Source: Robbery suspect shot by 7-Eleven clerk, in critical condition

VIRGINIA BEACH, Va. (WAVY) — A robbery suspect is in critical condition after he was shot by a 7-Eleven clerk Saturday, a source tells 10 On Your Side.

Virginia Beach police say Davin McClenney robbed the 7-Eleven in the 300 block of Kellam Road. Officers were called to a reported robbery at the convenience store at 1:06 a.m. Saturday.

Police say when they got on scene, they found McClenney with a gunshot wound to his upper body. He was taken to the hospital with life-threatening injuries.

McClenney has been charged with two counts of robbery and wearing a mask in public. 10 On Your Side dug into his criminal history and found he has been arrested three other times for robberies. He pleaded guilty in 2006 to two counts of robbery.

McClenney was also charged after a home invasion on East Bay Shore Drive in July 2016. He spent several months in jail and then in December, he was allowed to bond out.

The Commonwealth Attorney’s office tells 10 On Your Side they argued against McClenney bonding out, but the judge still granted it.

McClenney was scheduled to go to trial on the charges in August.

WAVY News reached out to 7-Eleven management, who said they could not comment on the case.

I will e-mail the reporter asking why the judge wasn't named. That judge needs lights,cameras and microphones shoved in their face asking why they put the public at risk.

That judge needs to be removed from office and face charges of gross criminal negligence.

The judge should have been laying on the floor alongside the robber.

I, too, would like to know the basis for the judge's decision given his prior arrests. If he dies, did the judge do him a favor?

I think it’s a right to a bail hearing, not bail.

Armed robber who keeps attcking society, yep, catch and release until someone is killed. Poor judging skills if you ask me.

In this case it was the robber who is knocking on death’s door, with any luck the thug dies from complcations,

Now he’s been “rescheduled” for a pine box, coupled with his long-awaited meeting with Satan. This is probably the first of three or four postings of this type today, if it’s a “normal” Tuesday in “The Hood.”

Considering his lengthy rap sheet, and the violent nature of his crimes, the judge could have denied bail or set it so high that no bondsman would have provided the bail money.

You are right, however, in non capitol offenses the 8th amendment states “no excessive bail”. Home invasion is not a capitol offense and it had been ten years since his previous arrest. There would be no room in jail if we held everyone before trial.
