Please tell me what the man is doing at the 4-5 second mark of the video (just before the girl pushes him)?
He is protecting his family

The first thing he does in the video is to yell, “break it up”. The point is I think he was getting involved in something that had nothing to do with him or his family. And because he was with his family that was not the time to intervene in someone else’s battle and consequently put your family in harm’s way. He was either leaving or entering the mall. Should have just continued on his way.
You watched it, you tell me. And then tell me what happened 1 minute prior to the video being turned on? I don't know, and neither do you.

Agree, in general. Know a lot of great people in Asheville— people of faith and principle. Mtn. people who do not take crap. Some might intercede in some “flash gang” event. Agree, the better part of valor would be to surround his family with his arms, and walk them away. We just don’t know the chain of events. Asheville is a much more traditional medium size city , and the “folks” involved seriously in the minority, speaking frankly. Anyone in Atlanta would know better.

I think he was either coming or going from the mall with his family and decided to intervene in someone else’s beef. I say this because at the beginning of the video he yells ‘break it up’. Then, at the 4-6 second mark, HE IS THE FIRST ONE to lay hands on someone (probably the girl who them pushed him) when he spins someone out of the way, seemingly to confront someone else who I’m guessing yelled a profanity at him.
The whole premise of everyone attacking the girls was that they struck first. And you did it based only on the video. Will you now say the same things about him since he was the first one to assault someone in the vdeio?
There used to be a time in the U.S. when it was a much better place and a more united country, when an adult told young folk to stop something, like brawling in public, they generally did what they were told.
Now adults are apparently supposed to cower when it comes to feral kids. What if some kid was getting their brains kick in and was outnumbered? Is it better to just keep walking and mind your own biz?

As yet the news station can't ascertain what happened and is asking for witnesses and the person who shot the video.
What I see is a man surround by teenage girls yelling and taunting him. How he got in the situation is not known and at this point only speculation. More information is needed.
I also see a young girl walk up to him twice.
Did he feel threatened? Did he feel his family was threatened? Did he respond appropriately to the level of threat?
Again, we don't know. We weren't there. All we have is 29 seconds of video.

I’d bet the rent there is more video from those who were watching the alleged fight.
The off duty police officer should have confronted the girls if they were causing a disturbance.
Yep, it appears as though he pushed someone out of the way. But I have no idea what happened in the seconds prior and neither do you. See simple!

Well I will go ahead and tell the whole story.
I was taking my date to watch an Asheville Toursts baseball game. Cheap date as the admission was only 50 cents. This was around 50 years ago.
I was drving down a side road turning onto Charlotte Road when a White Pontiac convertible containing 8 Youths of the African race pulled in front of me and blocking me in.
We were in a little English Ford with the windows down which is typically the only cooling you need in Asheville during the Summer.
They all piled out of the convertible and one yelled “Chicken Shit” as they headed toward me. I immediately reached down for the Browning which was being carried illegally at the time. One of them noticed and said “He has a gun” and they all piled right back in and sped off.
I had no connections to them in any way. Never even seen them before.
I later worked with a Black Federal Agent and asked him what had made them go after me. He said most likely they had a run in with some other guys and were just looking for another White group to take it out on. He said I certainly saved us from a beating.
I also did a couple of things wrong. I should have hit the door lock first then rolled up the window then gone for the gun. What ever it did work. My date said if I had not had that gun we would have been in real trouble.
The State of North Carolina tried to prevent my saving myself but my life is mine to save no matter what the state says.

Note that you only had the video to go by when you attacked the girl because she supposedly struck first. Now that we see that wasn’t true and he was the first to assault someone, in the same video you used to attack the girl, you change the narrative.
That’s my best effort to open your eyes. I can you see you like to play in the mud and not admit when you err. Have fun now playing with yourself.
Btw, even if he told these allegedly violent people who were fighting in public, to knock it off, that isn’t a crime. In fact it’s probably the adult thing to do. But the young have everyone afraid, right bramps?

Actually, from the LiveLeak video, she shoves him in the back at about the 6s mark. He pushes her away, hard. She comes at him threateningly, and he take her out with the left hook.
And the whole time, there’s a whole pack of others screaming, some acting threateningly.
It’s a tough one all the way around.
The real question legally seems to be Was the girl under 12. I know he is charged with that, but someone claiming to be her cousin says she’s 13. Apparently this matters under NC law.
