Actually none as long as the Senate confirms you. Ocasio-Cortez could be appointed ( God forbid ) if the Dems had the Presidency and the Senate.

Napolitano told friends he was on Trump's Supreme Court shortlist

I seem to recall that when the Gorsuch nomination came in, he [said] he was an advisor to the President in selecting Gorsuch.

Since then, however, he has made a sharp turn to the left and seems to be a "never-Trumper". I think he felt jilted when he was asked to leave any advisory role. And, as someone else on this thread mentioned, he really changed after he was suspended by Faux Snooze!

Nothing the left does is borne of honor and integrity. If things they spout, like “Trump colluded with Russia”, was due to their honestly believing it, I could dismiss it as them having been fooled. However, we are not dealing with ordinary honorable folks here, who are simply “mistaken”. They intentionally mislead.

I wish Rush would stop saying, “They really believe that Trump colluded with Russia”. They do not. They know full well all that stuff was made up. They are not dumb. Please stop giving them credit for being honest. They have no shame about lying to advance their cause. This is a new day. Our old adversaries may have honestly believed the things they proclaim, but this new batch cares not a whit about truth.

I understand. The statute is not the governing law here. The U.S. Constitution is. That provision of the Federal Vacancy Act is almost certainly unconstitutional by any measure.

The following law provides that Whitaker is the ONLY ONE that can appointed at this time.

You're reading that part of the statute incorrectly. The "first assistant" of the U.S. Attorney General is not his chief of staff. It's the Deputy AG.

I notice they leave out the part where he says it is written in a US Statute. By putting that in , people might decide to look at the statute themselves and find out that he ( and the NY Post ) are not giving the full story.

You are right. The President used the Vacancy Reform Act which gives him 210 days before confirmation. Nothing illegal about it.

Legal nuts and bolts are handled by the Deputy Attorney General, according to DOJ Operations Manual. The AG is a broad policy maker. AGs used to be little more than cronies of the president.

There's nothing illegal about it, but it almost certainly is unconstitutional.

That's why the complaints about the appointment have been so muted -- and they've come almost entirely from lawyers and think-tank types outside of government.

What's Chuck Schumer or Nancy Pelosi going to do -- complain about a vacancy appointment that's been done under an unconstitutional law that they both voted for in 1998? LOL.
