The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The 4th Amendment is probably, next to the First Amendment, the most recognizable to the average American. After all, how many times have we seen some television character answer the front door and politely ask the police waiting there if they have a warrant? The founders fashioned this amendment after having endured the uncertainty and tyranny of British soldiers conducting searches whenever the spirit moved them to do so, typically with no more cause than bare suspicion or vengeance. Unfortunately, the Fourth Amendment is singularly threatened in our modern society, and is threatened more now than ever.

Tell a cop (and then a judge) he doesn’t have the right to search your car. Or that he can’t stop and roust you for being “in a known drug area.”

And yes, DWB is alive in some places (although not as prevalent as the race-whores would have you believe).

4th Amendment? It has long ago joined the 9th and 10th on the dustbin of prior known freedoms. As the 1st is about to.

When I left a particular cop job on an indian reservation, while moving away the chief deputy took an officer to my apartment and told the housing authority I abandoned the place. The housing authority let them in. They searched the place (and tore it up in the process) and they seized almost $5000.00 in private property including a laptop and computer related items. I have been told that the res is a ‘sovereign nation’ and is exempt from the constitution as well as state laws . Even though when I took my oath it was to defend the constitution and laws of the state and res.,
I still don’t have an avenue of recourse as the local and state prosecutors office won’t touch it and the only attorney that would take it wants a $15000.00 retainer.

This one has been trashed bad of late. We have a local cop who likes to harass the high school kids. Pulls them over for any minor infraction, claims he smells pot smoke, every time, and has the kid(s) handcuffed sitting down while he searches. He rarely finds anything. I know people are sick of him, but he continues on.

Tell that to the cop who stops you @ a sobriety check point, shines a flashlight in your face, & says “Papers, please!” when you are simply minding your own business.

WHAT 4th Amendment?

The 4th amendment was repealed with the 16th:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration.

(I’m just about to send away every bit of my personal financial information to the IRS tomorrow)

Yeah, I was walking home from work around 1:45 AM several months ago, walking down a public sidewalk, when a cop flashed his lights @ me @ asked me what I was doing there....where I was going...why I was out that late....yada yada yada.

When he asked me where I was going, I pointed in the direction I was headed & said, “That way”; he then asked me where I was coming from, & I turned a 180, pointed my finger, & said “THAT way!”. Needless to sday he didn’t like it. SCREW HIM!

I know...the cops can KMA, however. All I wanted to do was get home from work, & I had to walk about 4 & 1/2 miles one-way ‘cuz I can’t drive anymore (I’m legally blind). Being stopped like that w/ the lights blaring was really embarrassing.

We’re way beyond invasive searches in this country. We’re at the point now where the President decides if you can have your job, how much money you can make, how your business can be conducted and where. Soon, we’ll be told what kind of cars we can use, what kind of light bulbs, how much electricity and water, who knows where it will end?

Income tax is unconstitutional and you are giving up you 5th amendment when you send in your 1040

IIRC, in the instance of a sobriety checkpoint, the LEOs are suppose to only be checking for drunkenness and nothing else. (unless there's something obvious)
