A federal judge has ruled that they way in which Birmingham police uses pepper spray "to enforce basic school discipline" is unconstitutional.The court found that police used excessive force in reaching for the chemical spray to "deal with 'normal -- and at times, challenging -- adolescent behavior.'"The ruling does not keep police officers from using pepper spray in violent situations like a fight. The Saratoga Springs Police Officer who pepper sprayed a man that gave him the middle finger has been suspended without pay. The chief of police now says he's seeking to fire the officer. A Seattle history teacher who was pepper sprayed during a peaceful Martin Luther King Day Jr. rally is suing the cops who allegedly attacked him. Newly released video showed a Seattle police officer pepper spraying Jesse Hagopian as he walked home from the Jan. 19 rally, his lawyer said. Hagopian, who teaches history at Seattle's Garfield High School, spoke at the event and was on the phone with his mom when the spray hit his eyes. CHICAGO (CBS) – Chicago police detectives are trying to determine if four people charged with the robbery Monday of a cell phone store in the north side Edgewater neighborhood are responsible for any similar stickups. Nothing seemed amiss at first when two women walked into the Bestcom Wireless store at 6147 N. Broadway at about 5 p.m. Monday and began discussing the pros and cons of various cell phones and phone packages with the store’s manager. A sheriff's deputy in Orange County will be arraigned Monday for allegedly pepper-spraying a teenager's pizza during a traffic stop. The teen, authorities said, and a group of friends later became sick after eating the pepper-spray tainted pizza. Authorities charged Juan Tavera, 30, with one misdemeanor count of assault or battery by a public officer.
