80% of Potential SCOTUS Nominees on W's List Decline His Offer

During the 11:00 p.m. (CST) newsbreak, Donna Fuducia reported that Karl Rove told James Dobson that 80% of the potential SCOTUS nominees on the President's list declined his offer because of they didn't want to undergo the grueling confirmation process. Perhaps this sheds new light on the reason why W chose Miers.

Easy to say. But what do you do with a divided caucus? The simple fact is that the Conservatives did not win enough seats in the Senate. If they had taken Louisiana and Colorado, would any of this have happened?

Ever since Brandeis, there's been the tradition of a "Jewish seat" on the court. I have no doubt we're going to have the Court carved up according to identity politics eventually.

And you are assuming that there were 25 nominees on the list!!! I doubt that they were that many. I will say five or six, maximum 10.

Then, expand the names on the list and keep going until you find a known originalist ready to accept the nomination.

Heck, nominate someone like Mark Levin who would love to take on Senators in such a hearing.

It's called misinformation being released to try to justify the lack of principle in the administration. First, it was because there weren't enough Senators to approve an open originalist. That didn't fly. So, now this is the excuse.

Don't you believe Dobson spoke up without permission from Rove to do so.

I believe Dobson is wrestling with the idea that Rove and the Whitehouse lied to him.

YES!! We ALL want originalist Justices -- we are disagreeing on strategery and tactics, not goals!

BTW, Jim, thank you for allowing this important debate to proceed. There have been heated emotions and lots of flame, but it will only make us all stronger.

We all worked hard to elect the President, and with the possible exception of the WOT these SCOTUS nominations are THE most important issue for most of us. Since the President has the sole power of appointment, we can only hope he won't violate our trust. I believe he knows Harriet Miers and he'll keep his word on this. If not -- then he will go down as a turncoat and all of us who supported him last year will feel complete betrayal. Unless and until that happens, though, I'm lashed to the ship he commands!!
