Baltimore police lieutenant cleared in Freddie Gray death
A Baltimore judge on Monday cleared the highest-ranking cop tied to Freddie Gray’s death.
Lt. Brian Rice was found not guilty of involuntary manslaughter and reckless endangerment in a bench trial before Baltimore Circuit Court Judge Barry Williams.
Prosecutors had blamed Rice for Gray’s death because he did not put a seat belt on the prisoner when Gray was loaded into the back of a police van. Gray, 25, died from spinal cord injuries he suffered on his ride in custody.
Rice, 42, is the fourth officer to go on trial, with the previous three winning two full acquittals and one mistrial.

Rice, 42, was cleared of charges including involuntary manslaughter, misconduct in office and reckless endangerment. He elected a bench trial, and Circuit Judge Barry Williams decided his fate instead of a jury.
Two other officers were previously acquitted in relation to Gray’s death — Edward Nero and Caesar Goodson Jr. Another officer, William Porter, had a mistrial last year after a jury could not reach a consensus on the charges brought against him.
All of the officers involved in the case have pleaded not guilty. Williams previously acquitted Officers Edward Nero and Caesar Goodson Jr. of all charges. The case against Officer William Porter ended in a mistrial in December. He is scheduled to be retried in September. Officer Garrett Miller will go before a judge on July 27, and Sgt. Alicia White’s proceeding begins Oct. 13.

BALTIMORE (WJZ) — Baltimore City State’s Attorney Marilyn Mosby has been under fire. Now she could potentially face being disbarred, WJZ’s Meghan McCorkell reports.
A new complaint filed with the Maryland Bar Counsel calls Mosby “a runaway prosecutor” and alleges she violated ethics rules, claiming she never had probable cause to charge six officers in the death of Freddie Gray.
“I think Marilyn Mosby has harmed the city of Baltimore. And if she continues, that harm will get worse,” said law professor John Banzhaf, George Washington University.
Banzhaf, who filed the complaint, accuses Mosby of only filing charges to stop the unrest in Baltimore.
“I heard your call for ‘No justice, no peace.’ Your peace is sincerely needed as I work to deliver justice on behalf of this young man,” Mosby said in May of 2015.
Banzhaf’s complaint calls Mosby’s words a “misuse of her role” and a “perversion of her office.”
“It’s a crime, it’s unethical to indict somebody simply because it will quell the thirst of a rioting mob,” he said.
Stupid prosecutor....cannot get a conviction because police were doing their job....
If Mosby still has a law license at the end of this fiasco, we’ll know what privilege looks like.
I sure as hell wouldn’t take this to a Baltimore jury.

Would one single reporter EVER ask the stupid President if the data actually reflects the belief that black men are under attack from the police? Just make him say it, one way or the other. He will stammer around and mumble some nonsense about disparate impact or some such, but I would love to see him claim that the real numbers reflect what these idiots believe. He would never be able to claim that it does!

They elected the politicians. They elected the DAs and/or their politicians appointed the prosecutors.

WASHINGTON - July 5, 2016 - PRLog — The career, and probably even the financial future, of Baltimore State’s Attorney Marilyn Mosby may well be on the line this Tuesday as she must decide - faced with two disbarment complaints, five civil law suits, and a judicial hearing based upon newly-filed motions into her allegedly fraudulent conduct - whether to proceed with the criminal prosecutions of police officers.
Both disbarment complainants - one by a former prosecutor, and the other by a law professor who has been successful in filing similar complaints - have analogized her situation to that of Mike Nifong who prosecuted several Duke lacrosse players for rape even after it was clear that the prosecutions weren’t justified. Indeed, Mosby has been referred to as “Nifong but in a dress.”
For his wrongful actions, Nifong was disbarred, driven into bankruptcy by law suits over the prosecutions, and eventually jailed, notes public interest law professor John Banzhaf, who filed one of the two complaints against Mosby.
If Mosby likewise continues with additional prosecutions - having not only failed in the first three, but also having had the judge reject virtually all of her major legal theories of criminal liability - she will substantially strengthen the case for her own disbarment, and greatly increase the potential damages in the civil cases brought, and to be brought, against her.
