What's With All of the Executive Order's Flying Fast?

Ok...so Drudge and others are talking about the E.O. that was re-signed by Obama on Friday with the additional words "non-emergency" added to it as well.

Dig a little deeper...now mind you I am not jumping on the Alex Jones bandwagon just yet...but what's up with these other E.O.'s being signed days and weeks apart that actually link right along with what was re-signed and amended on Friday night?

Establishing the President's Global Development Council

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:

Section 1. Policy.

To help protect national security and further American economic, humanitarian, and strategic interests in the world, it is the policy of the Federal Government to promote and elevate development as a core pillar of American power and chart a course for development, diplomacy, and defense to reinforce and complement one another. As stated in the 2010 National Security Strategy and the Presidential Policy Directive on Global Development, the successful pursuit of development is essential to advancing our national security objectives: security, prosperity, respect for universal values, and a just and sustainable international order. The effectiveness of this development policy will depend in large measure on how we engage with partners, beneficiaries of our development assistance, and stakeholders. We will use evidence-based decision-making in all areas of U.S. development policy and programs, and we commit to foster development expertise and learning worldwide.

Sec. 2. Establishment.

There is established the President's Global Development Council (Council). The Council shall be established for administrative purposes within the United States Agency for International Development (USAID) subject to the foreign policy and budgetary guidance of the Secretary of State.

Sec. 3. Membership.

The membership of the Council shall be as follows:

(a)   The Council shall be composed of the officials described in paragraph (b) of this section and not more than 12 individuals from outside the Federal Government appointed by the President. Appointed members of the Council may serve as representatives of a variety of sectors, including, among others, institutions of higher education, non-profit and philanthropic organizations, civil society, and private industry. (b)   The Secretary of State, the Secretary of the Treasury, the Secretary of Defense, the USAID Administrator, and the Chief Executive Officer of the Millennium Challenge Corporation shall serve as non-voting members of the Council and may designate, to perform the Council functions of the member, a senior-level official who is part of the member's department, agency, or office, and who is a full-time officer or employee of the Federal Government. (c)   The President shall designate a member of the Council to serve as Chair and another member to serve as Vice Chair. The Chair shall convene and preside at meetings of the Council, determine meeting agendas, and direct its work. The Vice Chair shall perform the duties of the Chair in the absence of the Chair and shall perform such other functions as the Chair may assign. (d)   The term of office of members appointed by the President from outside the Federal Government shall be 2 years, and such members shall be eligible for reappointment and may continue to serve after the expiration of their terms until the President appoints a successor. A member appointed to fill a vacancy shall serve only for the unexpired term of such vacancy.

Sec. 4. Mission and Functions.

The Council shall advise and support the President, through the National Security Staff and the National Economic Council staff, in furtherance of the policy set forth in section 1 of this order. The Council shall meet regularly and shall:

(a)   inform the policy and practice of U.S. global development policy and programs by providing advice to the President and other senior officials on issues including:   (i)   innovative, scalable approaches to development with proven demonstrable impact, particularly on sustainable economic growth and good governance; (ii)   areas for enhanced collaboration between the Federal Government and public and private sectors to advance development policy; (iii)   best practices for and effectiveness of research and development in low and middle income economies; and (iv)   long-term solutions to issues central to strategic planning for U.S. development efforts; (b)   support new and existing public-private partnerships by:   (i)   identifying key areas for enhanced collaboration and any barriers to collaboration; and (ii)   recommending concrete efforts that the private and public sectors together can take to promote economic development priorities and initiatives; and (c)   increase awareness and action in support of development by soliciting public input on current and emerging issues in the field of global development as well as bringing to the President's attention concerns and ideas that would inform policy options.

Sec. 5. Administration of the Council.

(a)   The heads of executive departments and agencies shall assist and provide information to the Council, consistent with applicable law, as may be necessary to carry out the functions of the Council. (b)   Funding and administrative support for the Council shall be provided by USAID to the extent permitted by law and within existing appropriations. (c)   The USAID Administrator shall appoint an Executive Director who shall be a Federal officer or employee of USAID and serve as a liaison to the Administrator and the Executive Office of the President and consult with relevant executive departments, agencies, and offices on matters and activities pertaining to the Council. (d)   The members of the Council who are appointed from outside the Federal Government shall serve without compensation for their work on the Council. Members of the Council may, however, receive travel expenses, including per diem in lieu of subsistence, as authorized by law for persons serving intermittently in the Government service (5 U.S.C. 5701-5707). (e)   Insofar as the Federal Advisory Committee Act (FACA), as amended (5 U.S.C. App.), may apply to the Council, any functions of the President under FACA, except that of reporting to the Congress, shall be performed by the USAID Administrator in accordance with the guidelines issued by the Administrator of General Services.

Sec. 6. Termination.

The Council shall terminate 2 years after the date of this order, unless renewed by the President.

Sec. 7. General Provisions.

(a)   Nothing in this order shall be construed to impair or otherwise affect:   (i)   authority granted by law to a department or agency, or the head thereof; or (ii)   functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals. (b)   This order shall be implemented consistent with applicable law and subject to the availability of appropriations. (c)   This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

By the authority vested in me as President by the Constitution and the laws of the United States of America, and in order to advance U.S. foreign policy and protect the national and economic security of the United States through strengthened and coordinated enforcement of U.S. trade rights under international trade agreements and enforcement of domestic trade laws, it is hereby ordered as follows:Show citation box

Section 1. Policy. Robust monitoring and enforcement of U.S. rights under international trade agreements, and enforcement of domestic trade laws, are crucial to expanding exports and ensuring U.S. workers, businesses, ranchers, and farmers are able to compete on a level playing field with foreign trade partners. To strengthen our capacity to monitor and enforce U.S. trade rights and domestic trade laws, and thereby enhance market access for U.S. exporters, executive departments and agencies (agencies) must coordinate and augment their efforts to identify and reduce or eliminate foreign trade barriers and unfair foreign trade practices to ensure that U.S. workers, businesses, ranchers, and farmers receive the maximum benefit from our international trade agreements and under domestic trade laws.Show citation box

Sec. 2. Establishment. (a) There is established within the Office of the United States Trade Representative (USTR) an Interagency Trade Enforcement Center (Center).Show citation box

(b) The Center shall coordinate matters relating to enforcement of U.S. trade rights under international trade agreements and enforcement of domestic trade laws among USTR and the following agencies:Show citation box

(i) the Department of State;Show citation box

(ii) the Department of the Treasury;Show citation box

(iii) the Department of Justice;Show citation box

(iv) the Department of Agriculture;Show citation box

(v) the Department of Commerce;Show citation box

In matters relating to the enforcement of U.S. trade rights involving intellectual property rights, the Center shall consult with the Intellectual Property Enforcement Coordinator.Show citation box

(c) The Center shall have a Director, who shall be a full-time senior-level official of USTR, designated by and reporting to the United States Trade Representative. The Center shall have a Deputy Director, who shall be a full-time senior-level official of the Department of Commerce, designated by the Secretary of Commerce, detailed to the Center and reporting to the Director. The Center shall also have an Intelligence Community Liaison, who shall be a full-time senior-level official of the Federal Government recommended by the Director of National Intelligence and designated by his or her agency, as applicable, to be detailed or assigned to the Center.Show citation box

(d) To the extent permitted by law and subject to the availability of appropriations, and in consultation with the Director of the Center, agencies enumerated in subsection (b) of this section, and others in the Intelligence Community recommended by the Director of National Intelligence, are encouraged to detail or assign their employees to the Center without reimbursement to support the mission and functions of the Center as described in section 3 of this order.Show citation box

Sec. 3. Mission and Functions. The Center shall:Show citation box

(a) serve as the primary forum within the Federal Government for USTR and other agencies to coordinate enforcement of U.S. trade rights under international trade agreements and enforcement of domestic trade laws;Show citation box

(b) coordinate among USTR, other agencies with trade related responsibilities, and the U.S. Intelligence Community the exchange of information related to potential violations of international trade agreements by our foreign trade partners; andShow citation box

(c) conduct outreach to U.S. workers, businesses, and other interested persons to foster greater participation in the identification and reduction or elimination of foreign trade barriers and unfair foreign trade practices.Show citation box

Sec. 4. Administration. (a) Funding and administrative support for the Center shall be provided by USTR to the extent permitted by law and subject to the availability of appropriations.Show citation box

(b) The United States Trade Representative, through the Director of the Center, shall direct the work of the Center in performing all of its functions under this order.Show citation box

Sec. 5. Definitions. For the purposes of this order:Show citation box

(a) the term “U.S. trade rights” means any right, benefit or advantage to which the United States is entitled under an international trade agreement and that could be effectuated through the use of a dispute settlement proceeding.Show citation box

(b) the term “domestic trade laws” means any trade remedies available under U.S. law, including, but not limited to, sections 201, 301, 406, and 421 of the Trade Act of 1974, as amended (19 U.S.C. 2251, 2411, 2436, and 2451); sections 332 and 337 of the Tariff Act of 1930, as amended (19 U.S.C. 1332 and 1337); section 281 of the Uruguay Round Agreements Act (19 U.S.C. 3571); and self-initiation of investigations under Title VII of the Tariff Act of 1930 (19 U.S.C. 1671).Show citation box

Establishing a White House Council on Strong Cities, Strong Communities

By the authority vested in me as President by the Constitution and the laws of the United States of America, and in order to forge a partnership with local communities to provide them with comprehensive technical assistance to use and compete for Federal resources more effectively and efficiently, which will enable them to develop and implement economic strategies to become more competitive, sustainable, and inclusive, it is hereby ordered as follows:

Section 1. Policy.

Cities, towns, and regions across our Nation continue to face difficult economic challenges. Enhancing current Federal assistance is helping to lift communities out of distress. To allow the Federal Government to better partner with these local communities to build local capacity to address economic issues, and to support comprehensive planning and regional collaboration, my Administration established the Strong Cities, Strong Communities (SC2) pilot initiative. By partnering with cities and regions to augment their vision for stability and economic growth, the SC2 was designed to help communities strengthen their capacity to create jobs and more competitive business climates, and implement locally driven community and regional planning approaches that lead to sustained economic growth, as well as ensure that Federal assistance is more efficiently provided and used.

This order improves the way the Federal Government engages with and supports local communities by better aligning resources and coordinating efforts across executive departments and agencies (agencies) so that communities across the country have access to comprehensive, localized technical assistance and planning resources to develop and implement their economic vision and strategies.

Sec. 2. White House Council on Strong Cities, Strong Communities.

There is established a White House Council on Strong Cities, Strong Communities (Council)

(a)   Membership. In addition to the Co-Chairs, the Council shall consist of the following members:   (i)   the Secretary of the Treasury; (ii)   the Secretary of Defense; (iii)   the Attorney General; (iv)   the Secretary of the Interior; (v)   the Secretary of Agriculture; (vi)   the Secretary of Commerce; (vii)   the Secretary of Labor; (viii)   the Secretary of Health and Human Services; (ix)   the Secretary of Transportation; (x)   the Secretary of Energy; (xi)   the Secretary of Education; (xii)   the Secretary of Veterans Affairs; (xiii)   the Secretary of Homeland Security; (xiv)   the Chair of the Council of Economic Advisers; (xv)   the Administrator of the Environmental Protection Agency; (xvi)   the Director of the Office of Management and Budget; (xvii)   the Administrator of General Services; (xviii)   the Administrator of the Small Business Administration; (xix)   the Chief Executive Officer of the Corporation for National and Community Service; (xx)   the Chairperson of the National Endowment for the Arts; (xxi)   the Senior Advisor and Assistant to the President for Intergovernmental Affairs and Public Engagement; (xxii)   the Assistant to the President and Cabinet Secretary; (xxiii)   the Assistant to the President for Economic Policy; (xxiv)   the Chair of the Council on Environmental Quality; (xxv)   the Director of the Office of Science and Technology Policy; and (xxvi)   the heads of such other agencies and offices as the President may, from time to time, designate. A member of the Council may designate, to perform the Council functions of the member, a senior level official who is a part of the member's agency or office, and who is a full time officer or employee of the Federal Government. (b)   Administration. The Co Chairs shall convene regular meetings of the Council, determine its agenda, and direct its work. The Secretary of Housing and Urban Development shall appoint an Executive Director of the Council to coordinate the Council's activities. At the direction of the Co Chairs, the Council may establish subgroups consisting exclusively of Council members or their designees, as appropriate. Agencies may detail staff to the Council to support its coordination and implementation efforts.

Sec. 3. Mission and Function of the Council.

The Council shall, to the extent permitted by law, work across agencies and offices to:

(a)   coordinate the development and implementation of the various components of the SC2, as determined by the Co Chairs; (b)   coordinate agency efforts to ensure communities have access to comprehensive, localized technical assistance and planning resources to develop and execute their economic vision and strategies (including, where appropriate, efforts of existing committees or task forces related to providing technical assistance to local governments and improving their capacity to address economic issues); (c)   ensure that members of the Council incorporate SC2 implementation efforts into their agency annual performance plans and those efforts' outcomes into their annual performance results; (d)   provide recommendations to the President, through the Co Chairs on:   (i)   policies for building local expertise in strengthening local economies; (ii)   changes to Federal policies and programs to address issues of special importance to cities and local governments that pertain to local capacity and economic growth; (iii)   implementing best practices from the SC2 initiative Government-wide to better support cities and local governments; and (iv)   opportunities to increase the flexible utilization of existing Federal program resources across agencies to enable more performance and outcome-based funding; (e)   encourage the development of technical assistance, planning, and financing tools and implementation strategies that can be coordinated or aligned across agencies to assist communities in building local capacity to address economic issues, engaging in comprehensive planning, and advancing regional collaboration; and (f)   facilitate the exchange of ideas and strategies to help communities address economic challenges and create sustained economic opportunity.

Sec. 4. Outreach.

Consistent with the objectives set forth in this order, the Council, in accordance with applicable law, shall conduct outreach to representatives of nonprofit organizations, businesses, labor organizations, State and local government agencies, school districts, elected officials, faith and other community based organizations, philanthropies, other institutions of local importance, and other interested persons with relevant expertise in the expansion and improvement of efforts to build local capacity to address economic issues in cities and communities. The Council will convene an annual meeting of interested parties including mayors and city employees to share key findings and progress, offer best practices, and promote strategies that have worked in communities participating in the initiative.

Sec. 5. Reports.

Within 1 year of the date of this order, and annually thereafter, the Executive Director shall provide a report to the Co Chairs on the work of the Council and its achievements during the year, including demonstrable changes in the capacity of local communities to implement their economic development goals and efforts to achieve more efficient and effective use of Federal resources.

Sec. 6. General Provisions.

(a)   The heads of agencies shall assist and provide information to the Council, consistent with applicable law, as may be necessary to implement this order. Each agency shall bear its own expense for participating in the Council. (b)   Nothing in this order shall be construed to impair or otherwise affect:   (i)   the authority granted by law to an executive department, agency, or the head thereof; or (ii)   the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals. (c)   This order shall be implemented consistent with applicable law and subject to the availability of appropriations. (d)   This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

ED MORRISSEY’s Hot Air post http://hotair.com/archives/2012/03/18/national-defense-resources-preparedness-executive-order-power-grab-or-update/ sounds knowledgeable but when I read the EO at whitehouse.gov it sounds evil - that other POTUS’ have addressed that issue does not really comfort me at all. No other POTUS before BHO was so unAmerican and so begged for indictment.

The President is to appoint the heads of the departments and agencies as well as the Council members. Notice how many Czars he's already named so how many of them are already in position?

Crash the economy and the sheeple will be begging to serve Hitler in any job. He's already proven how he can sweep through major corporations so bankrupt cities will be next. Then it's just a matter of setting up his minions to "help" out these bankrupt communities. It's all falling into place and no one, NO ONE, in the other two branches is doing a thing to stop him.

Others see the EO as just another bit of criminal conceit of authority:

If other POTUS' criminally violated our law by perpetrating executive legislation (and got away with it) thatt is not a lawfully significant justification for any other POTUS to do so.

Just because someone robbed you once and got away with it does not make it their right to rob you again.

The crime is still a crime and

a crime that is not subject to any statute of limitations

that could shield the perpetrator from either temporal or eternal condemnation.

The criminal code violated by unConstitutional Executive Legislation is US Code Title 18 Chapter 63 Sections around 1346 "Frauds & Swindles" having a leg landing in Virginia so as to perpetrate VA18.2-481(5) statutory treason and VA18.2-111 statutory embezzlement.

The context for this question of criminally perpetrated 'frauds & Swindles' by EO's which are not addressed ONLY to subordinates in the executive branch

or not limited in scope to the mere detail of implementing laws explicitly authorized under our Constitution

is raised in the 1792 words of Thomas Paine:

“A constitution is not the act of a government, but of a people constituting a government; and government without a constitution is power without a right. All power exercised over a nation, must have some beginning. It must be either delegated, or assumed. There are not other sources. All delegated power is trust, and all assumed power is usurpation. Time does not alter the nature and quality of either”.

It appears that neither execute orders nor signing statements can be given or conceited to have the authority of general civil law upon the people of the United States as that is “legislation-by-executive-order" explicitly prohibited by our U.S. Constitution in Article I Section 1 “All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”

'ALL' in #A1S1 means just that, 'ALL', as in EACH AND EVERY INSTANCE THAT CAN EXIST.

The Legislative authority vested in the members of Congress by the member's oath are of personal duty in nature. "Duty is not collective; it is personal.” - Calvin Coolidge

No member or aggregation of members has been vested with Constitutional authority to sell, assign or delegate their oathed personal service duties to any other person or agency.

It seems obvious to me that every instance of legislation-by-executive-order or signing-statement appears to be criminal fraud and usurpation - It is of no matter that the judges, justices, legislators and the executives are willing - they do not appear to have the authority to come to terms as that authority as is retained by the people and the states (US Constitution 10th Amendment).

It seems obvious to me that the POTUS -Commander-in-Chief has authority that allows him to make constitutionally lawful orders and constitutionally lawful standing orders upon the US military, applicable to the POTUS’s military employees only.

It seems obvious to me that the POTUS - Chief Executive has authority that allows him to make constitutionally lawful orders and constitutionally lawful standing orders upon of the POTUS’s civilian employees, applicable to the POTUS’s civilian employees only.

It seems obvious to me that the POTUS - Chief Executive has authority that allows him to make signing-statements-attached-to-legislation that have no conceit to a binding effect upon legislation.

It appears obvious to me the every executive order or signing-statements-attached-to-legislation that is an exercise of executive legislation is a grievous trespass against the Constitution and its duly authorized penal laws.

If my perception is in error, that this appearance is not fact, please show me the source of my error by reference to the U.S. Constitution and its duly authorized law.

I see it as an avenue to dramatically reduce gas prices just prior to the elections for vote bartering.

Obama works to get gas at $10 a gallon nationwide but then a week before the electing he drops it by using the provisions of this bill to $1.99 a gallon trumping everyone.

And the day after he is sworn in it reverts back.
