North German court rules bread rolls and coffee don’t constitute breakfast: report

According to a court judgement in North Rhine-Westphalia published on Monday, bread rolls and coffee aren’t considered a complete breakfast and therefore not subject to taxation.

The ruling, which was made by a tax court in the city of Münster, stated that breakfast does not consist of just bread rolls and hot drinks, it is also accompanied by cold cuts, cheese or spreads, German media reported.

Due to the lack of spreads and other types of toppings to accompany the bread rolls, the company in question was not serving a complete breakfast, the tax court found.

After a software company with about 80 employees had been providing in their canteen free hot drinks such as coffee and plain bread rolls for staff, customers and guests each day, the tax office saw this as a “free provision of a meal to the employee in the form of a breakfast.” …

Odd, I've never thought of cold cuts, cheese, or spreads as breakfast foods.

Continental breakfast. The rolls were bakery fresh though unlike most of our fare until we've caught up a bit. I haven't been to Germany, but IIRC it also included orange juice.

I'm amazed they didn't mention Nutella by name - every time I visit Germany, that seems to be a standard part of breakfast.

I spent a week in Germany and Austria two decades ago. After having semi-stale Kaiser rolls for breakfast every day (at multiple locations), I refuse to eat those darn things ever again.

Odd. A tax court limiting the ability of a gub'mint to tax.

Except when a tax would make a bill illegal, so it's ruled a "fee"...

When I was working in Boston, for breakfast, I'd buy two rolls, with butter, from Au Bon Pain, head up to my desk, and have a coffee with the rolls.

What about islamist gored sheep blood? Is that breakfast? Or they just never comment about Hallal stuff? I mean, if they want to nanny what is what I eat, they might as well come out the closet and demand hallal while at it!

Basically, that is what a Continental Breakfast is. Continental is referring to Europe as opposed to and English, Irish or American Breakfast. Normally a Continental Breakfast is a cold breakfast with coffee, tea or orange juice. There are bread rolls, often croissants. And with them there are cheeses, jams, and cold cured meats. All of this is available on a sideboard and generally is served without table service. This breakfast is often provided free with a room at a hotel or bed and breakfast.

I wouldn’t consider tax on anything that did not have a brace of fried eggs, taters, ham steaks and biscuits and gravy.

Odd, I've never thought of cold cuts, cheese, or spreads as breakfast foods.

My first morning in Germany at NATO in Stuttgart I was served cold cuts, cheese and spreads with my rolls and coffee. I didn't know enough "kitchen German" to complain without sounding like an "ugly American," so I ate everything on my plate!

Every time my company gives me a shirt, its taxed. Taken to the extreme, large perks like vacations can be ‘given’ to employees...of course the other extreme is this German taxman trying to tax coffee.
