Jury unable to reach verdict in killing of gay student Larry King

A jury has been unable to reach a verdict in the murder trial of Brandon McInerney, the 17-year-old accused of shooting a gay classmate to death in 2008.

The jury began deliberating Friday, weighing eight weeks of testimony in a trial that included nearly 100 witnesses. Many of those testifying were students and teachers at E.O. Green Junior High School in Oxnard who saw tensions on campus rising after 15-year-old Larry King began coming to school dressed in makeup and girl's boots.

McInerney, then 14, shot King twice in the back of the head in a school computer lab on Feb. 12, 2008. The prosecution says it was a calculated murder carried out in part because McInerney was exploring white supremacist ideology and didn't like homosexuals.

Defense attorneys painted a different picture, that of a bright but abused 14-year-old who snapped after being sexually harassed by King.

The trial was followed closely by gay-rights groups that have fought hard to protect gay and transgendered students from campus bullying. But as the weeks of testimony rolled on and a more nuanced portrait emerged of what was happening at E.O. Green in the weeks before the shooting, it also raised a host of thorny questions.

Sounds as though the jury is hearing about the dark hideous underbelly of "gay rights". The kid snapped after being tormented by the mentally ill sex pervert who was lionized and pampered by the school administration. Did the killer do the right thing? No. But people more easily do the wrong thing - especially 14 yr old kids - when the adults around them do evil. The kid was basically abused by the mentally ill sex pervert and every single adult in that school system who allowed it.

Some homo kids find tough (but straight) boys who are bent on bullying to be a turn-on. It’s easy to see how the situation deteriorates to hell from that point. The homo kid keeps telling the bully he likes him. The bully takes more and more umbrage, which only sexually excites the homo kid more. Eventually if they are not separated, the bully administers a beatdown or worse to the homo kid.

Yep.

Do you think the majority of Americans will be able to defeat this phase of “homosexual freedom and rights”?

I have my doubts given how far the aggressive perverts have infiltrated the Universities, government, media and public schools. They act out sexually with children in the culture, more and more without inhibitation and with self righteousness.

Poor kids. We really are going to be Sodom... Do you think Americans will stop them?

In that case, yes. However, that’s totally different from a gay kid flirting with a guy who’s harassing him for the sole reason that he’s gay, creating an escalating situation that got a kid killed in cold-blood execution style.

I don’t know what kind of grief will have to visit the land to get it to emphatically vomit out this kind of perversion. It was, for me, hard to understand how Sodom could be as bad as it was depicted, till I saw its game played out before the public eye. Gayness never seems to find a place at which it says “enough, I’m satisfied, I stop here.” It is a demonic leech upon the soul with an infinite hunger. We should care about individual homosexuals with compassion, wishing them free of their sinful habit and all the spiritual burden it entails. But no way, no how, should society condone it parading around in public.

OK, well the homo in this case did none of that - other than teasing (which apparently went both ways in this case).

If she were just teased - do you think she would have been justified in shooting from behind in the head those who teased her - possibly in a sexual manner or upon a sexual subject?

Does verbal abuse alone (in this case losing a verbal jousting match that the shooter willingly engaged in repeatedly over time) justify cold blooded murder?

Why of course it doesn’t. Sounds to me like the jury is stuck on “hate crime” rather than on “murder.” This “hate crime” nonsense never belonged in the legal lexicon.

Some info from Wiki for those of us not familiar with the case:

The school could not legally stop King from dressing as such because of a California hate crime law that prevents gender discrimination, although teachers at the school thought that his clothing was clearly in violation of school code, which prevents students from wearing clothing considered distracting.[2] The school issued a formal notice to every teacher on January 29, 2008 via email. Written by eighth-grade assistant principal Sue Parsons, it read, in part:

We have a student on campus who has chosen to express his sexuality by wearing make-up. It is his right to do so. Some kids are finding it amusing, others are bothered by it. As long as it does not cause classroom disruptions he is within his rights. We are asking that you talk to your students about being civil and non-judgmental. They don’t have to like it but they need to give him his space. We are also asking you to watch for possible problems. If you wish to talk further about it please see me or Joy Epstein.[2]

Joy Epstein was one of the school’s assistant principals, and also openly lesbian...

...Brandon David McInerney was born on January 24, 1994 in Ventura, California. His mother Kendra had a criminal history and was addicted to methamphetamine.[2][5] In 1993, Kendra accused her husband William of shooting her in the arm with a .45-caliber pistol.[2] In another incident, William McInerney choked his wife almost to unconsciousness after she accused him of stealing ADHD medication from her older son...

...In August 2008, King’s family filed a claim against E.O. Green Junior High School at Ventura County Superior Court, alleging that the school’s allowing King to wear makeup and feminine clothing was a factor leading to his death.[21] According to the California Attorney General’s Office, however, the school could not legally have stopped King from wearing girls’ clothes because state law prevents gender discrimination.[2]

According to a Newsweek article published on July 19, 2008, some teachers at E.O. Green also allege that assistant principal Joy Epstein was “encouraging King’s flamboyance to help further an ‘agenda’”.[2]...

...Another teacher testified that pupils had told her King would seek them out and follow them into the bathroom, behavior she considered to be sexual harassment. She was told by Epstein the school could do nothing about the behavior.[47]...

...Dawn Boldrin, an English teacher had testified and said she counseled King and told him he should not wear attention getting clothing if he did not want to receive negative attention. However, she gave the teen, who was suffering from a sexual identity issue, a strapless, green, chiffon gown. She meant for him to wear it outside of school. ...”

I don’t know the legal implications, but I don’t see convicting the kid AS AN ADULT. I also don’t see it in any way as a hate crime. It look like murder committed by a kid with a horrible background.

It also looks like a California ‘freaks on parade’ day...what a cesspool of evil and loathsome values being accepted by California, on both sides. Both kids were hung twisting in the winds of adult moral confusion. Kids need guidelines, and all the adults and the state were busy using them for a political agenda of tolerating evil.

See my tagline - this is a sign America (and California) has gone down the toilet. In the America I grew up in, lots of adults would have taken both of these kids away from their morally bankrupt parents and sent them somewhere to grow up. These kids were treated (abused) like pit bulls owned by drug dealers. It is sickening any of this could happen, let alone happen with full support from the government!

I honestly have no idea.
Many people are fooled into believing it isn’t happening.
In some places it is instituted and done under ‘cover of darkness’.
Local school board in my area had wanted to teach such wonderful sexual exploits as bondage and fisting to grade school kids.
Parents heard about it because somebody actually had a backbone and said something, and the plan was shelved.
Odds are, parts of it were likely done at a later date.
What needs to happen is parents need to take an interest in what their kids are learning.
They also need to voice their displeasure and distaste.
Flipside is, too many parents are working two jobs and are unable to take an active role.
Then you have the inattentive parents who are blind to the lives of their children and would be horribly shocked if they’d open their darn eyes for even five minutes.

“The prosecution in closing arguments last week said the jury should find McInerney guilty of first-degree murder...First-degree murder with a gun enhancement carries a mandatory minimum sentence of 50 years in prison.

The defense countered that McInerney was in a dissociative state when he killed King and was not completely aware of what he was doing...should be found guilty only of voluntary manslaughter and use of a firearm, which carries a discretionary sentence as low as 14 years.”

I agree with a murder charge, but not a minimum sentence of 50 years in prison for a 14 year old with a horrible home who may well have been pressured sexually by the victim. I suspect the jury was reacting to the required punishment, rather than the facts of the case.

Both sides argued for a conviction, but the jury couldn’t agree to send the kid to prison for 50 years minimum!

Exactly. As another poster pointed out, the queers can’t take no for answer.

The murder was wrong, but had the supposed “adults” done their job, with effective intervention, all of this could have been prevented.

The kids was being sexually harassed and bullied by a homosexual, nobody helped him. What he did was not right, but was the result of lack of help/intervention by the supposed “adults” in his life.

If a queer eveer hits on me and refuses to stop/back down, I will give a few punches... but nothing fatal.

I think you are both missing the point. Both sides of the trial argued FOR a conviction. The prosecution wanted a minimum sentence of 50 years, and the defense wanted a minimum sentence of 14 years. And the sentencing, either way, could have gone higher.

For the trial, the prosecution overreached.

Both sides of the trial wanted a conviction. NO ONE said the defendant should go free. The question was between a minimum sentence of 14 years, and a minimum of 50 years...
