Virginia is still deciding whether to ratify the ERA. The ERA would put in the U.S. Constitution a guarantee that “Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.” The proposed amendment was never added because it was not ratified by the requisite 38 states.
