  • SCOTUS ruling shows how far gun rights have come

Topping last week's legal stories was the Supreme Court's decision in McDonald v. Chicago, holding that the Second Amendment -- which the Supreme Court just two years ago interpreted to protect an individual right to own a gun -- also protects the individual right to own a gun against state and local interference. Many people were unimpressed, regarding this as a statement of the obvious. Others -- like Rush Limbaugh -- were alarmed, noting that what should have been an obvious statement of a right specifically protected in the Constitution nonetheless made it by a bare 5-4 vote in the...

Not once in the history of man has the government ever successfully "stimulated" the economy. Not once has the state ever "rescued" the economy or "made it grow." If the government could genuinely perform such financial magic -- successfully printing money, or conjuring wealth from the clear blue sky, etc. -- wouldn't it do it all of the time, and at a much higher level? In the history of the world, all that government intervention in production and trade has ever done is make various economic actors -- both labor and management -- behave in ways that they don't want...
  • Discussion on the intent of the Commerce Clause

Senator Diane Feinstein (D-Calif.) said that Congress has the authority to mandate that people buy health insurance and that there is no constitutional limit on Congress’ power to enact such mandates, adding that this unlimited authority stemmed from the Commerce clause of the Constitution. And apparently 59 other Democrat senators agree with her. It is my understanding that the intent of the commerce clause is to assign the responsibility of regulating commerce (the transportation and trading of goods with foreign Nations, and among the several States, and with the Indian Tribes) to the central government, taking the law-making responsibility for...

Self-Evident Truths: Sen. Dianne Feinstein says it comes under the Commerce Clause. Rep. Steny Hoyer says it's mandated by the "general welfare" clause. Despite liberal wishes, health care is not a right. The "living Constitution" that Democrats and their court appointees have given us may be the death of our freedoms. Their constitution adapts to the times and serves the whims of the elitists. The Constitution is supposed to limit government powers. It does not allow government to do anything it feels like doing. Cass Sunstein, the head of the Office of Information and Regulatory Affairs, is the author of...

Forward: I wrote this article some time ago. A few days ago Oklahoma passed a resolution declaring its sovereignty. While I haven’t read House Concurrent Resolution 1028 according to news reports this was the second attempt, the first being vetoed by Gov. Brad Henry. According to one news report: “HCR 1028, which, if passed, would be sent to Democratic President Barack Obama and the Democratic-controlled Congress, would not jeopardize federal funds but would tell Congress to "get back into their proper constitutional role.” The resolution states the federal government should "cease and desist” mandates that are beyond the scope of...

Today's G-20 economic summit conference in London is virtually guarenteed to be a ghastly pro-Big Government orgy -- a veritable Lolapalooza for Leviathan. Barry Goldwater and Ronald Reagan -- not to mention John Locke and Adam Smith -- are going to be spinning in their graves. Nothing is more certain than that this tour de force of politico-economic stupidity and depravity is going to come out four-square against true free enterprize, capitalism, and laissez-faire. Sadly and almost incomprehensibly, the great conclusion of today's deepest thinkers (sic) is that the "Anglo-Saxon" version of political and economic liberty has proven to be...

Understanding how the Constitution was based on the Declaration of Independence provides the knowledge needed to defend our God-given rights. Would any reasonably prudent businessman sign a proposed contract involving a large-scale venture to be conducted over many years, if the other party admitted that most of the contract's terms were undefined, that some terms were so vague as to be undefinable, and that in the future he intended to interpret all of the contract's provisions in whatever matter might suit his own purposes at that time? Obviously not. Yet this is precisely the theory of "the living Constitution" that...

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. - Second Amendment to the U. S. ConstitutionThe aftermath of the Supreme Court’s historic affirmation of an individual’s right to bear arms illustrates the philosophical divide between the Left and Right, Conservative and Liberal. Liberals believe that rights emanate from the government while conservatives hold that the individual has inherent rights. When the Founding Fathers established America’s representative democracy the world was just beginning to emerge from the feudal and monarchic traditions that...

A recent editorial in the Arizona Daily Star takes the view that payday loans should be outlawed in Arizona, as scheduled, in 2010. Payday loans are very small loans that accept future paychecks as collateral and charge high fees and rates of interest. . While I agree with the Star that it's not good for people to be using payday loans on a regular basis, I think the choice should be left to individuals, not government. Generally, it's a bad idea to finance a business startup with credit cards. But I know a millionaire who did exactly that to get...

Barak Obama touts one form of Socialism after another and has the nerve to call it change. Hillary, already known for being a Socialist as well as a bald faced liar is simply annoyed that her chances of making the grade are slipping away. In all her campaign contributions, she has yet to garner enough money to give back the silverware she ripped off when she was in the White House. This is the Democrat’s idea of change. It’s time to face reality. What is really the Republican’s idea of change? The hand wringing over the lack of a genuine...

The time has come for America to make a choice. The arch enemy of Socialism is Individual Rights. The 08 election has become a referendum that will determine which path America will take. As the primary issues are presented IE immigration, economy or the wars that are currently taking place, everyone wants to discuss the stance each candidate will take. The media will parse the words and regurgitate them in light of “how” the candidate has either voted or expressed himself on related issues. They might draw a line indicating that on “XYZ” issue the candidate is conservative or liberal...

Please vote this gun issue question with USA Today. It will only take a few seconds of your time. Then pass the link on to all the pro gun folks you know. Hopefully these results will be published later this month. This upcoming year will become critical for gun owners with the Supreme Court accepting the District of Columbia case against the right for individuals to bear arms. First - vote on this one. Second - launch it to all the pro-gun folks and have THEM vote - then we will see if the results get published. To vote in...

The mayor of the nation's capital says he's "deeply disappointed" and "outraged" by an appeals court decision today striking down a long-standing Washington, D-C law against owning handguns. The court rejected the city's argument that the Second Amendment right to bear arms applies only to militias. Mayor Adrian Fenty says the decision "flies in the face of laws that have helped decrease gun violence" in the city. He says the city will appeal -- and that in the meantime, the law will be enforced. The handgun ban went into effect in 1976.

I'm a renter. Shoot me, OK. Or, if you can't do that, at the very least take away my 4th Amendment rights. Or, whatever is left of them. In Baltimore County, Maryland, where I live, the county government has the right to come in and inspect my house as part of a "landord registration" law that includes a "rental unit inspection" process. The inspection was shoved through the local duma (Baltimore County Council) by one Vincent Gardenia, D., former Sierra Club official it says on his bio. He might also boast that his is the office that hung up on...

Murakami Yoshiaki (that's my son's name, too...but no doubt the characters are different) faces a possible three years in prison and a fine of up to $30,000 - small change when you consider the billions he has made. Murakami is a corporate raider in a land where business is done by consensus. In the end, he admitted to inadvertently "breaking the law" by buying shares after he had "heard" that a company might be the target of a hostile takeover. Normally, this is called insider trading. But the Japanese also have a way of not saying things directly. It causes...
  • Illegal in Arkansas to Smoke in a Vehicle With A Minor? (What was that about a free country?)

I heard today as I was getting ready to leave work that as of today, it is illegal in the state of Arkansas to smoke in a private vehicle with a minor or on the premises of any business establishment frequented by minors. Does anybody have any more detailed information on this? If true, this is an outrage! Not unexpected, but an outrage nevertheless. Before we know it, we will have to have prior government approval to use a public restroom.

Calabasas makes it illegal to light up in public spaces, with fines up to $500. Some residents breathe easier, but others just fume. As a pioneering public smoking ban went into effect Friday in Calabasas, enforcement came from a higher authority: Mother Nature. A pouring rainstorm snuffed out renegade smokers' cigarettes and sent them scurrying for cover as security guards began issuing warnings at the town's main shopping center. Calabasas, an upscale suburb perched on the western edge of the San Fernando Valley, was generating international attention for what appears to be the nation's first ban on smoking in all...
