Obama's mother was an American citizen - not that that matters. He was born in Hawaii. That makes him an American. Where his parents were born is not at all relevant, nor does it make him a "dual citizen" at birth. Automatic birthright citizenship is based on birth on American soil, and is generally unaffected by the legal status or citizenship of the mother or father. Donofrio's interpretation of the words "natural born citizen" are not supported by law or interpretive history, and would have rendered John McCain an invalid candidate as well. Because the State of Hawaii vouched for the authenticity of Obama's birth certificate, it's over.

Time to call Sancho Panza and the donkey and ride home.

My understanding is that the primary relief sought by his application was for a stay, so by denying the stay, they have effectively denied the entire case.
As we say when one case is finally concluded...”next case”. And there are other cases.
Keyes’ case has the best chance of clearing the standing threshold issue.
I do not pretend to know what the SCOTUS is thinking, but I suspect that if they do want to hear this controversy, they decided this was not the best case to do it. And if that is the case, I agree with that.

what is the time frame/status on Keyes case?

Nothing important has changed since yesterday.

The Constitution still has a non-negotiable clause which demands that a President be a natural born citizen.

Barack Obama still has not released a simple twelve dollar document to prove that he is a natural born citizen of the United States.

Judges, elected officials and electors are still bound by the oath they took before God to uphold and defend that Constitution.

The burden of proof remains on Barack Obama. The burden of enforcement still remains on every sworn officer of the United States government.

While it saddens me to see the SCOTUS take a pass on this, the part that hurts the most is to see our own people say that those to took Clinton and Obama to task, were unrealistic, just not savvy in political or criminal matters.

Folks, if we are going to cave on obstruction of justice, witness tampering, Constitutional requirements for our Presidents, let’s just pack it in. The nation is lost.

Our side appointed seven of the nine current sitting SCOTUS Justices. And still we seldom get a ruling that is sound on important matters.

Looks like Schwarzenegger should just put his own name on the ballots and run in 2012. Nobody give a s—t.

Nothing about Kenya or the actual Birth Certificate has even reached the Supreme Court yet. Give it time. If it is proven that Obama is a legitimately qualified candidate, I will accept that. But so far he has not proven such.

This is really going to become an issue as people like me who share a common upbringing are able to attest to amount of records there really are, what the documents look like and what the processes are. As such, having direct experience that mirrors Obama puts us in a position to articulate to people what is going here.

Everyone that knows me, knows my life story and I can easily raise the issue and awareness by speaking from the authority of experience.

The challenge right now is not many people are aware of the Obama challenge.

I have told a lot of friends, in jest(but seriously), to prepare and they had not even heard of this.

There has got to be a way to make clear and loudly that this problem is real and must resolved. And, involve more people consciously on this.

I won't give up.

Paraphrase WFB, "It's important to fight the good fight, especially if it's a lost cause."

However, I'm adjusting my strategic mindset to the reality of the disadvantages we now find ourselves in.

I'm certainly not going forward with any more of that irrational belief I had that America is by and large still the conservative and moral people that elected Reagan.

They vouched for the authenticity of his BC, but not of a Hawaii BC. Quite a difference.

The Gov of Hawaii is a Republican? I didn't know that. Must be a RINO. Hate to say that but the state is notorious for it's liberalism and left wing politics.

She, or any other state official, would have been in violation of their own state laws and oaths of office, if they had released the document to anyone but the individual (Obama), or through an order of a court having proper jurisdiction.

Yup and I stand corrected on that. Still, my point was that nobody FOUGHT to avoid disclosure. Obama simply said "NO" and the Hawaiian Governor followed the law. The only folks fighting were the ones trying to force disclosure.

See this stuff comes under the definitions of VETTING and the time for it was way back when he won in IOWA. You snooze, you lose. Simple. Give him his shot at trying to destroy the country so we can have ours in 2010 (1994 redux?). In any case, we had to have Jimmy Carter to get Ronald Reagan.

If we can survive until 2012 we have a good chance to elect Palin or Jindal. Maybe on the same ticket. Personally, I don't care which is at the top of the ticket.

The truth is that the constitution does require that any president be 35 years old, a natural born citizen, and 14 years a resident.

The truth also is that the constitution does not establish any responsible office or party to verify that those qualifications are met.

I assume it is up to each elector to make his/her own determination of eligibility.

I also assume that Congress could legitimately set up a verification office/protocol if it wishes. They haven’t done so to date.

Russia has said already it will not honor anything signed by Obama. They do not recognize him as a legitimate leader.
Big surprise there eh?

I hate to admit this, but I will at this point. I can agree more with an article printed in Pravda than most of the MSM here.

I believe the Keyes case is still pending in the Cali court system.

It wont get to the SCOTUS before the electoral college meets.

It probably will not get to the Court prior to January 20.

But if he perseveres, it will probably get there eventually.

Those Americans that did vote for Obama (it certainly was not all of them) in the most part, could not tell you what the Constitution is, what the Bill of Rights is, who wrote them, or what they even stand for. Nor do they have any care or knowledge about THE LAW that governs elections.

So right. Read a blog today of someone who was ranting and raving just a few weeks back to vote for Obama and yet said "Clinton was named to the Secretary of the House or whatever (don't want to google it)."

The assumption was made that the Marxist was born in Hawaii. Therefore, the whole case must be flawed.
