Cruz joins in Red River property dispute

This week, U.S. Sen. Ted Cruz joined an amicus brief on behalf of 22 members of the Texas congressional delegation in support of private landowners along the Red River.

The Bureau of Land Management has recently made waves by claiming thousands of acres of privately owned Texas land along the Red River. It has done so by utilizing — in apparent violation of a nearly 100-year-old Supreme Court precedent and tradition — an arbitrary and bizarre gradient boundary survey method that has adversely impacted private landowners.

Sen. John Cornyn (R-Texas) and Rep. Mac Thornberry (R-Texas) joined Cruz in the brief along with Republican Texas U.S. Reps. Kevin Brady, Michael Burgess, John Carter, Mike Conaway, John Culberson, Blake Farenthold, Bill Flores, Louie Gohmert, Kay Granger, Jeb Hensarling, Sam Johnson, Kenny Marchant, Michael McCaul, Randy Neugebauer, Ted Poe, John Ratcliffe, Pete Sessions, Randy Weber, and Roger Williams. The case is Aderholt v. BLM, Civ. Act. No. 7:15-cv-00162-O (N.D. Tex.).

In June 2014, Sen. Cruz, with Sen. Cornyn and Rep. Thornberry, introduced the Red River Private Property Protection Act to address this issue and direct the BLM to transfer any land in Texas along the Red River to landowners who can prove through official records that they own the land outright.

WASHINGTON — Twenty-two members of Texas’ congressional delegation filed an amicus brief Wednesday afternoon supporting landowners in a lawsuit against the federal government over disputed property along the Red River.

U.S. Rep. Mac Thornberry, R-Clarendon, filed the brief, joined by Sens. John Cornyn and Ted Cruz and 19 other U.S. House members. The brief argues that the Bureau of Land Management, which is trying to claim the 116-mile stretch of land along the Texas-Oklahoma border, “overstepped its legal authorities” by using contested survey results to declare the land for public use.

A group of local landowners sued BLM last year, arguing that they have paid taxes on the land and it is their personal property. The agency has countered that a 1923 U.S. Supreme Court ruling says the land between the state boundary belongs to the federal government.

Thornberry, who introduced a bill in the U.S. House last year to try to resolve the dispute, said the lawsuit was another front “in this fight against the federal government’s land grab along the Red River.”

“Until there is a fair resolution in this matter, we will not let up in our efforts to assure landowners that their private property rights will be protected. This legal brief makes it clear that BLM has exceeded its authority under the law,” Thornberry said in a prepared statement.

Thornberry’s bill, which would have barred the BLM from implementing a resource management plan until the Texas General Land Office resurveyed the area, passed 253-177, but the White House vowed to veto the legislation if it crossed the president’s desk. Cornyn proposed a similar bill in the Senate, which stalled.

Rep. Roger Williams, R-Austin, who also signed on to the brief, said the agency’s claim violated landowners’ rights.

“The right to private ownership is a core foundation on which this nation was built, but today the federal government is trying to change the rules to strip Texans of what is rightfully theirs,” Williams said in a statement.

Major players in Texas have lined up to support landowners in the dispute. The General Land Office successfully joined the lawsuit last year, and a U.S. District Court allowed Texas to join the lawsuit as well earlier this month.

I will send a postcard in your place. I won’t vote for anyone other than Trump. Hillary’s voting record as Senator was as Republican party as one can get on many issues. She supported the Iraq invasion and the Libyan adventure same as McCain and Rubio did. Etc etc. The GOP without Trump is just a the other side of teh same uni-arty coin.

I’m not sure on the factual details as it’s been sometime since I’ve explored this. But I
belived it’s a many years old situation regarding property lines along the Red River. The
local property owners are disputing the line between the River and their land in fee.

I suppose the BLM is claiming land between the flow of the Red River and the vegetation line, west of the 98th meridian and the north fork of the Red River.

BLM should be disbanded.

It has no reason to exist, once its lands have been redistributed back to the states, and preferably, privatized.

Per the BLM link, It is extremely complex

One wonders how large the actual parcels are that make up the total 46,000 (90,000) acres apparently involved

I guess it matters most where oil is involved

Hillary’s voting record as Senator was as Republican party as one can get on many issues.

She will stack the Supreme Court with left wing justices. This must NOT happen. By not supporting the eventual Republican candidate, you will be helping Clinton succeed.

We are not sure why Roberts ruled the way he did, but we are 100 % sure Hillary will pick the absolutely worse SCOTUS nominee's in the country...

So am I to assume you plan to vote for Hillary if Cruz gets the nomination...

I mean whoever Hillary picks and Roberts will be two peas in a pod...right ?
