work-place sexual harassment cases, a supervisor need only verbally harass an employee to be found guilty of sexual harassment.

Sure, I can see that. But from what I've read he didn't direct his comments at anybody in particular when he made his comments on a forum outside the university. Maybe there's more to this...

Good post. Yes, I agree that sub-human was a terrible choice of words but I defend his right to say it. First off, he's 19 years old and in my experience students tend to become more "extreme" in the sophomore year then moderate a bit after that. Cut him some slack. Remember that if he supported pedophilia as NAMBLA does, the ACLU would leap up and defend him.
Final point, I'm on Facebook myself and if somebody called Christians or Southerners "subhuman," you can bet that I would give them a piece of my mind but I certainly would not support expulsion. Yes, there are some anti-Christian and anti-Southern groups on Facebook at other schools. The response is usually to start an "Anti- Anti Christian" group.

God the Son served notice upon mankind as to His view
of such acts...at Sodom and Gomorrah...

I suppose God would be charged with a hate crime for those acts today....

This is a Catholic instituiton. They consider the doctrine of total depravity a heresy.

He'd be in trouble no matter what he said, but there is a big difference between saying a behavior is wrong or immoral and saying that the person who does a particular activity is subhuman i.e. not really human. The Catechism talks about the behavior, but doesn't say anyone who practices it is not really human.

Actually many of them don't. Most of the observed "homosexual" behavior of animals is either when they are incarcerated in an unnatural manner in jails or cages, or purely as a dominance display.
