    One hour ago, Circuit Judge George Greer denied the Request by Terri Schiavo's parents, Bob and Mary Schindler, who are trying to get Michael Schiavo removed as their daughter's guardian.

    Greer has presided over the case the longest, and the Schindlers have tried three previous times to get him off the case. They charge he favors their son-in-law.

    Circuit Judge Crockett Farnell decided yesterday no more motions can be filed in the guardianship matter until after a third judge, George Greer, rules on a disqualification request by Terri Schiavo's parents, Bob and Mary Schindler.

    Judge Greer ruling would now allow additional motions to be filed on the guardianship matter.

    Michael Schiavo has been battling his in-laws in court for years to remove his wife's feeding tube, saying she would not to be kept alive artificially. She suffered severe brain damage after collapsing in 1990.

    Doctors and Greer have ruled she has been in a persistent vegetative state since then, but her parents believe she is aware of her surroundings and could be rehabilitated.

    Schiavo Case Judge Refuses To Step Down

    CLEARWATER - Circuit Judge Douglas Baird on Thursday refused to step down as requested by Gov. Jeb Bush in the court battle over ``Terri's Law,'' which Bush signed to order a feeding tube reinserted into the abdomen of Terri Schiavo.

    In court filings Wednesday, Bush asked Baird to disqualify himself after Baird made remarks at a hearing Friday that the law intruded on Schiavo's privacy rights and was ``presumptively unconstitutional.''

    That is the argument advanced by Schiavo's husband, Michael, who is challenging Bush and the law in a case over which Baird presides.

    Michael Schiavo had won court permission to have the tube removed.

    On Wednesday, Bush's attorney in the case, Kenneth Connor, comparing Baird to a character from ``Alice In Wonderland,'' accused the judge of making a determination on the constitutionality of Terri's Law before the governor had made his case.

    Baird, in a tersely worded response Thursday, said that although he didn't contest the facts recounted in Connor's motion to disqualify him, it didn't reach the legal threshold that would require him to recuse himself. A spokeswoman from the governor's office said Bush's attorneys will assess Baird's response and respond. George Felos, Michael Schiavo's attorney, said he had planned on submitting a pleading arguing that Baird should not recuse himself. But Baird beat him to the punch.

    Court issues stay blocking husband's challenge to law

    LAKELAND, Fla. --

    An appeals court has stepped in to at least temporarily block a man's right-to-die fight with Gov. Jeb Bush over a new law restoring a feeding tube to his brain-damaged wife.

    Bush had faced a Monday deadline to justify the constitutionality of the law, but that is gone, and Michael Schiavo now must explain to the state appeals court by Tuesday why his challenge should be on a fast track.

    The 2nd District Court of Appeal issued an indefinite stay late Friday after Circuit Judge Douglas Baird lifted another stay to allow the challenge to move forward.

    Schiavo has been fighting his in-laws in court for years for the right to remove his wife Terri's feeding tube, saying she would not want to be kept alive artificially. She suffered severe brain damage in 1990 when her heart temporarily stopped, cutting off oxygen to her brain.

    Attorneys for the governor contend Michael Schiavo's lawsuit should not be allowed to move ahead until after he serves legal papers on the governor.

    "I'm not dragging my feet," Bush said after filing the appeal. "I think it's appropriate in something that is a matter of life and death that the procedures that we believe are the appropriate ones should take place."

    Bush compared his position to the "very deliberate" legal work done before any execution, saying he "wants to make sure that innocent life is protected. We go the extra mile."

    Calls for comment to Michael Schiavo's attorney Saturday was not returned.

    Pat Anderson, attorney for Terri Schiavo's parents, Bob and Mary Schindler, said her "life continues to be threatened by those forces who want to see her die from starvation and dehydration. We are once again grateful that the Gov. is doing everything in his power to protect Terri's life."

    Terri Schiavo went without water and nutrition for six days before the Legislature and Bush stepped in last month to have the tube reinserted.

    Florida courts had repeatedly affirmed the right of Michael Schiavo to remove the feeding tube.

    Flattorney - Thanks for great thread start. I must have received 50 emails from people wanting the complete Attorney Pearse’s GAL Affidavit since I/we wrote about it on another thread.

    Here is what I posted on the other Mary Jo Article thread, see what you think in this matter:

    2...Key Schindler Group people in Terri’s Case should still contact Attorney Pearse. However, he still may not help as he has other issues here, but worth the effort.     Pearse is probably not aware of the recent facts involving how Michael utilized this money. I/we, well understand the “legal loopholes” that Michael-Felos-Greer are utilizing to use Terri’s Trust money to pay legal fees. I/we/our attorney’s still think it is illegal, and a violation of the Malpractice Settlement Agreement and the responding Trust Agreement. No disrespect intended, but many FR poster’s on the Terri Schiavo Case do not understand the many extreme complexities and “backwoods” politics involved here and accordingly they reach erroneous and/or emotionally driven conclusions. Again not trying to be demeaning, this is just one of the most complex Cases, overall, I have seen in almost thirty years. This Case has broad reaching ramifications that affects the entire County, our U.S. Healthcare policies in this matter, the positions of the American Medical Association, and the positions of the Florida Department of Health.

    Florida “Powers” didn’t want this Terri Schiavo Case to spill into the National media spotlight. They tried everything possible to sweep this deal under the carpet and even Washington was involved. I am not questioning this attorney’s credibility whatsoever. I am just stating that unfortunately they are much bigger forces/currents involved here that just Terri’s Life or Death Interest. It’s a very sad fact, but nevertheless a fact. I wish some people could wake up before it’s too late.....probably 4-5 ways Terri's Case can still be lost.

    Interesting, Attorney Pearse, made a different statement in the press on this subject, just four weeks ago...of course the "trade winds" changed.

    JoeFromSydney - Ausi? I lived in Sydney 5 years in the early 90’s, loved it. Hey, Great Post! Right, Terri is not dying and medical advances are totally outstripping existing laws. Of course, the existing laws in Florida s--k anyway on this type of case, IMO.

    My/our position has been clear since Day One. Michael should give Terri to her parent, it they have the ability and financial capacity to take care of her for the rest of her natural life.

    (Note - Many FR people are forgetting that if Michael gave Terri to the Schindler’s tomorrow, no strings attached, a Judge could block it because the Schindler’s cannot pass a “Means Test” (say they are dead broke from the legal battle) and it is not cheap to keep up with Terri...Just something to think about.) (FR’s posters that beat on me here, don’t understand there are 4 - 5 ways easy to still lose this Case...some of us are not forgetting)

    I will post to this thread tomorrow in a little more detail. However, I have an associate, an MD, PhD, who has a niece that has been just like Terri, for 42 years! Like this women in the article her niece lives at home and is well taken of, seems happy for a semi-PVS, “healthy as a horse” for being semi-PVS, and has totally baffled all the medical experts in the U.S. that have reviewed her Case. Only difference between her and Terri, is that she has had therapy where she can still eat spoon feed baby food and liquified food, instead of living on a gastric tube. (Note -Terri is semi-PVS, not PVS - PERIOD per a top neurologist in the world who has reviewed her case and films for us)

    Per my associate, the docs thought this women would live maybe 15 years tops. 27 years later, her parents have never been able to come to the decision to stop feeding her and let her starve to death. As devote Christian’s they don’t believe it is even an option for them. You cannot fault them if you believe in the Scriptures. What are you going to do?

    We are getting into a whole new arena here of problems that this Terri Schiavo Case is magnifying throughout the U.S. and world. (Also see my above post on “backwoods” politics in this deal)

    For one, NOBODY really knows the number of semi-PVS/PVS people in the U.S. population. There is no census count “line item” for these severely disabled people. There is no realistic way to count them all. Many like this doctor’s niece dropped out of sight 20 years ago. My associate thinks that 60-90,000 U.S. PVS patients number being bantered around in the media, doesn’t even come close. Probably like 200-400,000 PVS’s.

    And with over 2 million deaths a year in the U.S., when a PVS dies, they just slip through the numeric and statistical cracks. Most docs think they died umpteen years ago anyway, even though they are still spiritually alive.

    Opens up your mind a little, hun..Sure does mine...Starts getting a little like a Stephen King novel...

    Terri Schiavo case in court again today

    There could be some major changes in the Terri Schiavo case today.

    Judge George Greer has scheduled a hearing to dismiss a petition from Schiavo's parents. They want to remove Terri Schiavo's husband, Michael Schiavo, as her guardian.

    The hearing is scheduled for 2:30 p.m.

    This is a different guardian issue than the one ordered by the new "Terri's Law."

    Terri Schiavo is the Pinellas woman who has been in what some doctors call a persistent vegetative state since 1990.

    Excellent, I/we definitely felt better after the hearing late Friday. I liked Felos “crying around” comments in the print media over some of Judge’s Demer’s rulings. But you got to admit the man is eloquent in this speech:

    I am not real good with all that fancy English – but I think what George is saying is, 1) that his National Right-To-Die Test Case is starting to unravel, 2) he has already blow all of Terri’s Medical Trust money (we got some docs here you are going to love!), 3) and Felos is realizing he has NO plan C. That is what this “country boy” thinks he said in that above noted press “ACLU smoke signal”.

    I/we have dealt with Felos types before. Felos & Co. plays VERY dirty, using passive-aggressive “slant” approaches. Felos & Co. likes to hide behind books, loop-holes in the Laws, and “Judge’s robes”. But he/they will fold in a second if taken straight on; with the hard NO BS FACTS (dump all this other stuff!); you don't stop the pressure; and you “draw him out into the street” with your “line” of legal offense. Works every time!

    Felos is already rattled, making uncharacteristic mistakes, and totally blew it letting Michael "out of his cage" to do Larry King Live. I wish many FR posters that blasted Larry over that “power puff” interview, (and I will not state publically what else transpired post-show which was ridiculous) could understand how well Mr. Larry "came out of the hard streets of Miami, with a PhD in hard-knocks, and a grand-larceny arrest record) King set Michael up in that interview. King is a "street pro" and it was beautiful!

    Michael never knew what hit him. The interview did WONDERS for the Terri’s Right-To-Life Movement and the media finally starting to “open up their eyes” on this case.

    Harv...Thank you for PM. My comments were written Friday evening after the Hearing late Friday afternoon. No court record Ms. Quartetti was accepted “on entry” by the Judge, which is what I was looking at when I made this statement. I don’t even know who she is. Cannot find her on Court approved GAL list either? Probably my mistake on both counts. Don’t know, but it is not important at this juncture. Let’s just say everything is fine and the Schindler’s did nominate someone for GAL, although I have a technical problem here with this statement. Sorry for the initial mis-post and all the confusion...Ed
