Free speech in jeopardy; Sen. Bingaman hopes 'Fairness Doctrine' is reinstated

Senator Jeff Bingaman (D-NM) was asked by KKOB talk-radio host Jim Villanucci if, "There would be a push to reinstate the 'Fairness Doctrine'?" His answer was, "I hope so." Like all liberals, he thinks free speech should be protected just as long as all the speakers agree with him.

Senator Bingaman also said all media should be regulated "at a higher level." Yet surely, he does not want America to end up like the old Soviet Union where all speech was controlled.

Therefore, to be fair, Congress should place into the 'Fairness Doctrine' that the right-halves of every newspaper in the country be preserved for and controlled by conservatives, and overseen only by conservative boards. The same fairness should apply to the news programming of all television stations. Of course, Senator Bingaman said none of that because he does not intend to control the free speech of the like-minded.

And just who will get to determine what is "liberal" and what is "conservative" anyway, and HOW will the determination be made?

Freedom of speech - such a foreign (or perhaps more accurately, frightening) concept to the b*st*rds on the left.

Wouldn’t it be interesting if, say, Jon Stewart’s “The Daily Show” were to fall under the aegis of a Fairness Doctrine? Then, when Stewart superimposed a photo of Sarah Palin on the screen while holding up a handwritten sign that says “SHEEP F*@KER” (which he recently did), he might have to do something similar with a photo of Joe Biden or Barack Hussen Obama on the screen. He’d be crushed to have to do that, but, hey, the law is the law.

The Fairness Doctrine initially required that during the airing of controversial issues of public significance, if an “attack is made upon the honesty, character, integrity or like personal qualities of an identified person or group,” the station must give timely notice to the attacked person or group and a reasonable opportunity to respond.

Additionally, it required that if a broadcast licensee endorses or opposes a legally qualified candidate in a televised editorial, then that candidate must receive timely notice and be given a reasonable opportunity to respond.

However, the only laws still on the books associated w/the fairness doctrine are the political broadcasting provisions, §§ 312(a)(7) (reasonable access) and 315 (equal access, lowest unit pricing), and their implementing regulations.

Technically the Fairness Doctrine was only an advisory policy of FCC after 1980s research revealed that it had technically never been as part of the statute. Nonetheless, the Supreme Court upheld the Fairness Doctrine in Red Lion Broadcasting Co. v. FCC; and to this day it has not been overruled.

However, in 1971 Congress made clear that § 315 applied to cable operators (§ 312(a)(7)) does NOT apply b/c revocation of license is punishment and cable operators are not licensed by the FCC, rather local franchising boards.

Liberal definition of free speech;

“Say or do anything you want in accordance with liberal positions with bravado and gusto while bravely having no fear of any consequential reactions or argument”

Convervative Definition of free speech;

“Say or do anything you want as long as it does not infringe on the rights or present personnal danger to others. Suffer the consequences and reactions to your excersie of free speech.”
