Like most Americans, I was initially shocked at the decision announced by the Obama administration to prosecute Khalid Sheikh Mohammed (KSD) and other Guantanamo Bay Naval Base detainees in New York under civilian law. I was shocked by the prima facie stupidity of the decision to unnecessarily avail terrorists with the full rights, legal processes and courtroom procedures due an American citizen. I love America, and I want what’s best for her. But, when one hates the traditional American way of life, this decision is a masterstroke.


To cripple and ultimately destroy a stronger or entrenched adversary, invest in tactics whose deployment costs little, but your foe must spend far more to purchase an effective defense.
Moving the terrorists to New York will require millions simply to provide for years of their physical security. The trial process will require tens of millions more - per month: Will the courtroom and court building be hardened physically? How far around the court will the security zone extend, and how many layers of security will there be? Will the jury be sequestered? Will their families be protected, and for how long? Soft costs include: traffic closures during each detainee and witness movement, the productivity loss of family and friends reliving 911 during the months of trial, etc. These costs must be borne during the year(s) of the trial and the years of the appeals processes. These trial and appeals processes cost Al-Qaeda literally nothing, and they will ultimately cost America hundreds of millions of dollars.


Force your foe to reveal the sources and methods of their intelligence gathering, as this immediately compromises the intelligence gathering assets themselves, thereby weakening the intelligence organizations. Furthermore, intelligence agency revelations provide Al-Qaeda agents, handlers, trainers and organization with an actual itemized list of do’s and don’ts to avoid detection and survive interrogation.
KSD simply needs to demand the right to confront his accusers, i.e. the agents who interrogated and processed him: “Please state your name for the record.” “Tell the jury the exact protocol for all methods of ‘enhanced interrogation.’ ” “List all agents and the agencies of those agents who were involved during the entire interrogation and custody process of the accused.” During the trial of KSD, our agents, our techniques and our ally’s agents will become known and thus ineffective, i.e. we give our playbook to the other side.


Employ these tactics in front of a wide audience in order to: reveal your foe’s weakness, what will happen to each of your foe’s potential allies, how Al-Qaeda now drives international events, and, ultimately, advance Al-Qaeda’s financial and recruiting efforts.
Who doubts the acclaim and cheers that KSD and his fellows will receive as they humiliate the Great Satan via world-wide simulcast day after day from the very belly of the beast? Donations and Jihadists flock to the organization that leads the humiliation of the Great Satan bringing power to that organization’s leaders. Furthermore, will members of the US military receive increased local support as they crawl in the dust of Afghanistan trying to avoid IEDs while Al Jezzerra shows KSD grandstanding everyday in New York?


In the eyes of an administration that advanced the idea of prosecuting CIA agents, an administration that surrounds itself with and assimilates the vanguard of the most radical elements of unAmerican society, the decision to force America to pay terrorists to stage a Ground Zero Théâtre de l'Absurde revealing and betraying America’s agents and allies in the War On Terror while advancing militant Islamic organizational goals must appear brilliant.

Best case? DOJ will decline to press charges, KSM and cohorts will be deported back to their countries of origin.

Worst case?

If I were in charge of the military side of the information flow, I would not do anything to jeopardize sources, operations, personnel, strategy or tactics. If that means the defendants walk, so be it. The larger issue is the war itself - which will go on long after Obamao is relegated to the ash heap of history.

This is act one of a Shakespearian play. Obama the king, endowed with far more vanity than wisdom, thrust into the role of king by an adoring nation that had hope rather than scrutiny.

This will end in tragedy for the king and end his rule. Hubris, the fatal flaw of the king is his undoing. The ultimate victor will be Al Queada the loser the American people. A tragedy. This will end badly when Al Queada seizes an American school, ala Beslan, and holds the entire nation hostage and in horror.

A tragedy that can and should be avoided. A tragedy that will forever change America. Obama will hand victory to Al Queada at the cost of his presidency.

What is the upside for Obama? Or is Paul Osborne arguing that Obama's entered a political suicide pact. He uses his time as President to do everything he can to weaken and damage this country? Or is he weakening and damaging the country to the extent he can get away with it?

Isn't this an extremely risky political strategy? He's already lost 25 points in popularity. He's created a 30-40% swing against himself and his allies (NJ, VA) in the Democrat leaning suburbs. He's driving independents away from himself and the Democrats in droves.

Who's going to go along with him for much longer? Obama's already had 54 Democrat Senators vote against cutting off spending to bring al Qaeda terrorists to the US for trial. That vote is poison for each of those Senators. Democrats are in bed with ACORN, that is now poison.

Obama is turning himself into political poison. Among Republicans, that is already the case. Ask Gov. Crist in Florida, who's lost 30% points against a far lesser known competitor and can lose the primary.

Why is Obama doing this? And who's going to gone down with the ship the SS Obama?

This is EXACTLY what I mean. Where did you get the evidence for these charges? Who was involved? He has a right to face his accusers, so let's have some names. How was this evidence obtained? Who was involved in obtaining this information? Do you have a Search Warrant for all of these monitored phone calls? Are you going to press charges against everyone involved in obtaining these phone taps? Who are your sources in Iraq and Al Quaeda? What is their name, and address? I want an affidavit from each of them, in person. Furthermore, how did you obtain their confessions? Were they water-boarded too? Where are they presently located and where have they been kept?

Remember how eager our newspapers are to tell the enemy how we get information? Obama essentially gave a fellow Muslim a presidential pardon, and has gutted our intelligence gathering ability with a single stroke.
