Advice on dealing with child protective services

My girlfriend has a friend in Washington State, who is a bit odd, Christian, home school type. While they are not not the normal standard people the government would like us to me, she assures me that they are in fact good people who love their children. The also adopted a couple of children from Ethiopia. One of those children died under strange circumstances, so naturally it was investigated. That is perfectly understandable.

It turns out that the child had some sort of tropical malady that led to rapid weight loss loss, erratic behavior and an untimely death. Now this is where it gets bad. Despite the death being ruled to have been the result of natural causes, their other children have been removed form the home and kept form the parents by child protective services. These children who have been home schooled their entire lives and fed on a diet of healthy natural foods are now in foster homes being fed junk and sent to public schools. The children were tested before enrollment and all of them tested at least 3 grade levels above their chronological age. Sounds like some awful parents doesn't it.

Now they have been told by their court appointed lawyers not to say a word or make waves of any kind even though they are regularly being slandered in the press there.

I am chomping at the bit to post some of the articles here and encourage freepers to let the CPS working in Washington State know what we think, but my girlfriend says no, because they haven't asked. I am of the opinion that if we sit on our hands their kids will just quietly be taken away permanently and they will move on to taking kids away from parents who do other odd things like vote Republican and believe in God.

Having gone through a custody fight of my own, I do tend to give the benefit of the doubt to the parents.

Why would you accuse me of trolling? I meant that as sarcasm. As in the government would consider anyone who was a Christian and God forbid did not enroll their children in a government school as a bit odd. If you took that as a jab at either Christians or home schoolers, I apologize.

Large number of children, a small minority of which being adopted children, and it’s an adopted child that dies under supicious circumstances that includes low body weight. You could open up a red flag store with all of those.

Thanks for that link. I had made my posting that we were probably missing ‘the rest of the story’ before I saw your posting.

It makes a lot of sense now. Given what is known, it would have been negligence if they hadn’t removed the children while they investigate.

Doubt about a 13 year old losing 30 lbs, and according to the coroner dying outside of hypothermia? The County Prosecutor is evidently weighing charges, and CPS is the agency that removed the other children until their safety can be assured. What else do you have the "benefit of the doubt" about?

The HSLDA can also link them with attorneys who support their case even if the HSLDA won't take the case themselves. Other resources they can use (who often take pro bono cases) are:

As I said an investigation is perfectly reasonable, but it seems to have become a witch hunt. All the other children including the other adopted child were perfectly healthy and tested 3 grade levels ahead of their age group. Yeah that sounds like some bad parenting.

Tell them to find a private lawyer who can truly dedicate his or her time to defending them and helping them navigate the sytem. Yes it will be expensive but maybe friends and family will be willing to help out.

Tell them most of all DO NOT SPEAK TO CPS AT ALL FOR ANY REASON WITHOUT THEIR ATTORNEY PRESENT TO ADVISE THEM. I can not stress that enough. They are walking through minefield and without proper legal representation they are gonna trip one of the mines.

Second go on the offensive. Publicize as much as possible the medical findings which exonerate them in the death of their child. Publicize any improper or breaches of policy by CPS workers. An example would be not telling the parents of their rights during proceedings. Or giving the impression that a court had sanctioned CPS actions when it had not. CPS has a hard time distinguishing between should and shall and often ignores the restraints that law actually puts on them.

Best to them.

I have little info on this case, but I do know, from personal and professional experience, that CPS in the state of Washington are mostly a bunch of unprofessional, make up the rules as you go along, liberal scumbags. CPS gets sued all of the time and usually loses. They totally suck.

Why did this girl die outside in the rain of hypothermia, and was she under an MD’s care for her illness and rapid weight loss?

DO NOT get a lawyer that practices in that family court. They only kiss up for the next time they are in front of the same judge. You gotta get an attorney that has no reason to be nice to that judge.

Very, very, wise words indeed. We lost our grandkids. Long story I can't go into here except they were taken from their parents for very good reasons. This has to be understood though. The child protective services in this nation in most states has been taken over by hard core liberal activist with their warped liberal agenda. A mother can pick her live in molesting boy friend over her kids and these idiots will help her get the kids back anyway.

I don't trust any lawyer. I saw way too much questionable conduct waiting in hallways for court. Heck I even saw one get a neck massage by his female client while court was in session.

Kids today placed in foster homes for the most part can never be adopted. The parents must surrender their rights and most won't do it. They will however make the kids and your life a living hell till the kids get moved. I got to know my local deputies very well.

here is what the parents in this case will likely face. The kids lawyer G.A.L. as they are called who is supposed to represent their best interest. The CPS caseworker. Usually some 20 something fresh out of Liberal University and hates kids but loves texting on their cell phone. They simply like their nice big state employee paychecks and POWER over others.

I really wish the parents luck in getting their kids back but reality is the odds are highly against them as these jerks doing their so called children protection hide behind many layers of state protections and are friends of the court.

The parents can also look for the state and every lawyer in the court room to go nuclear on any and all witnesses they may bring in and call on their behalf. This would include their friends and any professional witnesses.

My last trip too court I was found in contempt and kids were removed. Myself, my wife, and my parents had been harassed by the parents and no one was stopping it. When I told Judge Sleepy Liberal what I thought of the mother that was it. Trust me the birth mothers by CPS and most judges no matter what they have been convicted of can do anything they please. You as a Foster Parent better like it and not rock the boat.

One last thing to consider. By now the state has likely gone Therapist Shopping. Yes kids who have been in Foster Care due to abuse etc often do need help. This is somewhat different. They look for a therapist specifically with the "systems" mindset. in most cases their therapist will not even have a case history on the child but will make professional statements the stat wishes them too make. A therapist on the other hand which has spent considerable time helping the kids and looking out for the kids will be tore too shreds usually by both the state lawyers and the judge.

As you stated. Never hire a lawyer who has practiced in that court before that judge. In my neck of the woods you have no choice and we had no money to hire one anyway nor are foster parents given any legal help. They will darn sure get subpoenas to court to testify though.

If the child really died of hypothermia, then they should be charged with neglect. Strangely they haven’t been, because the coroner changed his finding. Strangely the news media did not see fit to print that. Taking children away from parents who do strange things like home school may seem like a good idea to you, but not to me. It is an awful thing thing to lose a child, but that will not stop the MSM from using to promote an agenda.

I saw this first hand when a cousin was shot accentually by a friend. The media made pro-gun control statements and attributed them to the child’s father. He man no such statements. He sued and received a cash settlement and a small retraction.

In this case I think the family should be demanding that the truth be printed about the cause of death, but their lawyers are telling them to stay quiet.

If she did the parents would have been charged with manslaughter. The coroner took a second look and changed his findings. If he had not changed his findings they would be charged with manslaughter and rightly so.

You sound like one of those who thought that Janet Reno did the right thing by burning all those children to death at Waco because she thought they were being abused.

Here is a link to the list of states that require all parties to consent to taping of conversations. There are only 12. In addition, the First Circuit federal court has ruled that it is a first amendment right to tape public officials in a public place. It is hard for me to believe that it would be illegal for you to tape public officials in your own home. If you look at the actual laws, even in California, consent is not needed if there is no expectation of privacy.

It should always be legal to audio or video record public officials in the performance of their public duties, In most states it is. This needs to be codified as a Constitutional right, and with the First Circuit decision, we are on our way there.

Meds can make hypothermia happen much easier and sooner especially to someone in an already weakened medical condition. I knew a dentist who gave a patient way too strong of a pain killer. The patients metabolism could not fight of colder temps and almost died as a result.
