House Democrats File Brief Against DOMA

House Democrats today filed a brief in support of a legal challenge to the Defense of Marriage Act, the 1996 law that defines marriage as between one man and one woman.

The amicus brief filed by 133 Democrats, including the party’s top leaders, maintains that Congress hastily passed legislation during President Bill Clinton’s presidency to limit who can marry and asserts that the law is unconstitutional. The brief was filed in a consolidated court case being considered in the 1st U.S. Circuit Court of Appeals, although a release said House Minority Leader Nancy Pelosi (Calif.) and other top Democratic leaders who oppose the law will file similar briefs in other pending court cases.

“Congress passed DOMA without examining its impact on any of the thousand-plus federal laws that take marital status into account or hearing from child welfare or family law experts,” the brief states. “Nor did Congress pause to examine why the federal government traditionally has respected state marriages for purposes of federal law despite the non-trivial differences in state marriage laws over this Nation’s history before rupturing this longstanding federalist practice.”

Separately, a large collection of businesses, cities and professional organizations, including Microsoft, Google and Aetna, filed a brief against the law, according to a release.

Democrats cheered President Barack Obama’s declaration in February that DOMA was unconstitutional and his instructions to the Justice Department not to defend it in court. The move sparked a flash point in the culture wars and prompted Speaker John Boehner (R-Ohio), following a party-line vote by the Bipartisan Legal Advisory Group, to hire outside lawyers to defend the law in pending court cases. While Boehner has taken steps to ensure the law is upheld, Congressional Democrats have pushed to overturn it.

The amicus brief is the latest in the Democrats’ lobbying effort. It asserts that DOMA impedes on state marriage laws and maintains that support in the House for the law is eroding. Thirteen of the letter’s Democratic supporters voted for the DOMA bill in 1996. Still, legislation to overturn the law has no chance of passing in the House or the Senate. The Senate Judiciary Committee is slated to vote on a repeal bill next week, and while it is expected to win approval in the committee, it does not have the 60 votes needed to break a potential filibuster and move to the floor.

This would totally throw out Natural Law Theory as the basis of our Constitution and philosophy and our jurisprudence for over 200 years. It would transform us into one of Marxist philosophy, which defies our form of government. No inalienable rights would exist, because God’s standards are dropped and Marx is the replacement.

They are destroying our Biblical standards (the God of our Founders was the Judeo/Christian one) and replacing it with Barney Frank’s (and Marx’s) standard of Right and Wrong which can not stand. There is no God for them; therefore, no Objective Truth—no right and wrong—it is arbitrary—whoever in power gets to decide or vote even—but with no inalienable rights. Private property could be voted away. Everything when it is arbitrary standards. Our Founders knew this. That is why we are based on Objective Truth—God.

With our system of government, we have Supra Positive Law (it is the reason there was a higher law than King George’s) which gave us inalienable rights which King George was abusing-—so we had the right to revolt—not only a right—a duty!!!!

The Bible is clear on what marriage should be and our legal system has to be based on that standard as stated in the philosophy of our legal system: Right Reason according to Nature. That means we have to use logic, reason, and science to form our laws and it has to be aligned with Nature as God designed it-otherwise, it is NOT JUST law.

All science and reason and nature states that two men can not marry. Natural Law respects the teleological aspects of human beings. Perversion of their nature can never be protected and forced on a people in the US by law. Legally it should be impossible to have “gay” marriage in the USA.

In fact, I disagree with Scalia on this point since he thinks you can “vote” to remove inalienable rights—such as the right of a child to be connected to their biological parents. Our government was formed to protect the Duty of the people—which is first and foremost—to nurture and raise your children to be good people. A stupid law like they are proposing disregards man’s duty and children’s natural rights. It reduces children into objects to be sold or bartered for—where their rights and best interests are TOTALLY disregarded (as is all the science which proves that biological parents are the best people to raise children) . The child is treated as objects, not human beings with dignity and human rights and human needs. A rational society would promote laws which fostered biological parents doing their duty of raising and caring for their young. Laws that don’t do this are unjust and do not treat children with dignity and worth. Government should NEVER undermine the duties of the parents.

It is a Marxist move to destroy biological meaning—they have been trying to destroy marriage with no fault divorce (Lenin did that) and create a promiscuous society to make serial divorce common so they can then add polygamy, etc. It is all to destroy children—make them insecure and lack family support—the only effective unit against government tyranny—that loyalty and security gone—then state becomes the nanny from cradle to grave.

These are the same people who lecture to us about defending states’ rights on right to carry gun laws reciprocity.

When it comes to respecting the decision of the states on marriage, they want those states rights thrown out because they don’t agree with them.

There’s a word that comes to mind about them. But this more than anything else, illustrates who they truly are.

The people that railed against the one-parent family many decades ago, against artificial birth control 90 years ago, against abortion 60 years ago.....they were right then and are still right. Those against perversion and perverting the family/marriage are right.

Secular and low-theology religious may steam roll over these truths and make the new relative the new fashion, but society decays just the same. We see it, it will get worse, and it will eventually devour itself like Pax Romana. And the Church will be here to pick up the pieces of peoples’ lives - a vibrant, but smaller via persecution, Church, growing.

In the mean time - turn off the perverted TV and teach your kids: they’re the vibrant Church’s teachers of tomorrow.

Screw the persecution. Fight back, and fight back hard, mean, and with everything you’ve got.

God didn’t put us here to let ourselves be murdered by communist *ssholes. He put us here to defend what is right, and good, and decent, and by example teach others to stand up and defend Christian principles and Western Civilization.

Make the Left stop - let THEM feel what persecution is like, for once. They’ve been doing this crap to societies for decades now. It’s time that we stop it, here, now - like we stopped slavery.

This is OUR country. We ought not sit by idly and so casually accept “persecution” in our own land.
