Mr. Speaker, I rise to restore the right the founding fathers saw as the guarantee of every other right by introducing the Second Amendment Protection Act. This to keep and bear arms by repealing unconstitutional laws that allow power-hungry federal bureaucrats to restrict the rights of law-abiding gun owners. Specifically, my legislation repeals the five-day waiting period and the "instant" background check, which enables the federal government to compile a database of every gun owner in America. My legislation also repeals the misnamed ban on "semi-automatic" weapons, which bans entire class of firearms for no conceivable reason beside the desire of demagogic politicians to appear tough on crime. Finally, my bill amends the Gun Control Act of 1968 by deleting the "sporting purposes" test, which allows the Treasury Secretary to infringe on second amendment rights by classifying a firearm (handgun, rifle, shotgun) as a "destructive device" simply because the Secretary believes the gun to be "non-sporting."

Thomas Jefferson said "The constitutions of most of our States assert that all power is inherent in the people; ...that it is their right and duty to be at all times armed." Jefferson, and all of the Founders, would be horrified by the proliferation of unconstitutional legislation that prevents law-abiding Americans from exercising their right and duty to keep and bear arms. I hope my colleagues will join me in upholding the Founders' vision for a free society by cosponsoring the Second Amendment Restoration Act.

If we get more people involved with the gun groups and working together, we can get members to actively work for the candidates. This way we can elect more Second Amendment politicians in office which gives us more Second Amendment judges. While we revoke more anti-gun laws, the courts can start ruling in our favor.

Our solution is we can work slowly in revoking the laws and at the same time, we're in a better position to get a court ruling that can restore the Second Amendment overnight.

It looks like this bill only applies to Federal laws.

However, a bill that applied to States anti-gun laws would be constitutional, IMO, and should be passed by Congress and signed by the President.

Mr. PAUL introduced the following bill; which was referred to the Committee on the Judiciary



A BILL

To restore the second amendment rights of all Americans.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Second Amendment Protection Act of 2001'.

SEC. 2. REPEAL OF FEDERAL HARASSMENT PERIOD.

Public Law 103-159 is hereby replaced, and any provisions of law amended or repealed by such Act are restored or revived as if such Act had not been
enacted.

SEC. 3. REPEAL OF UNCONSTITUTIONAL GUN BAN.

Title XI of Public Law 103-322 is hereby repealed, and any provisions of law amended or repealed by such title are restored or revived as if such title had not
been enacted.

SEC. 4. REPEAL OF UNCONSTITUTIONAL DISTINCTION.

(a) Section 201 of title 11 of Public Law 90-618 is amended by striking `which the Secretary finds is generally recognized as particularly suitable for sporting
purposes,' and `which the owner intends to use solely for sporting purposes.'

(b) Public Law 90-351, as amended, is amended as follows:

(1) In section 902, strike `which the Secretary finds is generally recognized as particularly suitable for sporting purposes,' `which the owner intends
to use solely for sporting, recreational, or cultural purposes,' `a projectile which the Secretary finds is primarily intended to be used for sporting
purposes,' `devoted to the collection, competitive use, or other sporting use of firearms in the community,' `determined by the Secretary of the
Treasury to be particularly suitable for sporting purposes and,' `(A) determined by the Secretary to be generally recognized as particularly suitable for
sporting purposes, or determined by the Department of Defense to be a type of firearm normally classified as a war souvenir, and (B),' `and is
generally recognized as particularly suitable for or readily adaptable to sporting purposes,' and `provided that such handguns are generally recognized
as particularly suitable for or readily adaptable to sporting purposes,'.

(2) Strike `lawful sporting purposes' and insert in lieu thereof `lawful purposes'.

SEC. 5. EFFECTIVE DATE.

The provisions of this Act shall take effect immediately upon enactment.

It does not repeal ALL the anti-constitution seditionist "gun control" garbage that has been passed by the prior congress, but it IS a good start.

Will it also apply to state laws as part of the federal jurisdiction on the issue?

When a man can't keep his word, he ain't worth keeping.

He's really good on border issues, but he flat out lied and ran for a fourth term after stating unequivocally that he wouldn't. Not a man of high moral character, in my opinion.

here is my letter to my maryland representative the honorable wayne t gilcrist

representative from texas, ron paul is sponsoring the second amendment protection act, hr 1762, i believe. it is sad that the "honorable" institution of the u.s. congress has made necessary this protection for an individual's right, but i expect your whole hearted support of hr1762. in affirmation of your oath to office to support and defend our constitution, and in the tradition of the founding fathers of this great nation.

i would also expect that you will stress to your fellow maryland representatives, that they too pledged to support the constitution, which includes the second amendment.

i shouldn't have to plead to retain a god-given right, nor thank you for this consideration of your sworn duty, but,

Hey, we did our part here in Colorado's 4th Cong. District by sending Marily Musgrave to the House! She's as good a person as you'll run into in politics. I told her at her victory party that seeing her elected was one of the better moments of my adult life. Sort of restored a little of my faith in the system, ya know?

My bet is that she'll co-sponsor this one in a hurry. I'll be calling on Tuesday to make sure!

States don't have the power to pass laws that infringe on the rights of the people. Someone posted the 10th amendment above.

However, these state level laws would have to be declared illegal by a circuit court. And we know what would happen in the 9th Circus.

I'm on a gun web site and only six other people admitted to calling their reps to stop the Assault Weapons Bill.

This one is too important to leave to others. It's up to us.

Also, call your gun group and make sure they're doing everything possible to stop it.
