WASHINGTON Twenty-two members of Texas congressional delegation filed an amicus brief Wednesday afternoon supporting landowners in a lawsuit against the federal government over disputed property along the Red River.
U.S. Rep. Mac Thornberry, R-Clarendon, filed the brief, joined by Sens. John Cornyn and Ted Cruz and 19 other U.S. House members. The brief argues that the Bureau of Land Management, which is trying to claim the 116-mile stretch of land along the Texas-Oklahoma border, overstepped its legal authorities by using contested survey results to declare the land for public use.
A group of local landowners sued BLM last year, arguing that they have paid taxes on the land and it is their personal property. The agency has countered that a 1923 U.S. Supreme Court ruling says the land between the state boundary belongs to the federal government.
Thornberry, who introduced a bill in the U.S. House last year to try to resolve the dispute, said the lawsuit was another front in this fight against the federal governments land grab along the Red River.
Until there is a fair resolution in this matter, we will not let up in our efforts to assure landowners that their private property rights will be protected. This legal brief makes it clear that BLM has exceeded its authority under the law, Thornberry said in a prepared statement.
Thornberrys bill, which would have barred the BLM from implementing a resource management plan until the Texas General Land Office resurveyed the area, passed 253-177, but the White House vowed to veto the legislation if it crossed the presidents desk. Cornyn proposed a similar bill in the Senate, which stalled.
Rep. Roger Williams, R-Austin, who also signed on to the brief, said the agencys claim violated landowners rights.
The right to private ownership is a core foundation on which this nation was built, but today the federal government is trying to change the rules to strip Texans of what is rightfully theirs, Williams said in a statement.
Major players in Texas have lined up to support landowners in the dispute. The General Land Office successfully joined the lawsuit last year, and a U.S. District Court allowed Texas to join the lawsuit as well earlier this month.

I’m not sure on the factual details as it’s been sometime since I’ve explored this. But I
belived it’s a many years old situation regarding property lines along the Red River. The
local property owners are disputing the line between the River and their land in fee.

I suppose the BLM is claiming land between the flow of the Red River and the vegetation line, west of the 98th meridian and the north fork of the Red River.
BLM should be disbanded.
