How smart is Ted Cruz?
Washington Post ^ | August 26, 2013 | By Jennifer Rubin

Smarts don’t always equate to common sense. In the case of Sen. Ted Cruz (R-Tex.), there is an inverse relationship between the two. I’m told by smart lawyers that he has a sharp legal mind, can think on his feet and has remarkable recall for facts, cases and even page numbers of the briefs. But his political judgment has become distorted by ambition.

Interestingly, he no longer is touting the line that Republicans unwilling to join the suicide squad ”own” Obamacare. Perhaps someone told him that among the obnoxious and untrue things he has said, this ranks at the top and will put him crosswise with a majority of those GOP senatorial candidates running in 2014.

A Cruz presidential run into 2016 would be interesting, if not downright amusing. An early rebuke in his young career might be a beneficial dose of cold water — or devastating to a pol who, even among senators, is excessively convinced of his own exceptionalism.

Cruz is not the guy to build the party or a governing majority (which requires moderate Republicans). But he is just the person to build up Ted Cruz. In fact, he is masterful.

The Nationality Act of 1940
under the law in effect between 1952 and 1986 — Cruz was born in 1970 — someone must have a citizen parent who resided in the United States for at least 10 years, including five after the age of 14, in order to be considered a natural-born citizen. Cruz’s mother, Eleanor Darragh, was born in Delaware, lived most of her life in the United States, and gave birth to Rafael Edward Cruz in her 30s.

what was the law in 1790?

Naturalization Act of 1790, signed into law by President Washington: “the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens.

That is not the law that applied December 22, 1970. Please see Pub. L. 82-414 § 301(a)(7)

That law was repealed in 1795, more than two centuries ago. Please keep up.

Those laws you mentioned were requirements for eligibility of Citizenship..........not natural born Citizenship. The 1790 law was repealed 5 years later with the natural born Citizen language taken out.

It’s all so very tiresome. I’m gonna try ignoring for a while. It’s hard to resist jumping in sometimes though, like when someone posts for the millionth time how an appointed Senate would a panacea for all our ills, as if. I hate to see idiocy and troll posts go unchallenged.

I am a vet of overseas duty in WWII and my brother was killed on Okinawa. We were born in the USA. Our parents were from Russia and not ‘naturalized’ when we were born. I have never heard of or been offered to have our births to/from non citizens ‘wiped clean’ for purposes of being declared a ‘natural born ‘ citizen. Perhaps someone just forgot to tell my brother and me.

“Cruz wiped the Canadian slate clean.

Have you not read the news?, and he never declared himself a Canadian citizen.”

He didn’t have to declare himself a Canadian citizen since he was already born one.

So I looked up the statute that you quote via a couple of links you’ve provided elsewhere

http://www.gpo.gov/fdsys/search/citation2.result.STATUTE.action?statute.volume=66&statute.pageNumber=163&publication=STATUTE

http://www.law.cornell.edu/uscode/text/8/1401

under which the law expressly states that he is a US citizen by birth. Why, therefore, are you claiming that he was naturalized?

Citizen AT birth BY statute. The statute specifies “citizen”. If Congress so desired the statute could have specified “natural born citizen”.

This is no different than if the mother was single and was on a vacation over seas when he was born.

Exactly. The wasted time by all of the amateur 'constitutional scholars' here would be funny if it wasn't such a sad waste of time and energy.

It's Not Complicated

This is odd, isn’t it? Normally, a brilliant politician gets their admiration in spades. And a magna cum laude law degree from Harvard, editing the Harvard law review AND the Latino Harvard review. Why...if this were Obama, they would be falling all over themselves licking his boots.

AND, if it were any other Latino moderate Republican with those credentials, they’d be building him a throneroom at theis very moment.

But, Cruz is a Christian Conservative. And that disqualifies him in their minds.

None of that achievement counts with him.
