DIFFERENCE BETWEEN GORSUCH AND KAVANNAUGH

I have an observation and a question. I don't remember the dims or anyone else having such a cow over Gorsuch. What is the deal with Kavannaugh? Just curious.

This was my liberal friend’s argument: the allegations are not politically motivated and Kavanaugh is probably guilty, because the same things weren’t said about Gorsuch.

The Kavanaugh confirmation is HUGE for a number of reasons, but I believe the one case coming down that has Democrats terrified is Alabama V. United States Dept of Commerce


In this case Alabama is suing the Census Bureau because it's Residence Rule includes illegal immigrants, which means 1) illegal immigrants are considered as part of the population for apportionment of Congressional seats, and 2) Alabama is projected to lose one of it's Congressional seats.

The suit is arguing that including illegals in apportionment calculations goes against section 2 of the 14th Amendment, because it does not give equal consideration to voters. For example, the number of voters in a congressional district in a low illegal immigrant state is around 550,000 but in a state with a high number of illegal immigrants the average number of voters in a Congressional district is 450,000. The vote of voters in low illegal immigrant states is diluted by illegals being considered in the population for apportionment.

If Alabama wins this case, then 20-30 Congressional seats may shift from states with high numbers of illegal immigrants to states with lower numbers of illegal immigrants. California may lose 5 seats by itself.

Expect the Democrats to put up a HUGE fight on the Citizenship question being on the Census. If they have it removed, the courts will likely throw the case out, because without it there is no legal remedy. If there is no way to exclude illegal immigrants, then there is nothing the court can do.

Gorsuch was nominated in early 2017. The Democrats couldn’t turn it into a midterm election campaign spectacle because it was more than a year and a half before the elections.

Tell your liberal friend the reason is that Gorsuch was not mentioned in The New Yorker article that set in motion Ford's attack on Kavanaugh. This article came out just prior to Ford counseling session when she first remembered Kavanaugh attacking her.

Gorsuch replaced Scalia, and you could not get more right wing so nothing changed. Kav replaces Kennedy who was liberal on social issues. Now it’s a harder right turn. Also Kav is a thought leader, so a Stalinist execution of a Kulak was warranted.

Wait till RBG gets replaced - WW3.

One of the downsides to Trump having provided a list of potential SC nominees is that it gave the Dems a lot of lead time for opposition research.

After Kavanaugh, that strategy may need to be revised.

It’s mostly the “Kennedy as swing/left vote” issue, and the threat he poses to feminists on the abortion issue. Then there is the ascendency of the metoo! movement. But don’t forget that Kavenaugh worked for Ken Starr on the Whitewater and Bill Clinton sex/perjury/graft/Vince Foster investigations. The Clinton cult never stops punishing their foes.

It's a conservative majority only if Roberts shows some reliability. If he can be blackmailed, then his last name may as well be Kennedy.

Not only does Kavanaugh become a new conservative Justice, the Rats and their affiliated leftist media saw this as an opportunity to whip up voter frenzy for the midterms. Media makes lots of money spinning these types of smear campaigns.

This whole fight is because the Left is terrified about a return to the model designed by the Founders, which is three co-equal branches of government, each with specific powers/responsibilities/limitations.

Laws are supposed to be created/proposed in the Legislative branch, which is responsible to the voters who put them into office but in the last 50+ years, Congress has sold themselves to the highest bidder through lobbyists (whose numbers exploded in the 1970s)and they no longer actually write or pass laws - certainly not the way the Constitution designed.

What this has meant is that most of our “legislation” now comes through Executive Orders, which everyone loves when “their” side is in the White House and hates when the “other” side does it...again, NOT how the Founders designed it!

Or, some city, state, bureaucracy enacts a law/rule at the local level and the voters squawk and then someone sues and it works its way up the legal chain until it arrives at the Supreme Court, who suddenly finds themselves in the middle of a fight that should never have reached them in the first place and they pronounce a Yay or Nay for the whole country.

There is a method for Amending the Constitution but it doesn’t get used very often because it involves actually convincing a majority of the voters to go along with your idea...the Left does NOT like that plan so they have increasing turned to the Courts to force through Legislation they cannot get at the ballot box!

And that is really what this whole fight is about!

Look to Kavanaugh’s testimony. He pointed directly at the Clintons as being the perpetrators of the smear campaign against him. If you know Kavanaugh’s job history, you know that he was front and center in Ken Star’s independent counsel investigation of Bill Clinton. IMHO this fact is precisely why the dems tried to destroy him. Pretty ugly stuff.

Leftists have a stupid idea that they control the courts and who gets on them. Even when they are not in power.

They scream about power-sharing and having a court that can opt to go leftist is what they are screaming about.

However, they lost. And conservatives have an opportunity here to pack the courts and remake 60 years of horrible law.

I think Kavanaugh on the USSC might mean more than just changing the balance of power;and I’d say that’s just what’s needed. Also,the Dems might now be concerned about a little vengeance wreaked on them because of how they treated the man. I don’t know that he would do that,but I sure wouldn’t hold him back if he could do it legally.

They don’t care about the Supreme Court or the rule of law. They’re in slash and burn mode already.

Never forget the loud screaming demonstrations in the Senate Chambers by the paid for protesters. That is what you will see from here on out.

Kennedy voted conservative 70% of the time. A somewhat conservative swing vote gone.

The real battle will be replacing rbg. I think Amy will be up to it though.

The difference is that Gorsuch only replaced a conservative, not a flip-flop voter like Kennedy. Kavanaugh is an originalist and will vote the way the Constitution was intended, and the democrats cannot have that.

The only reason is Gorsuch didn’t throw the balance of the court..

If Kavanaugh had been put up instead of Gorsuch, and now it was Gorsuch instead of Kavanaugh being confirmed, it would be the exact same fiasco....

This has NOTHING to do with Kavanaugh as a person.. it has to do with the balance of the court.

Understand, the left has advanced its insane agenda largely through the courts, not the ballot box... Once the Supreme Court returns to a majority of constitutionalist and constructionalists, not only does their agenda stop... it starts to be peeled back....
