DIFFERENCE BETWEEN GORSUCH AND KAVANNAUGH

I have an observation and a question. I don't remember the dims or anyone else having such a cow over Gorsuch. What is the deal with Kavannaugh? Just curious.

Gorsuch replaced Scalia.

Kavanaugh is replacing the squishy centrist Kennedy.

Kennedy used to be the “swing vote”. If Kavanaugh is confirmed, Roberts will become the “swing vote. Roberts, although compromised, is much more of a constitutionalist than Kennedy ever dreamed of being.

You are correct. The people claiming the difference between Gorsuch and Kavanaugh is that the latter moves the court to the right are only partially correct.

This is PAYBACK for Kavanaugh working for Ken Starr on the impeachment of Bill Clinton. Also a 5-4 conservative court.

If Ruth Buzzi Ginsberg croaks in the next year or so, it will be an outright scream fest beyond what we have seen because the court will be 6-3 conservative.

Didn’t see it in the thread: Kavanaugh was publicized in 2012 by CNN as a Romney USSC pick and Dems had the smears ready. If Clement had been the nominee, something like this would have exploded because CNN named him back then too.

The other reason is that if the Democrats lose potentially 5-7 seats in the Senate in the mid-term elections, the makeup of the Judiciary Committee when Ginsburg vacates will be 12-9 instead of the current 11-10.

They're fighting hard right now because they will have smaller ranks on the committee for the next confirmation.

I would question whether the Democrats have assumed losses in the Senate this year . . . but the reality is that half the entire Senate Democrat Caucus - 25 senators - is up for reelection, and not only is it likely that they will lose some, the Republicans seriously need to win some. Not merely to gain a more effective majority now, but to even hold the majority at all in 2020 and 2022 (when they will be defending more seats than the Democrats will be defending - not fewer).

Agreed, though I think it was more than just wanting Mrs. Bill to name her replacement. I don’t think RBG had any respect for Zero. His actions and demeanor were too much for even her. She didn’t want him to name her replacement, and took her chances.

One of the downsides to Trump having provided a list of potential SC nominees is that it gave the Dems a lot of lead time for opposition research.
. . . which did the Dems a fat lot of good because of their overconfidence in ‘16. I was seriously worried at the time when Trump expanded his list, because it provided more potential targets for the Democrats. All it took could have been one “if you vote for Trump _____ will be on the Court - and he didn’t pay his taxes in 1990”.

The more people on the list, the more embarrassing it should be now to the Democrats to not have been able to find one thing to complain about in ’16. Thing is, tho - nominating Kavanaugh, tho apparently a fine thing, actually “breaks” a campaign promise in the sense that Trump added him to the list after the election.

Anyone on that list before the election, OTOH, could claim to have been “elected” with Trump. And would theoretically be harder to oppose on that account.

It's a conservative majority only if Roberts shows some reliability. If he can be blackmailed, then his last name may as well be Kennedy.
Post #68 finally hints at the real effect of "replacing Kennedy with Kavenaugh.”

Namely, that Roberts will be the swing vote on the court.

That’s why I put the sentence above in scare quotes: de facto, Roberts is replacing Kennedy. We hope.

Exactly. And replacement of another, outright liberal, justice would mean that even Roberts wouldn’t be the swing vote.

I agree on all points, except that the leftists will always be virulent...always...

whether it seems that they expended all of their ammo on this hill or not, I can guarantee you they will be violent with the eventual replacement of RBG, as long as DJT is president.

The Kavanaugh confirmation has been an absolute shitshow. The “replacement for Ginsburg” confirmation will make this present madness look tame. The communists in the mainstream of the democrat party tried to assassinate Judge Kavanaugh’s character. I believe they will attempt a literal assassination, next time.
