This may seem to be a rather obscure topic, but it popped up while I was reading Helen Smiths musings on whether or not pornography should be made illegal and the long term, detrimental effects that it can have on marriage. As a subset of that discussion, she touched on David Friedmans book, Laws Order: What Economics Has to Do with Law and Why It Matters. In it, Friedman makes the following observation on prostitution in general and the specific side effects it can have when married men pay for sex outside of marriage. (I specify men here only because incidents of women engaging prostitutes are so rare as to be a statistical anomaly. In theory this would apply to either gender.)

Yeah, but in Virginia I almost have to have an eyewitness to the copulation to prove adultery. Apparently the fact that they have been living together for the past 1.5 years is not enough proof.
And then there is the Clinton argument that certain types of sex is not sex.
Maybe you can get them to commit perjury and claim that they are not (in front of a judge and in a court).
That sounds like a member of the "other team speaking."
I can't speak for all conservatives, but I can speak for myself.
I would be totally at peace if merely the government at all levels stop subsidizing the "pro-sodomy" and other perversion brigades directly or indirectly in word and in deed; e.g. public funding of gay parades, teaching tolerance of perversion as an "education" requirement, legislating "tolerance," etc.
I attempted to watch Modern Family once. Two things turned me off.
1. The openly gay couple made me sick.
2. I couldn’t understand a word Sofia Vegara said. But I did enjoy looking at her.
No, it should not be illegal, but they should allow temporary insanity defense in such cases.
Anyone who has ever lived with cats knows the default position is LID down! Hubby and I never have any disagreement about the seat because we both don’t want a soaking wet, pissed and terrified cat crawling into the bed.
My view on adultery is that it is a sin. But I dont want it made into a crime. Does that make sense?
Yes it does, however when government gets involved...

Secular government seems like an oxymoron. As for adjudication, it gave me a headache.
I have a 28 year old daughter who lives with us who leaves the top lid up ALL THE TIME!

The actual biblical approach to such affairs is known as “Noahide commandments.”
I was jailed in Georgia on just such an offense. Lady friend’s father had us both jailed. Gendarmes came in the middle of the night...sheesh. Good thing I had an outside friend and some bail money.
Or do what they’ve done in parts of Europe and pass a law requiring men to pee sitting down.

No. With the legalization of same sex marriage, you just know that making adultery illegal would FLOOD the courts chock full of warring gays.

Agree. I have enough laws from the guvmit telling me what to do. I don’t want anymore laws.
If a man or woman commits adultery, thats between him, his wife and God. (and ultimately divorce court)
If my wife had committed adultery, I would have handled it the way I see fit... in my house... in private. If it was a mistake that she was truly remorseful for, I would have forgiven her because God has already forgiven her and I am not better than God.
trust me... when a loved one is laying on their death bed, past mistakes are the furthest thing from your mind.
People can handle their own affairs without the guvmit stepping in.
Laws are always about regulating one person’s view or views of morality upon other people.
It used to be a capital crime to curse the “king”. We’d all hang here on FR if that was still the law.
Good luck trying to enforce that as it is unenforceable just like Prohibition was.
You cannot legislate morality.
Why have these laws been allowed to stand? This isn’t a no-fault divorce! This thread is giving me a super headache. I never understood spousal support for the one committing adultery. If she leaves for someone else, she should not have support from you. I’ve heard of other men who are in the same position, never women.
Who came up with the idea that just because you lived a certain lifestyle you have a right to live that life after you choose to leave that life? Must have been the lawyers.
